RESOLUTION NO. 2010- J 533
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, RATIFYING AN
EXISTING UTILITY EASEMENT AGREEMENT WITH
FLORIDA POWER AND LIGHT COMP ANY ("FPL") FOR
SUNNY ISLES BEACH GOVERNMENT CENTER AND TONY
ROMA'S PROPERTIES, ATTACHED HERETO AS EXHIBIT
"A"; AUTHORIZING THE CITY MANAGER TO DO ALL
THINGS NECESSARY TO EFFECTUATE THIS
RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Sunny Isles Beach is in the process of platting the Government
Center and Tony Roma's properties; and
WHEREAS, existing Florida Power and Light Company ("FPL") easements that are on
the property had not been dedicated; and
WHEREAS, FPL requires a Utility Easement Agreement with the City in order to have
the proper dedication of those easements.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified
and confirmed as being true and the same are hereby made part of this Resolution.
Section 2. Ratify Approval of Utility Easement Agreement. The City Commission of the
City of Sunny Isles Beach hereby approves the Utility Easement Agreement with FPL, attached
hereto as Exhibit "A".
Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate this Resolution.
Section 4. Effective Date. This Resolution will become effective upon adoption by the City
Commission.
PASSED AND ADOPTED this 18th day of February 2010.

Florida Power and Light Easement Agreement
RECOMMENDA TION:
The attached resolution is recommended for approval by the City Commission.
REASONS:
The City Commission approved a resolution that replatted the City Hall and Tony Romas
property in the January City Commission meeting. The surveyor preparing the plat
found that two utility easements for FPL that are currently servicing the City Hall and
Tony Romas Restaurant had not been recorded or dedicated to FPL.
This resolution is to ratify the dedication of the existing easements that should have been
dedicated when the City Hall and Tony Romas Restaurant were being built. Once this
resolution is approved and the utility easement dedicated the plat can be recorded.
