A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE THIRD
ADDENDUM TO THE AGREEMENT WITH MARLIN
ENGINEERING, INC. FOR THE SUNNY ISLES BOULEV ARD/
SR826 PROJECT, IN AN AMOUNT NOT TO EXCEED TWENTY-
TWO THOUSAND SIX HUNDRED FIFTY DOLLARS ($22,650.00),
ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE
MAYOR TO EXECUTE THE THIRD ADDENDUM TO THE
AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO
ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF
THE AGREEMENT; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on June 21, 2007, the City Commission adopted Resolution No. 2007-1110
approving an agreement with Marlin Engineering, Inc., in an amount of Eighty-Four Thousand
Two Hundred Seventy-Two Dollars and Thirty-Nine Cents ($84,272.39), to provide Post Design
Services during the construction of the Sunny Isles BouIevard/SR 826 Project; and
WHEREAS, on November 15,2007, the City Commission adopted Resolution No. 2007-
1180 approving a First Addendum to the Agreement with Marlin Engineering, Inc., in an amount
not to exceed Forty-Six Thousand Nine Hundred Seventy-Three Dollars and Eighty-Five Cents
($46,973.85), to provide additional services by performing a Subsurface Utility Exploration
(SUE) so that FP&L can include the undergrounding of power lines, and to replace the existing
water main along the south side of Sunny Isles Boulevard; and
WHEREAS, on January 17, 2008, the City Commission adopted Resolution No. 2008-
1199 approving the Second Addendum to the Agreement with Marlin Engineering, Inc., in an
amount not to exceed Seventeen Thousand Four Hundred Fifty Dollars ($47,720.00), to provide
additional services by providing Post Design Services during construction to include: 1)
construction for the State Road 826 Sidewalk Enhancement Project, and 2) design of the
reconstruction sidewalk and the installation of supplemental drainage system in the form of
slotted drain at the northern right-of-way limit; and
WHEREAS, the City wishes for the Consultant to provide additional servIces by
providing Post Design Services during construction to provide consulting Civil Engineering
Services for the plans design of an existing I2-inch water main extension relocation along Sunny
Isles Boulevard from approximately Sta. 134+51 to Sta. 136+45 connecting to the newly
constructed water main completed by St. Tropez on the Bay Project; and
WHEREAS, Marlin Engineering, Inc. has submitted a proposal, and the City wishes to
accept the proposal modifying the agreement to include this work, in an amount not to exceed
Twenty- Two Thousand Six Hundred Fifty Dollars ($22,650.00), for a total contract amount of
$201,616.24, attached hereto as Exhibit "A".

NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The recitals contained In this resolution are
incorporated herein by reference.
Section 2. Approval of Third Addendum to the Agreement. The Third Addendum to the
Agreement with Marlin Engineering, Inc., attached hereto as Exhibit "A", be and the same, in an
amount not to exceed Twenty-Two Thousand Six Hundred Fifty Dollars ($22,650.00), for a total
contract amount of $20 1,616.24, is hereby approved.
Section 3. Authorization of Mayor. The Mayor is hereby authorized to execute Amendment
to Agreement.
Section 4. Authorization of City Manager. The City Manager is hereby authorized to all
things necessary to effectuate the terms of the agreement.
Section 5.
Effective Date. This Resolution will become effective upon adoption.

THIRD ADDENDUM TO CITY OF SUNNY ISLES BEACH
AND MARLIN ENGINEERING, INC. AGREEMENT
CONTRACT NO. C0708-093
THIS THIRD ADDENDUM TO THE MARLIN ENGINEERING, INC. AGREEMENT, executed this
I ~ay of ~~~, 2008, is hereby attached to and is made a part of said Marlin Engineering. Inc.
Agreement Contract No. C0607-083 by and between the City of Sunny Isles Beach ("City") and Marlin
Engineering, Inc. ("Contractor") a business corporation licensed in the State of Florida, whose Federal
Identification # is . The City and Contractor hereby agree as follows:
1. ADDITIONAL SCOPE OF WORK: The City wishes to add to the original Marlin Engineering, Inc.
Agreement to provide post design services during the construction of the Sunny Isles Boulevard/SR 826 Project, to
provide consulting civil engineering services for the plans design of an existing 12" water main extension
relocation along Sunny Isles Boulevard from approximately Sta. 134+51 to Sta. 136+45 connecting to the newly
constructed water main completed by St. Tropez on the Bay Project, as more fully described in Attachment "A".
2. COST: The Contractor agrees to charge the City an amount not to exceed Twenty-Two Thousand Six
Hundred Fifty Dollars ($22,650.00) for said services.
3. TERM: The term of this Third Addendum shall begin upon the execution date of this Third Addendum
and shall end three (3) months thereof.
4. INCORPORATION OF PRIOR TERMS AND CONDITIONS: Except as modified herein, the terms
and conditions of the original Agreement with Marlin Engineering to provide post design services during
construction of the Sunny Isles Boulevard/SR 826 Project, as well as the First and Second Addendum, shall remain
in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this document as of the date
mentioned above.

I RE: PROPOSAL FOR PROFESSIONAL SERVICES
EXISTING WATER MAIN REPlACEMENT (EASTMOST SEGMENT)
Dear Mr. Conner:
I Marlin Engineering, Inc. is please to respond to your request for proposal for the
refeJenaKt project.
1. PROJECT
Provide Consulting Civil Engineering Services for the plans design of an existing
12" water main extension relocation along Sunny Isles Boulevard from
approximately Sta. 134 + 51 to Sta. 136+45 connecting to the newly constructed
water main completed by St. Tropez on the Bay Project..
2. SCOPE OF WORK
1. Data Gathering and conferences with the City of Sunny Isles, and City of
North Miami Beach, as well as the regulatory agencies having jurisdiction
on the project, including Miami-Dade County DERM and WASD.
2. Obtain from others:
· Land Surveying necessary to determine the finish ground
elevations and other features (e.g. driveways, trees, electric poles
and lights, catch basins, etc.) along the alignment of the facilities
being designed in general,
· Subsurface Utility Engineering (SUE).
3. Preparing water main replacement plan and profile drawings in
accordance with the City of North Miami Beach construction standards
and specifications.
4. Dry-run and final plans submittal through the City of North Miami Beach,
Miami-Dade County DERM, and Fire Depts. and Department of Health
(DOH) for processing and approval. .

5. Preparing pertinent pennit application fonns and the required technical
support information for approvals before the City of North Miami Beach
Engineering Department, Miami-Dade County DERM. and DOH.
6. Preparing an Engineer's Estimate of probable Cost.
7. All permit and application fees and expenses required by reviewing
agencies will be paid directly by City of Sunny Isles-Beach.
8. MEI will provide Twenty (20) sets of plans for dry-run and final process.
9. MEI will provide the following services during the Construction Phase of

. Pre-construction Conference.
· Shop drawings and technical submittal review. Requests for
information (RFI) and plan clarification, as well as technical
interpretations of the construction plans when requested by Client.
· Three (3) Site Visits during the construction of the project.
3. COMPENSATION FOR PROFESSIONAL SERVICES
For the services performed under paragraph 2 Scope of Work, the Client will pay
the Engineer the lump sum fee of Twenty Two Thousand Six Hundred and Fifty
dollars ($22,650), as described below and payable monthly in proportion to the
services performed.

A- Bid Phase Services
· Document Review and meetings or discussions with the parties involved
in this process.
Should the Client wish us to provide and/or negotiate with third parties, any of the
aforementioned services or any other additional work not included in this proposal
under the Scope of Work, MEI will provide it on a Time Charge plus Expenses
, basis, computed as the sum of the following:
· Salary Costs times a multiplier of 3.00.
· Non-8atary expenses times a multiplier of 1.05

5. CLIENT RESPONSIBILITIES:
Provide access to and make all provisions for the Engineer to enter upon public
and private lands as required for the Engineer to perform his work under this
proposal.
Place at the disposal of the Engineer all available mfonnation pertinent to the
project upon which the Engineer can rely, including previous reports, boundary
and topographical survey, and any other -data related to the design and
constn,Jction of the project.
Designate a person to act as the Clienfs representative with respect to the work
to be perfonned, such person to have complete authority to transmit instructions,
receive infonnation, interpret and define the Clienfs policies and decisions with
respect to the work covered by this proposal.
6. ACCEPTANCE
The return of an executed copy of this proposal and completion of the fee
negotiation agreement would constitute our authorization to proceed.
