Home My WebLink AboutReso 2009-1470 RESOLUTION NO. 2009 - \ 41 () A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE FIRST AMENDMENT TO AGREEMENT WITH TENEX ENTERPRISES, INC., FOR THE SR AlA/COLLINS A VENUE STREETS CAPE IMPROVEMENTS PROJECT, IN AN AMOUNT NOT TO EXCEED NINETY-NINE THOUSAND FIVE HUNDRED THIRTY DOLLARS AND FIVE CENTS ($99,530.05), ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE SAID FIRST AMENDMENT TO AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City was in need of a contractor to furnish all materials, equipment and labor for the streetscape improvements along Collins A venue from 18ih Street to the William Lehman Causeway; and WHEREAS, on December 18,2008 via Resolution No. 2008-1357, the City Commission awarded Bid No. 08-10-01, and entered into an agreement with Tenex Enterprises, Inc., to provide services on a unit price basis for the SR AlA/Collins Avenue Streetscape Improvements, in an amount not to exceed Nine Hundred Sixty-Eight Thousand Three Hundred Nineteen Dollars and Twenty-Seven Cents ($968,319.27); and WHEREAS, the City now desires to add the construction of six (6) retention ponds on Collins Avenue and install landscape and Palm Beach Cap Rock; and WHEREAS, Tenex Enterprises, Inc., has expressed its ability and desire to provide these services and provided the City with a proposal for these services in an amount not to exceed Ninety- Nine Thousand Five Hundred Thirty Dollars and Five Cents ($99,530.05); and WHEREAS, the City wishes to approve the First Amendment to the Agreement with'Tenex Enterprises, Inc. to provide these services for the SR AlA/Collins Avenue Streetscape Improvements, in an amount not to exceed Ninety-Nine Thousand Five Hundred Thirty Dollars and Five Cents ($99,530.05), attached hereto as Exhibit "A", bringing the total contract amount not to exceed One Million Sixty-Seven Thousand Eight Hundred Forty-Nine Dollars and Thirty-Two Cents ($1,067,849.32), unless amended by prior approval of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of First Amendment to Agreement. The First Amendment to Agreement with Tenex Enterprises, Inc., to add the construction of six (6) retention ponds on Collins A venue and install landscape and Palm Beach Cap Rock, in an amount not to exceed Ninety-Nine Thousand Five Hundred Thirty Dollars and Five Cents ($99,530.05), attached hereto as Exhibit "A", be and the same, is hereby approved. ("Contractor") a business corporation licensed in the State of Florida, whose Federal Identification # is S'Z"Z-OG:fl~14 The City and Contractor hereby agree as follows: 1. ADDITIONAL SCOPE OF WORK: The City wishes to add to the original Agreement with the Contractor for the SR AlA/Collins Avenue Streetscape Project, by adding the construction of six (6) retention ponds on Collins A venue and the installation of landscape and Palm Beach Cap Rock ("Services"), as more fully described in Attachment "A", attached hereto and made a part hereof. 2. COST: The Contractor agrees to charge an amount not to exceed Ninety-Nine Thousand Five Hundred Thirty Dollars and Five Cents ($99,530.05) for said Services, bringing the total amount not to exceed One Million Sixty-Seven Thousand Eight Hundred Forty-Nine Dollars and Thirty-Two Cents ($1,067,849.32). 3. TERM: The term of this First Amendment shall begin upon execution by the parties hereto and shall end thirty (30) days thereafter. 4. OTHER PROVISIONS REMAIN IN EFFECT: Except as specifically modified herein, all terms and conditions of the Original Agreement between the parties, approved via Resolution No.2008- 1357, shall remain in full force and effect. RECOMMENDATION: The staff recommends the approval of a Resolution amending the contract with Tenex for the Collins Avenue Streetscape in an amount not to exceed $99,530.05 to allow the development of the six median islands in Collins Avenue at Sunny Isles Boulevard. REASONS: We have just completed the original Collins Avenue Southbound Streetscape Project just south of the Lehman Causeway and it is certainly a wonderful addition to the City. The project came in almost two hundred thousand dollars under budget. At a recent Citizens Advisory Committee Meeting, the request was made to begin improving the streetscape of Collins near Sunny Isles Boulevard. The original plan was to include this area, but it was feared that there would not be sufficient funds so it was eliminated. Because we have very good bids on the unit items, we would like to extend the project to include the six small islands under and around the Sunny Isles Boulevard Flyover in this project and continue the great work already started. Therefore the staff asks for your approval of this Resolution amending the contract with Tenex for the Collins Avenue Streetscape in an amount not to exceed $99,530.05. ADDITIONAL INFORMATION: Funding for this project will come from the Capital Project Account for the Collins A venue ATTACHMENTS: .
