HomeMy WebLinkAboutReso 2010-1528 RESOLUTION NO. 2010- IS 2<6 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER AND/OR HIS DESIGNEE TO APPLY FOR, RECEIVE AND EXPEND GRANT FUNDS FROM THE FLORIDA INLAND NA VIGA TION DISTRICT WATERWAYS ASSISTANCE PROGRAM THROUGH THE STATE OF FLORIDA, IN AN AMOUNT OF UP TO TWO HUNDRED FIFTY THOUSAND DOLLARS ($250,000.00), FOR THE PURPOSE OF SITE IMPROVEMENTS AT THE BELLA VISTA BAY P ARK LOCATED AT 500 SUNNY ISLES BOULEVARD; AUTHORIZING THE CITY MANAGER TO TAKE ANY AND ALL ACTION NECESSARY WITH RESPECT TO THE OBT AINING, ACCEPTANCE, AND DISTRIBUTION OF GRANT MONIES, AS APPROPRIATE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach is interested in carrying out the following described project for the enjoyment of the citizenry of the City of Sunny Isles Beach and the State of Florida: Project Title: Total Estimated Cost: Bella Vista Park $500,000 Brief Description of Project: The project will include the removal and replacement of the existing concrete and steel seawall structure. The creation of this new retaining wall will allow the creation of a kayak launch and a baywalk/trail that will allow connection to the City's pedestrian and bicycle system. The hard surface walkway will bisect the inland portion connecting the docs, pavilions and other amenities on the site to allow for access from the adjacent parking lot. The walkways throughout the park will be ADA compliant and provide disabled access up to the waterway; and WHEREAS, Florida Inland Navigation District financial assistance is required for the program mentioned above. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Proiect Authorized. The City Commission of the City of Sunny Isles Beach finds that the project described above be in the same and is hereby authorized. Section 2. Authority to Apply For and Accept Grant. The City Manager and/or his designee is authorized to make application to the Florida Inland Navigation District in the amount of 50% of the actual cost of the project on behalf of the City of Sunny Isles Beach. Section 3. Accepts the Terms and Conditions. The City accepts the terms and conditions set forth in FIND Rule 66B-2 F.A.C. and which will be a part of the Project Agreement for any R201O- FL Inland Navigation Waterways Grant for Bella Vista Bay Pk ($200,000) Page I of3 assistance awarded under the attached proposal. Section 4. City is in Complete Accord. The City is in complete accord with the attached proposal and that it will carry out the Program in the manner described in the proposal and any plans and specifications attached thereto unless prior approval for any changes has been received from the District. Section 5. City Intends to Finance its Share. The City has the ability and intention to finance its share of the cost of the project and that the project will be operated and maintained at the expense of City of Sunny Isles Beach for public use. Section 6. City Will Not Discriminate. The City will not discriminate against any person on the basis of race, color or national origin in the use of any property or facility acquired or developed pursuant to this proposal, and shall comply with the terms and intent of the Title VI of the Civil Rights Act of 1964, P.L. 88-352 (1964) and design and construct all facilities to comply fully with statutes relating to accessibility by handicapped persons as well as other federal, state and local laws, rules and requirements. Section 7. City Will Maintain Adequate Financial Records. The City will maintain adequate financial records on the proposed project to substantiate claims for reimbursement. Section 8. Make Available a Post-Audit of Expenses to FIND. The City will make available to FIND if requested, a post-audit of expenses incurred on the project prior to, or in conjunction with, request for the final 10% of the funding agreed to by FIND. Section 9. Authorization of the City Manager. The City Manager is authorized to take any and all action necessary with respect to the obtaining, acceptance, and distribution of grant monies, as appropriate. Section 10. Effective Date. REASONS: This is the second in a trio of grants we are going after to develop Bella Vista Bay Park. The other two are the Coastal Management Program ($60,000) and Land & Water Conservation Fund ($200,000). These funds, along with another $400,000 we are seeking thru Florida Recreation Development Assistance Program (FRDAP) and Safe Neighborhood Parks (SNP) will put us in a position to complete the initial infrastructure improvements to the seawall, docks and site work. The grant application deadline is April 1, 2010 with notice of award expected June 15, 2010 and funds available beginning October 1, 2010. Grants require a dollar-for-dollar cash match.
