A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE CRIME CONTROL ACT OF 1984 TO EXPEND UP TO FIVE HUNDRED TEN THOUSAND DOLLARS ($510,000.00) FROM THE PARTIAL FEDERAL FORFEITURE (DOJ) FUNDS FOR THE PURCHASE OF AND SUPPLEMENTAL FUNDING OF POLICE VEHICLES AND STAFFING RESOURCES; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City and its Police Department are authorized to expend forfeiture funds from the established Department of Justice (DOJ) federal forfeiture account, for the approved programs or purchases intended to enhance law enforcement purposes; and WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, upon the request of the Chief of Police to the governing body of a municipality, federally forfeited funds may be expended if accompanied by written certification that the request complies with the provisions of the Comprehensive Crime Control Act of 1984; and WHEREAS, the Chief of Police has submitted a request for the expenditure of up to Five Hundred Ten Thousand Dollars ($510,000.00) in federally forfeited funds in compliance with the aforementioned. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached certification, the Chief of Police is hereby authorized to spend up to $510,000.00 from the established Department of Justice (DOJ) federal forfeitures account for the purchase of and supplemental funding of-Police vehicles and staffing resources. Maas, Chief of Police DATE: 9/17/2009 RE: Approval to Expend Partial Forfeiture (DOJ) Funds for the purchase of and supplemental funding of police vehicles and staffing resources, in an amount not to exceed $510,000.00 RECOMMENDA TION: It is recommended that the City Commission approve the expenditure of partial Federal (DOJ) Forfeiture Funds, previously awarded to the Police Department as the results of investigative participation in forfeiture and seizure cases. These funds are permissible by law to be spent for the purchases of police equipment, staffing resources and other law enforcement activities. It is requested that we be permitted to utilize up to $510,000.00 of said funds on deposit for such purpose. REASONS: The Sunny Isles Beach Police Department actively participates in an FBI / HIDTA (High Intensity Drug Trafficking Area) Initiative Group that conducts numerous ongoing proactive investigations and has a need for the attached listed equipment. ADDITIONAL INFORMATION: One of the benefits of participating in and providing personnel into high intensity narcotics investigations is the sharing of confiscated proceeds for the enhancement of law enforcement. Whereas the Police Department is facing budget cuts of up to 17% for the upcoming fiscal year 09/10, these cuts will place a serious impact on our staffing, assignments and equipment. As a result of these budget cuts, it is estimated that the police department will have to decrease our staffing levels from forty-eight (48) sworn officers to forty-five (45) sworn officers, thus causing us to reassign Agenda Item ~ http://sibagenda.sibfl.net/agenda/Preview .aspx?I temID=89&MeetingID=0( () q n~tp 1-'. _ h Preview Page 2 of2 our current under cover detectives (2) and our School Resource Officer (1) back to the patrol division. These reassignments will cause a tremendous void in the areas of school security and valuable criminal intelligence gathering and enforcement. In addition to staffing cuts, the police department will also be forced to cut most new vehicle purchases as well as vehicle rental agreements (Detective Bureau) for FY09/10. In order to assure adequate staffing levels and reliable equipment, it is requested that we be permitted to utilize up to $ 510,000.00 of said funds on deposit for the below listed purpose. All of the below listed items are authorized expenditures and are designed towards drug interdiction, community safety programs, crime prevention programs, staffing resources and the enhancement of law enforcement equipment as well as legal costs associated with the asset forfeiture process.
