A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, RATIFYING THE APPROVAL
OF THE WAIVER OF PLAT FOR THE VACANT PROPERTY
LOCATED WEST OF COLLINS AVENUE ALONG 175 TERRACE
AND SOUTH OF ATLANTIC BOULEVARD, ATTACHED HERETO
AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO DO
ALL THINGS NECESSARY TO EFFECTUATE THIS
RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on September 18,2008 via Resolution No. 2008-1328, the City Commission
approved an Option Agreement with Avila Condominium Association, Inc., for the purchase and
sale of real property located at the NE corner of 175th Terrace, in order to create a municipal parking
lot/garage for Samson Oceanfront Park; and
WHEREAS, on March 13, 2009, the Miami-Dade County Plat Committee reviewed and
approved the Waiver of Plat D-23041, attached hereto as Exhibit "A".
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Ratify Approval of Waiver of Plat. The Waiver of Plat, attached hereto as Exhibit
"A", for the vacant lot located west of Collins Avenue along 175 Terrace and south of Atlantic
Boulevard is hereby approved.
Section 2. Authorization of the City Manager. The City Manager is authorized to do all things
necessary to effectuate this Resolution.
Section 3.
Effective Date. This Resolution shall become effective upon adoption.
PASSED AND ADOPTED this 16th day of April 2009.

the Miami-Dade County Plat Committee on March 13,2009.

REQUESTED ACTION
The staff recommends that the City Commission adopts this Resolution for Waiver of Plat of the
vacant property located West of Collins Avenue along 175 Terrace and South of Atlantic
Boulevard.
BACKGROUND
The City of Sunny Isles Beach purchased the above indicated property from Avila North. The City
of Sunny Isles Beach has obtained approval for a Waiver of Plat from the Miami-Dade County
Plat Committee on March 13, 2009 to allow the City to avoid a lengthy and expensive platting
process. This resolution will allow the Waiver of Plat to be part of the City of Sunny Isles Beach
record.
