HomeMy WebLinkAboutReso 2010-1530 RESOLUTION NO. 2010 - I 5'?i') A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE FIRST ADDENDUM TO AGREEMENT WITH AMERICAN TRAFFIC SOLUTIONS, INC. (ATS) TO PROVIDE COLLECTION SERVICES FOR ALL PHOTO ENFORCEMENT VIOLATIONS REMAINING UNPAID, ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO EXECUTE SAID FIRST AMENDMENT TO AGREEMENT AND TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach desires to see accidents and potential accidents significantly reduced in our City by educating drivers as to the need to observe traffic signals; and WHEREAS, on July 17,2008 via Resolution No. 2008-1290, the City Commission entered into an agreement with American Traffic Solutions, Inc. (A TS), to install red light cameras at the intersections on Collins A venue to give continuous video coverage to our Police Department, at no cost to the City, however the City shares in the revenues generated by the fines; and WHEREAS, the City now desires to have A TS provide the City with collection services for all photo enforcement violations remaining unpaid after issuance of second notice; and WHEREAS, A TS has provided the City with a proposal for these services with a collection fee of30% of the unpaid amounts collected to be paid to ATS, with annual renewal periods; and WHEREAS, the City wishes to enter into an agreement with A TS to provide collection services for all photo enforcement violations remaining unpaid after issuance of the second notice, with a collection fee of 30% ofthe unpaid amounts collected to be paid to A TS, attached hereto as Exhibit "A". NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of First Addendum to Agreement. The First Addendum to Agreement with American Traffic Solutions, Inc. (A TS) to provide collection services for all photo enforcement violations remaining unpaid with a collection fee of30% ofthe unpaid amounts collected to be paid to ATS, attached hereto as Exhibit "A", be and the same, is hereby approved. Section 2. Authorization of City Manager. The City Manager is hereby authorized to execute said First Amendment to Agreement and to do all things necessary to effectuate this Resolution. Section 3. Effective Date. This Resolution will become effective upon adoption. PASSED AND ADOPTED this 18th day of February 2010. AGREEMENT CONTRACT NO. C0910-028 THIS FIRST ADDENDUM TO THE AMERICAN TRAFFIC SOLUTIONS AGREEMENT, executed this day of , 2010, is made a part of the original Agreement between the parties, attached hereto as Attachment "A" and incorporated herein, (the "Agreement") approved via Resolution No. 2008-1290 between the City of Sunny Isles Beach ("City") and American Traffic Solutions, Inc. ("Vendor") a business corporation licensed in the State of Florida, whose Federal Identification # is . The City and Vendor hereby agree as follows: 1. ADDITIONAL SCOPE OF SERVICES: The City wishes to add to the original Agreement with the Vendor to provide collection services related to the digital photo red light enforcement system provided by Vendor. The additional scope of services to be provided by Vendor shall include providing collection services to the City for all photo enforcement violations remaining unpaid after issuance of the second notice. The methods of the collection services are required to be pre-approved by the City Manager or his designee and shall be consistent with the industry standards for collection practices. 2. COST: As a collection fee Vendor shall be paid 30% (thirty percent) of the unpaid amounts collected. Any collections that Vendor has attempted to collect prior to termination of the Agreement but which are still unpaid at the time of termination will be paid to Vendor following termination of the Agreement under the terms described herein. 3. TERM: The term of this First Addendum shall begin upon execution by the parties hereto and shall end upon the completion of the additional scope of services. There will be annual one (1) year renewal periods for the collections services, however, the City Manager or his designee has the right to discontinue these additional collection services at any time in his sole discretion. 4. OTHER PROVISIONS REMAIN IN EFFECT: Except as specifically modified herein, all terms and conditions of the original Agreement between the parties, which was approved and adopted via Resolution No. 2008-1290 on July 17,2008, shall remain in full force and effect. REASONS: Under the current agreement, A TS is required to issue two past due notices to violators. Beyond that, there is no further follow-up. The addendum will authorize A TS to institute collection actions on violations that remain unpaid beyond that point for a fee of 30% of the actual cash collected.
