A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, APPROVING CHANGE
ORDER NO. 1 TO AGREEMENT WITH COASTAL
CONSTRUCTION COMP ANY FOR PROFESSIONAL
CONSTRUCTION SERVICES FOR THE HERITAGE PARK
AND PARKING GARAGE PROJECT, IN AN AMOUNT NOT
TO EXCEED NINE HUNDRED THREE THOUSAND FOUR
HUNDRED TWENTY-SEVEN DOLLARS ($903,427.00),
ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE
CITY MANAGER TO DO ALL THINGS NECESSARY TO
EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City of Sunny Isles Beach issued Request for Qualifications No. 09-
03-01 for Professional Construction Services for the Heritage Park and Parking Garage; and
WHEREAS, on June 18, 2009 via Resolution No. 2009-1434, the City Commission
awarded Request for Qualifications No. 09-03-01, and entered into an agreement with Coastal
Construction Company, to provide construction services for Heritage Park and Parking
Garage, in an amount not to exceed Nine Million Two Hundred Fifty Thousand Dollars
($9,250,000.00); and
WHEREAS, the City bifurcated the agreement to allow the contractor to commence
construction on the parking garage portion of the project; and
WHEREAS, the City entered into a contract for the construction of the parking garage
at Heritage Park for an amount not to exceed Six Million Six Hundred Thousand Forty Dollars
($6,600,040.00); and
WHEREAS, the City now desires to amend the plan to change the fayade to add a
decorative screening to the parking garage, add masonry and to address additional comments
from the Fire Department; and
WHEREAS, Coastal Construction Company, has expressed its ability and desire to
provide these services and provided the City with a proposal for these services in an amount
not to exceed Nine Hundred Three Thousand Four Hundred Twenty-Seven Dollars
($903,427.00); and
WHEREAS, the City wishes to approve Change Order No.1 to the Agreement with
Coastal Construction Company to provide these services for the construction of the Heritage
Park and Parking Garage Project, in an amount not to exceed Nine Hundred Three Thousand
Four Hundred Twenty-Seven Dollars ($903,427.00), attached hereto as Exhibit "A", bringing
the total contract amount not to exceed to Seven Million Five Hundred Three Thousand Four
Hundred Sixty-Seven Dollars ($7,503,467.00) for the parking garage, unless amended by prior
approval of the City; and
WHEREAS, the overall contract amount approved under Resolution No. 2009-1434
for the construction of the park and parking garage for Heritage Park remains the same, in an
amount not to exceed Nine Million Two Hundred Fifty Thousand Dollars ($9,250,000.00).
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Change Order No. 1 to Agreement. Change Order No. 1 to
Agreement with Coastal Construction Company, to add Nine Hundred Three Thousand Four
Hundred Twenty-Seven Dollars ($903,427.00) to the Heritage Parking Garage Project, in an
amount not to exceed Seven Million Five Hundred Three Thousand Four Hundred Sixty-
Seven Dollars ($7,503,467.00) for the parking garage, attached hereto as Exhibit "A", be and
the same, is hereby approved.
Section 2. Authorization of City Manager. The City Manager is hereby authorized to do
all things necessary to effectuate this Resolution.
Section 3.
Effective Date. This Resolution will become effective upon adoption.

DESCRIPTION OF SCOPE OR WORK CHANGES:
Delete poured in place crash walls, add perimeter barrier cables, add concrete eyebrows and
vertical fins, add decorative screening and split faced, colored masonry walls, add decorative
metal screening at ground f1oor, delete Public Works office on ground floor, add masonry
refuge shelters at stairwells, add F P & L work to provide permanent power to site.
NOTE: Unless specifically stated clearly elsewhere on this page, this change order does NOT include an extension
of time or grant any additional general conditions amounts. The City and the Contractor agree that the contract
time adjustment and sum agreed to in this document constitute a full and complete settlement of the matters set
forth herein, including all direct and indirect costs for equipment, manpower, mat rials, overhead, profit and delay
relatin to the issues set forth in this document.

First Amendment to Heritage Park Parking Garage Contract
RECOMMENDATION:
Staff recommends approval of the attached resolution amending Heritage Park parking garage
contract.
REASONS:
In June 18, 2009 under Resolution No. 2009-1434, the City Commission approved a contract
with Coastal Construction Company for the construction of Heritage Park and Parking Garage in
the amount not to exceed $9,250,000.
Under that same resolution the contract was bifurcated to allow the contractor to commence
construction of the parking garage portion of the property since the park portion was being
redesign. The City entered into a contract with the contractor for the construction of the parking
garage for an amount not to exceed $6,600,040.
The City has amended the original plans to change the facade of the garage to add a decorative
screening, additional masonry wall have been added and also to address comments from the Fire
Department. All these changes to the original plans have constituted a change order in an
amount not to exceed $903,427 to the contract for the construction of the parking garage. This
change order brings the agreement to an amount not to exceed $7,503,467. This change order
does not change the overall contract amount of $9,250,000.

At its regular meeting of January 28, 2010, the City Commission adopted
Resolution No. 2010-1520, which approved Change Order No.1 to Agreement
between the City of Sunny Isles Beach and Coastal Construction Company for the
construction of the Heritage Park and Parking Garage. Attached for your records
is a copy of said Change Order No.1 and a copy of the approving resolution.
