HomeMy WebLinkAboutOrdinance 2016-486 ORDINANCE NO. 2016- AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 238 OF THE CODE OF ORDINANCES OF THE CITY OF SUNNY ISLES BEACH TO ADD A NEW SECTION 238-16 REGULATING WORK WITHIN THE CITY OF SUNNY ISLES BEACH RIGHTS-OF-WAY; PROVIDING FOR STANDARDS FOR CONSTRUCTION AND REPAIRS OF STREETS WITHIN THE BOUNDARIES OF THE CITY; PROVIDING FOR SUSPENSION OF PERMIT; PROVIDING FOR EXCEPTIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR REPEALER; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach (the "City") has jurisdiction over certain streets and roads located within the boundaries of the City; and WHEREAS, the City and Florida Department of Transportation ("FDOT") have invested millions of dollars in the re-pavement of roads in the City; and WHEREAS, the City wishes to establish minimum standards and specifications to govern street repair work on streets within the City's jurisdiction; and WHEREAS, the City wishes to confirm that these minimum standards and specifications apply to the construction, improvement; maintenance, restoration or repair on City's rights-of- way and streets within the City's jurisdiction. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISISON OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Amendment. Section 238 of the City Code is amended to read as follows: § 238-16. —Maintenance and Repair Standards of Streets and Sidewalks. A. Minimum Standards for Construction and Repairs. (1) General Requirements. When a street or sidewalk is cut or excavated, it shall be done to City standard, which shall include appropriate traffic control. pavement cutting, backfill. and repair. Any repair of a street, sidewalk. or road shall be performed to restore the entire work area to the minimum standards and specifications as set forth in Attachment "A". as amended from time to time by the City Commission. Decorative sidewalk pavers approved by the City shall be used to repair any decorative sidewalk where pavers are installed. Pavement surfaces which have been constructed, reconstructed or resurfaced may not be cut or open for a period of five (5) years after the installation of a new pavement surface except if the following occurs: (a) Emergencies that endanger life or property. (b) Situations in which no alternative course of action exists. as determined by the. City Manager or designee based on written explanation submitted by the Permittee setting forth the facts giving rise to the conclusion that no alternatives exist. (3) Restoration of Newly Paved Roadways. Where street cuts are permitted on a newly paved roadway, pavement restoration shall include a minimum 1 milling and resurfacing of the full width. edge of pavement to edge of pavement of the roadway for a distance of a full block or the full length of the excavation to the nearest intersection whichever is greater. unless otherwise specified by the City Manager or designee. For concrete surfaces, the restoration limits shall be to the nearest expansion joint. Any street cut of a newly paved roadway is subject to review and approval by the City Manager or designee based on the guidelines established in this section. B. Warranty. For a period of two years following any work under this Section including repair work. cuts and borings. Permitttee shall be responsible for the condition of said pavement patches. cuts, and borings, and during that time shall, upon request from the City Manager or designee. repair to the City's satisfaction any of the street or sidewalk surfaces which become settled, cracked, broken or otherwise faulty. C. State Roads within City Limits. Where excavation or construction within the limits of the rights-of-way of a state road is anticipated or performed within the city limits, all provisions of this section shall apply and have precedence over county regulations or state regulations except where the state has preempted the authority of the City. D. Suspension of Permit. If the Permittee fails to comply with the requirements to repair the street or sidewalks in accordance with the minimum standards and this Section, the permit may be suspended and work stopped until such time as the entity preforming the work gives assurance to the City of compliance with the standards and this section. The City Manas?er or designee may. in his or her sole discretion, waive a requirement under this section. but only for good cause shown and only to the extent public safety and continuity of utility services are not jeopardized. Section 2. Severability. If any section, subsection, clause or provision of this Ordinance is declared invalid or unconstitutional by a court of competent jurisdiction, the remainder shall not be affected by such invalidity. Section 3. Repeal of Conflicting Provisions. All ordinances, or parts of ordinances in conflict herewith be, and the same, are hereby repealed Section 4. Inclusion in the Code. It is the intention of the City Commission, and it is hereby ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny Isles Beach Code; that the sections of this Ordinance may be renumbered or re-lettered to accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other appropriate word. REASONS The City has invested millions of dollars in beautifying the streets and sidewalks of the City. As such, the City must take the appropriate steps to protect its investments by regulating street and sidewalk repairs. The purpose of the attached Ordinance is to establish minimum standards and specifications to govern street repair work on newly paved streets within the City's jurisdiction following the completion of utility work. Specifically, the contractor or utility company must restore the streets or sidewalks to the satisfaction of the City based on the guidelines of this Ordinance. The Ordinance requires the Permittee to repair the streets in accordance with certain specific standards and specifications. Additionally, the Permittee will be responsible for the condition of the street or sidewalks for a period of two years after completion of the repairs to ensure the repairs last. The Ordinance also requires a suspension of the permit and work stopped until the entity performing the work complies with the minimum standards and specifications.
