HomeMy WebLinkAboutOrdinance 98-26 ORDINANCE NO. 98- 2.,J,p AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 5 OF ORDINANCE 98-18 ESTABLISHING INTERIM PARKS AND RECREATION IMPACT FEES SCHEDULE; PROVIDING FOR AN AMENDED IMPACT FEE SCHEDULE; PROVIDING FOR APPLICABn...ITY; PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; PROVIDING FOR SEVERABn...ITY AND AN EFFECTIVE DATE. WHEREAS, the City Commission adopted Ordinance 98-18 establishing an interim parks and recreation impact fee ordinance based upon Miami-Dade County's fee schedule; and WHEREAS, the City has learned that Miami-Dade County amended its fee schedule and the City wishes to conform its fee schedule to that of the County's. NOW THEREFORE BE IT ORDAINED BY THE COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Amendment of Impact Fee Schedule. Section 5 of Ordinance 97-18 is hereby amended to provide as follows; "Any person requesting a Building Permit for Residential Development Activity shall pay the impact fee derived from, and identical to, Section 33H-8 of the Code of Miami-Dade County, District 1 (of which the City of Sunny Isles Beach is part)as amended, as follows: IMPACT FEE SCHEDULEl District single Family Detaebed Multi.Family - including condominiwn &. hotel apartment Townhouse City of Sunny Isles Beach $1,453.40 $741.75 $1,247.01 In addition to the Fee as set forth above, each Feepayer shall pay to the City a non-refundable general 1 For a more detailed explanation of the computation oftbis impact fee schedule, see Section 33H of the Metropolitan Dade County Code, under which the City of Sunny Isles Beach currently operates pursuant to the Charter. AmeIldina PaJb.l: Roc. ImpIct fee adnistrative charge in the amount of seven and one-half percent (71/2%) for the processing of all materials relating to improvements at a local park. Section 2. Awlicability. Except as otherwise provided herein, all other provisions of Ordinance #97-18 shall remain in full force and effect until otherwise modified or replaced by the City Commission. Section 3. Repeal of ConflictinB Provisions. Any provision of Ordinance #97-18 of the City of Sunny Isles Beach in conflict with the provisions of this ordinance is hereby repealed. Section 4. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 11. Effective Date. This Ordinance shall take effect ten days after adoption on second reading. PASSED AND ADOPTED on first reading the -z,b~y of ~ r~ . 1998.
