THE HERITAGE PARK AND PARKING GARAGE
1. TECHNICAL COMPETENCE
a. The project team's overall technical competency. The Heritage
Park project will require a talented landscape architect and structural
and mechanical/electrical engineers whose efforts must be carefully
coordinated with all site development efforts by an experienced
architect. McLeod Architectural Group (MAG), headed by Donald
McLeod, with be the design team's leader. All member of the MAG
design team are based in South Florida and each has more than 35
years' worth of experience with a wide variety of projects. Although the
Heritage Park project is primarily landscape architect-intensive and
parking garage intensive, it will contain buildings and spaces that must
be attractive, safe, and ADA compliant - features that require total
coordination by an architect. Mr. McLeod has developed procedures
and check lists that have returned significant benefits to Owners.
These benefits include the economies of competitive bidding, attractive
buildings that have been designed and detailed for a long life under
hard use, and cost effective construction and economical operations.
McLeod Architectural Group's (MAG's) team longevity and experience
are its best credentials.
The MAG landscape architect, Rosenberg Gardner Design (RGD), will
playa key roll in this project. RGD is experienced with the design of
parks and playgrounds, and has designed 26 parks and recreational
facilities during its 14-year history.
MAG's structural engineer, Hershell Gill Consulting Engineers (HGCE),
will playa key roll in the design of the parking garage, and HGCE has
designed 19 parking garages, some as a Design/Builder.
MAG's Mechanical/ Electrical engineer, Hufsey - Nicolaides - Garcia -
Suarez (HNGS), has designed dozens of commercial facilities, 31
parking garages, and 13 parks during its 42-year history.
A four-acre urban site bounded by the Lehman Causeway and Collins
Avenue, will require important Civil Engineering coordination with
FDOT, the South Florida Water Management District, DERM, and the
water and sewer departments. MAG's Civil Engineering Consultant,
Schwebke-Shiskin Associates (SSA) is a well established engineering
firm that has worked in worked in South Florida since 1950.

MAG has worked with and coordinated these consultants while
producing dozens of buildings since 1980. Most recently, MAG has
worked with HNGS, SSA, RGD and HGCE on the design of the
Goodwill Parking Garage (built for the Miami Parking Authority as
Garage #9) as well as the Watson Island Marina. Construction cost
prediction may also be important to the City of Sunny Isles Beach, and
the MAG team includes RTM Estimating (RTM). MAG has known and
worked with Russell Morris since 1980, when he was a construction
cost estimator and project superintendent for one of its manufacturing
projects in Hialeah. Since that time, Mr. Morris has worked for the
architectural department of Levitz Furniture, and estimated the
construction costs and represented the Owner's interest during the
design, permitting, bidding, and construction of dozens of new stores.
RTM is an experienced construction cost estimator, contractor, and
owner's agent.
b. The project manager's specific technical competency. Donald
McLeod, Architect, is a Board Certified Architect that has been
licensed by the State of Florida since 1972. He has been licensed by
25 other states, and has been professionally responsible for hundreds
of multi-million dollar projects. Mr. McLeod is the President and
founder of McLeod Architectural Group, a Miami-based architectural
firm that has been in continuous operation in Miami-Dade County for
more than 27 years. Mr. McLeod has managed teams of architects,
draftsmen, specification writers, cost estimators, engineers, and
landscape architects for the past 35 years.
Mr. McLeod conducts frequent meetings with his design team, and
records all design decisions using Excel software, a program that
allows information to be sorted and retrieved with the click of a mouse.
He uses the email system to help document all decisions and to
coordinate the design. The MAG team frequently exchanges drawings
in pdf format so that drawings can be reviewed and checked every day
by each member of the design team. Mr. McLeod takes pride in the
aesthetic and technical details of each project, and his firm enjoys a
reputation for producing attractive and economical buildings with their
precise construction documents. Owners and general contractors
have complimented the firm about its designs and construction
documentation.

Most of MAG's clients have retained the firm for subsequent projects,
and in one case, a retail client retained MAG for more than 150
separate buildings over a 24-year period. Mr. McLeod maintains
contacts with key suppliers and manufacturer's representatives to
verify the constructability and availability of materials and systems
required by each project. The park will be an asset to Sunny Isles
Beach, and it should not be hidden from the public's view. He wants
the park to be not just a pleasant place to spend some time; he also
wants it to be an educational experience that features design elements
that illustrate various aspects of nature, not just plants. Some of these
features include birds, butterflies, fragrances, and geological materials,
such as indigenous rocks. Mr. McLeod is an amateur astronomer and
feels that all aspects of nature deserve to be featured in parks, not just
plants and animals, but water, rain, sun, time, and wind. Mr. McLeod is
fully aware of the ADA requirements for parking garages and parks,
not only as a licensed architect who is required to be familiar with ADA
regulations, but also because he has friends with disabilities that
require special accommodations, and therefore knows from first hand
experience how important the ADA regulations are.
Mr. McLeod also understands that materials and fixtures have to be
selected for durability, given that most will be subject to high humidity,
intense sun, strong winds, and heavy rain. Mr. McLeod has studied
mold and mildew prevention techniques, and he has also provided
expert testimony regarding building failures attributed to hurricane
force winds and im ro er construction.

2. PROJECT UNDERSTANDING AND APPROACH
a. The firm's thorough understanding of the scope of work. The
coastal location of the site will mean that structures will encounter
hurricane force winds, heavy rain, and high humidity. The site is
located in coastal area known for its corrosive environment. The MAG
team proposes pre-cast concrete for the parking structure, a structural
system that will reduce the field construction time and provide better
quality control. Higher quality concrete and protection for the steel
reinforcing bars are important considerations in corrosive
environments. Site drainage will be challenging. Soil conditions will
probably require deep foundations and grade beams. The City's
desire to minimize the garage's identity (i.e., to paint its solid exterior
walls with decorations or otherwise treat the fagade so that it does not
look like a garage) may trigger the requirements for mechanical
ventilation and increased lighting. Significant money can be saved by
designing an "open parking structure." Shielding the visibility of the
garage from park view, if deemed necessary, can best be
accomplished with trees, shrubs, and berms. Alternatively, wall
openings that are necessary for ventilation can be designed to look like
windows. The site is definitely "urban" with high rise buildings along the
eastern and western boundaries of the project. The parking garage
will not seem out of place in this urban setting.

AND ON VERY BUSY STREETS. IT IS DEFINITELY AN "URBAN" PARK.

b. The firm's identification of any significant project issues. The
biggest challenge to this project is the parking garage and its location
on the site. Although there is enough land available, the site's
proximity to high rise condos to the west is an important consideration
because the garage could potentially block ocean views. The
suggested size and shape of the garage will not fit on the property in
an east-west configuration, and that is the reason why the MAG team
has suggesting reducing its footprint. The MAG team strongly
suggests that the garage be located on the south side of the property,
and that it runs east-west, thereby providing almost three acres of
parkland to the north. If the garage is located on the southern portion
of the site, it will minimally obstruct ocean views from the condo to the
west. The MAG team feels that it can still provide at least 450 parking
spaces in the reduced footprint, and this design is feasible. Views of
this garage and park as seen from the high rise condos and hotels to
the east and west of the property are important, as they will be looking
down on this development. The park is a gateway feature to the City
of Sunny Isles, and the existing DPW facility is problematic for several
reasons: (1) It is termite infested (2) its roof-mounted air conditioning
ducts are an eyesore and they are plainly visible to the adjacent high-
rise residents (3) a park would be a far superior asset and gateway
feature to the city than the modular structure that currently hoses the
DPW. The MAG team recommends relocating the DPW to a different
site. If this is not possible, the DPW should be located on the ground
floor of the garage, but this addition would require greater height or
fewer parking spaces in the garage.

THE TEAM RECOMMENDS RELOCATING THE EXISTING DPW FACILITY
c. The constructability of the firm's approach. The MAG team knows
how to design parking garages and parks, because it has done this
many times before. The MAG team's goal is to produce a cost-effective
parking garage and an exciting park. In order to achieve cost-effective
construction, the garage should feature pre-cast concrete beams and
panels and a rectilinear floor plan. RGD will specify native plant
materials to insure durability and low maintenance costs. The MAG
team will select building materials for shelters, rest rooms, and other
elements to be durable, wind resistant, graffiti resistant, and attractive.

Rosenberg Gardner Design's role in this project will be performed in
two aspects. Primarily, RGD will be part of the team in the creating of
the master site plan. This project must receive input from all
disciplines to ensure that all of their individual requirements are
coordinated carefully in the design in the early stages. RGD will
provide its expertise in site planning by assisting in the location and
layout of the garage, public works facilities, interior site circulation and
placement of the individual park amenities (i.e. picnic shelters,
playgrounds, art features, etc.). Not only is "fitting" all of the required
amenities into the site to be taken into consideration, but of equal
importance are the issues of creating compatible uses within the site
and with adjacent sites, the creation of view corridors and buffers and
allowing for the future safety of the park by incorporating Crime
Prevention Through Environmental Design (CPTED) principles.
As the design proceeds, Rosenberg Gardner Design, as well as the
rest of the design team, will work with the City and interested
neighborhood groups in gathering a consensus to program elements
and ensuring connectivity and compatibility to nearby neighborhoods.
It is always important to remember that a park is for the residents and
must encompass their wishes and desires, of course within the
framework of the City's abilities.

As the design process progresses Rosenberg Gardner Design will
move into the next phase of their work which is preparing detailed

drawings of all of these program elements. Special attention will be
made to ensuring that the landscape elements are planned with
maintainable and sustainable design in mind. RGD has been very
involved with "green building" and many of its basic tenets may be
applied to this site. It is anticipated that the walking path will wind
through differing natural planting communities as it flows through the
park. This, with interpretive signage, will provide an excellent
opportunity for the education on our environment. This will also allow
for significant bio-diversity in the site. In addition to this, there are
many opportunities for the use of recycled materials, photo-voltaics,
storm water harvesting and reductions in heat loads.
3. EXPERIENCE
.
a. The firm's experience with projects similar in scope and size.
MAG and its team of consultants have worked together on the design
of recreational facilities and parking garages. One such project is the
Watson Island Marina which includes a huge boat launching ramp and
docks, parking lots, rest rooms and maintenance facilities, landscaped
grounds, site lighting, and board walks. Materials had to be vandal
proof and low-maintenance, as well as cost effective. One unique
problem solved by the MAG team was related to minimum floor
elevations above sea level and the need for special water proofing and
pumps to allow compliance with ADA slopes, flood control measures,
and economical site work.

The MAG team has also successfully designed a mixed use 324-car,
three-level parking garage/retail facility for the Miami Parking Authority.
Its client proudly proclaimed that this was MPA's first project that was
completed on time and within budget.

The MAG team also designed a 1,000 car parking facility for the
Performing Arts Center Authority in Fort Lauderdale, and the garage
was completed on time (actually before) the Broward Center for the
Performing Arts opened.
b. The firm's experience with municipal projects. The MAG team has
designed several facilities for the public sector. One such client is the
Miami Parking Authority, for which MAG and its consulting engineers
have designed surface parking lots and parking garages. RGD, its
landscape architect, has designed park facilities for Sunny Isles Beach.
MAG's architects have designed schools for Miami-Dade Public
Schools and multiple retail tenant improvements located in the Fort
Lauderdale International Airport. MAG's engineering consultants have
designed numerous projects for the public sector (see attached SF
330s). Public sector projects require tight plans and specs because
the lump sum competitive bidding process awards contracts to the low
bidder (who may have omitted or altered specifications to lower their
bids).
4. AVAILABILITY OF STAFF
a. The firm's ability to keep staff readily available for the project. If
selected to design the Heritage Park project, MAG assures Sunny Isles
Beach that it will give this project its top priority and MAG and its
design team will have dedicated architects, engineers, and technical
assistants assigned to this project for its duration. Continuity of
personnel returns benefits to the client as well as to MAG and its
engineering consultants. The attached SF 330 indicates that the MAG
design team has sufficient staff to produce the Heritage Park project.
b. The firm's ability to have staff readily available for the project.
MAG's office is located approximately seven miles from the proposed
site, and the travel time from its office to the site is approximately 13
minutes. MAG's engineering consultants' offices are located less than
one-hour's drive from the project site. MAG and its consultants
maintain a staff that is sufficient for all projects that they take on. The
MAG design team will keep dedicated staff members assigned to this
project for its duration. MAG is prepared to work overtime in order to
keep the project on schedule. Should production schedules require
more staff than originally assigned to this project, MAG will supplement
its drafting staff with additional personnel. MAG manages its
production commitments, and can anticipate its need for increased
production personnel months in advance; MAG will hire additional
experienced people as required. Although MAG's current staff and
work load are sufficient to accommodate the Heritage Park project, the
Group has the ability to increase its production staff. MAG has fully
equipped CAD drafting stations that allow it to increase its production
staff by 50%. All data is automatically backed up each evening and it
is stored off-site (a feature that allowed MAG to complete its production
commitments even after Hurricane Wilma destroyed MAG's office back
in 2005. MAG maintains good business interruption insurance.

5. EXPERIENCE WITH SUNNY ISLES BEACH
a. The firm's familiarity/experience with Sunny Isles Beach's
construction codes. MAG and its consultants have obtained and
studied Sunny Isles Beach's zoning regulations.

6. PERMITTING ISSUES
a. The firm's experience with all applicable permitting issues. MAG
and its consultants learned long ago that the key to eliminating
permitting issues is to do its homework. Proper building code analysis
with its detailed checklists all but eliminate permitting issues. MAG
schedules pre-permit application meetings with building authorities in
order to discuss permitting questions, concerns, and solutions before
they become permitting issues. MAG produces its drawings initially for
the client and then for the permitting authorities and lastly, for the
construction trades. MAG produces Life Safety Plans that clearly show
compliance with code-requirements (such as travel-to-exit distances,
exit capacities, fire rated construction, etc). MAG's drawings also
show compliance with ADA requirements and the requirements of the
Florida Building Code.

b. The firm's ability to work through all necessary permitting issues.
MAG and its consultants have a successful track record of permitting
projects located in South Florida. MAG is a local firm that understands
the Florida Building Code and construction practices. As previously
mentioned, MAG's office is located about 15 minutes away from the
Sunny Isles Beach's Building Department. MAG has always been very
successful when it has had the opportunity to personally meet with the
various permitting officials. MAG does not retain permitting expeditors
and prefers to manage all permitting efforts with its own people (the
architects and engineers of record). The MAG team has successfully
obtained approvals from building, fire, and zoning boards all over
South Florida. MAG records all written plan check comments received
during the permitting process in chart form and then responds to these
comments on the same chart. This chart is attached to the
resubmitted drawings, and MAG clouds relevant portions of the
drawings so that building officials can quickly see where and how their
concerns have been addressed. Building officials and Owners have
complimented MAG for this type of documentation. As design
professionals, MAG and its consultants take responsibility for
compliance with building codes and will make any revisions required
during the permitting process at no extra charge to the Client.
7. PERFORMANCE ISSUES
a. The firm's change order history for all projects in the past two
years. MAG's most recent project is an eight-million dollar proscenium
arch theater that was competitively bid. This project is in its final
weeks of construction and change orders have amounted to less than
3.25% of the contracted price. Most of these Change Orders were
Owner-requested changes. Historically a very tiny percentage of
Change Orders on MAG projects have been due to errors or
omissions. MAG minimizes Change Orders by carefully defining the
work required, and has developed text that is used on the drawings
and in the Project Manuals that emphasizes and reinforces the AlA
Document A201 's requirements. MAG establishes Allowances (usually
for material costs) for items that may not have been selected at the
time of bidding. MAG stresses the importance of the Request For
Information (RFI) process during the bidding phase and puts bidders
on notice that the bidding period is the proper time to identify
discrepancies or vagueness (in any) within the documents. If no RFls
are generated during the bidding process, MAG approves no Change
Orders applicable to discrepancies or vagueness after the contract for
construction has been signed. MAG utilizes the submittal review
process as a valuable tool in the project's quality control programs.
MAG and its consulting engineers have multiple architects and
engineers on staff that cross-check its documents (an in-house peer-
review).
b. The comparison of the firm's estimates and low bids for the past
two years. MAG no longer provides cost estimating services and

recommends a separate consultant for estimating. The MAG design
team includes an experienced construction cost estimator, Russ Morris
of RTM Estimating (RTM). Given the vast changes in market
conditions during the past two years, cost estimating has become a full
time and specialized effort that requires bids rather than estimates. In
less volatile times, historical unit prices and labor rates, such as those
found in Means' Building Construction Cost Data, allowed architects to
calculate construction costs to a high level of accuracy (and MAG
proiects usually were within 3% of MAG's estimates). This approach
does not work in today's market, particularly in South Florida, and
especially during the past two years. RTM keeps a file of the latest
construction cost data, and where possible, obtains direct cost input
from material suppliers and subcontractors for major items contained in
the project. RTM's input during the production of drawings acts as a
quality control measure. If RTM has questions about the project's
requirements, RTM advises the design team accordingly, and
corrections, additions, or clarifications are made to the drawings and
specification well in advance of the bidding period.
c. The firm's compliance with budgets for the last two years. Most of
MAG's projects during the past two years did not have tiqht budqets.
Most were built with Cost Plus or Construction Management contracts.
Schedule compliance was more important that cost control. In all
cases, MAG recommends Owners to carry a Contingency Allowance
and to avoid under-funded projects because market conditions
determine costs, and costs are beyond the control of any architect or
engineer.
d. The firm's compliance with schedules for the last two years. Most
of MAG's projects during the past two years have had strict schedules,
and all of MAG projects with such schedules were completed on time.
This is particularly true for retail clients with expensive grand openings
campaigns, merchandise delivery, personnel training, and advertising
commitments that must be coordinated with the Certificate of
Occupancy. With MAG's theater project, the building must be
complete on time as stage productions and ticket sales demand a
timely project completion. So far, everything is on schedule for a
December opening.
