HomeMy WebLinkAboutReso 2010-1526 RESOLUTION NO. 2010 - 15~1.o A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, REAPPOINTING JUDGE ROBERT NEWMAN, MAURICE DONSKY, ESQ., MIMI V. TURIN, ESQ., REGINE MONESTIME, ESQ., AND RAFAEL E. SUAREZ-RIVAS, ESQ. AS SPECIAL MASTERS, AND APPOINTMENT OF NEW SPECIAL MASTER ELLEN LAVIN, ESQ., FOR A PERIOD OF ONE YEAR, IN ACCORDANCE WITH CITY CODE SECTION 14-3; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 14-3 of the City of Sunny Isles Beach Code provides that appointments of Special Masters shall be made by the City Manager, as needed, on the basis of experience for a term of one year; and WHEREAS, said Section 14-3 provides that reappointments shall be submitted to the City Commission for ratification; and WHEREAS, Judge Robert Newman, Maurice Donsky, Esq., Mimi V. Turin, Esq. were previously re-appointed last year, and Regine Monestime, Esq. and Rafael E. Suarez-Rivas were newly appointed last year as Special Masters; and the City being satisfied with their excellent work as Special Masters desires to reappoint them, and appoint a new Special Master Ellen Lavin, Esq.; and WHEREAS, they have all acted as Special Masters for other municipalities in Miami-Dade County. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section I. Reappointments and New Appointment of Special Masters. The City Manager's reappointments of Judge Robert Newman, Maurice Donsky, Esq., Mimi V. Turin, Esq., Regine Monestime, Esq., and Rafael E. Suarez-Rivas, Esq., and newly appointed Ellen Lavin, Esq. as Special Masters for a period of one year, are hereby ratified by the City Commission, in accordance with City Code Section 14-3. Turin, Attorney Regine Monestime, and Attorney Rafael E. Suarez-Rivas, as Special Masters for the City of Sunny Isles Beach, and a new appointment of new Special Master Ellen Lavin. REASONS: Special Masters are the presiding officers at our Code Enforcement and Red Light Appeals Administrative Hearings. Administrative hearings provide a means by which individuals cited for code violations can plead their case and be heard before an impartial party. Sunny Isles Beach Code Section 14-3 states that appointments of Special Masters shall be made by the City Manager, as needed, on the basis of experience, skills and abilities and, whenever possible, shall include persons with legal zoning, engineering and/or construction experience, for a term of one year. The Code further states that appointments shall be submitted to the City Commission for ratification. Judge Robert Newman, Attorney Maurice Donsky, Attorney Mimi V. Turin, Attorney Regine Monestime, and Attorney Rafael E. Suarez-Rivas are our current Special Masters, and are serving with favorable results to date. The City Attorney has recommended these individuals to me, and therefore, I recommend the reappointment of all of the City's current Special Masters, and a new appointment of Special Master Ellen Lavin, Esq.
