AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, ADOPTING STANDARDS, REQUIREMENTS AND
RESTRICTIONS ON MATERIALS AND COLORS FOR
EXTERIOR WALLS OF BUILDINGS; PROVIDING FOR
FACING MATERIALS; PROVIDING FOR CHANGES IN
PLANS AND SPECIFICATIONS AS REQUIRED; PROVIDING
FOR SAMPLES OF COLOR AND PAINTING AND AWNING
WORKS; PROVIDING FOR FEES FOR EXAMINATION OF
PLANS AND SPECS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL OF CONFLICTING
PROVISIONS; PROVIDING FOR INCLUSION INTO THE
CODE AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the haphazard application of materials and colors on exterior walls is in conflict
with the City Commission's policy to create a beautification program for the City of Sunny Isles
Beach; and
WHEREAS, the City Commission wishes to put into place fair and specific procedures for
the selection, use and application of material and colors of exterior walls in order to promote the
health, safety, welfare of the citizens of the City of Sunny Isles Beach as well as the aesthetic
appearance of the City;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Exterior Walls - Materials and Color. All exterior walls of buildings shall be
constructed of concrete, glass blocks, poured concrete, stone, hollow tile, coral rock or clay brick
provided that for commercial zoning districts metal panels, pebble face panels, precast panels and
architectural concrete may be used for exteriors of walls designed and used for commercial purposes.
All exterior masonry services shall be stuccoed and painted excepting those of coral rock, stone,
glass, clay brick, slump brick, pebble faced brick, pebble faced panels, precast panels and
architectural concrete. Sun screens on commercial buildings may be constructed of masonry, metal,
glass or plastic where such frames are located in a metal or masonry frame, provided that such sun
screen shall be subject to approval by the City Manager or his designee. All exterior coloring shall
be approved by the City Manager, or his designee, in accordance with a palette of colors that will

be available for public consumption at the planning, development and building department.
Section 2. Changes in Plans and Specifications as may be required. It shall be the duty of the
Building Official to require changes, if any, in any plans and/or specifications presented, as may be
necessary to conform to the provisions of this and all Ordinances of the City of Sunny Isles Beach.
The City Manager, or his designee, may also suggest or recommend such changes in plans and
specifications as in his judgement may be requisite or appropriate to the maintenance of a high
standard of construction, architecture, beauty and harmony.
Section 3. Samples of Color and Painting and Awning Work. Which applicant for or holder of
a permit authorizing exterior painting, coloring, awning work or erection of a canopy shall be
required to submit to the City Manager, or his designee, for hislher approval, prior to the execution
of such work, a sample of the color to be used in such work. The colors shall be approximate to,
appropriate and harmonious with the palette of colors that will be available for public consumption
in the Building, Planning and Zoning Department.
Section 4. Fees for Examination of Plans and Specifications. For examination of such plans and
specifications by the City Manager, or his designee, there shall be charged and collected by the City
in addition to all other building permit fees with respect to the examination of material and color for
the exterior walls, a fee of $10.00.
Section 5. Severability. The provisions ofthis Ordinance are declared to be severable and if any
section, sentence, clause or phrase of this Ordinance shall, for any reason, be held invalid or
unconstitutional, such decision shall not affect the validity of the remaining sections, sentences,
clauses and phrases of this Ordinance but they shall remain in effect, it being the legislative intent
that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 6. Re.peal of Conflicting Ordinances. All Ordinance of parts of Ordinance in conflict
herewith be and the same are hereby repealed.
Section 7. Inclusion in the Code. It is the intention of the Commission, and it is hereby
ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny
Isles Beach Code; that the sections of this Ordinance may be renumbered or re-Iettered to accomplish
such intentions and that the word "Ordinance" shall be changed to "Section" or other appropriate
word.
Section 7. Effective Date. This Ordinance shall take effect ten (10) days after its adoption at
second reading.
