ORDINANCE NO. 98-50
AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, PROVIDING EACH YEAR THE CITY'S ANNUAL
BUDGET MAY BE AMENDED, SUCH THAT TRANSFERS
BETWEEN LINE ITEMS WITHIN A DEPARTMENTAL
BUDGET OR DECREASES IN LINE ITEMS NOT
AMOUNTING TO MORE THAN 20% OF THE TOTAL
BUDGET MAY BE MADE BY THE CITY MANAGER IN
ACCORDANCE WITH CERT AIN PROCEDURES;
PROVIDING FOR OTHER AMENDMENTS; PROVIDING FOR
GRANTS AND GIFTS; PROVIDING FOR A POST AUDIT;
PROVIDING FOR SEVERABILITY AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the City of Sunny Isles Beach, Florida, wishes to provide for an amendment
procedure to the budget may be utilized each year if the City adopts its annual budget; and
WHEREAS, compliance with Article 4.10 of the City Charter, Section 218.23(1 )(b) Florida
Statutes, the City wishes to acquire an annual post audit and be eligible to participate in revenue
sharing under minimum entitlement;
NOW THEREFORE BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Amendments to the Budget. Each year the City's annual budget may be amended
from time to time as follows:

Minor Amendments. Transfers between line items within a departmental budget or
decreases in line items not amounting to more than 20% of the total budget of each
department may be made by the City Manager by written statement describing the
transfers and the reasons therefor. A copy of such statement shall be filed with the
City Clerk and delivered to the Mayor and each of the City Commissioners. A copy
shall also be posted at a conspicuous place in City Hall. The transfers shall become
effective 14 days after posting unless the Mayor or any member of the City
Commission notifies the City Manager that he/she wishes the transfer to be placed
upon the Agenda ofthe next City Commission meeting for consideration by the entire
City Commission. A transfer considered by the Commission must be approved by
majority.
Other Amendments. All other budgetary transfers shall be approved by Ordinance of
the City Commission provided however, up to one (1 %) per cent of the contingency
reserve fund may be transferred to any departmental budget by approval of a duly
enacted resolution.

Grants and Gifts. Each year, if and when the City of Sunny Isles Beach receives
monies from any source, be it private or governmental by grant, gift or otherwise to
which there is attached a condition of acceptance, any limitation regarding the use or
expenditure of the funds so received need not be shown in the operating budget nor
shall such budget be subject to amendment of expenditure as a result ofthe receipt of
said monies, but said monies shall be disbursed and applied toward the purposes for
which said funds were received. To insure the integrity of the operating budget and
the integrity of the monies received by the City under grants or gifts, all monies
received as contemplated above must, upon receipt, be segregated in accounts based
on generally accounting principles and where appropriate, placed in separate and
individual trusts and/or escrow accounts from which any money drawn may only be
disbursed and applied within the limitations placed upon the gift or the grant as
aforesaid.
Post Audit provided. Each year, pursuant to Article 4.10 of the City Charter and
Section 218.23(1 )(b) Florida Statute, the City Commission hereby provides for annual
post audit of the City's financial account and may thereby be eligible to participate in
revenue sharing beyond the minimum entitlement in any fiscal year. The City
manager is authorized to take all action necessary to cause such post audit to be made
by a certified public accountant or firm of such accounts in accordance with the law.
Severability. The provisions ofthis Ordinance are declared to be severable and if any
section, sentence, clause or phrase of this Ordinance shall, for any reason, be held
invalid or unconstitutional, such decision shall not affect the validity of the remaining
sections, sentences, clauses and phrases of this Ordinance but they shall remain in
effect, it being the legislative intent that this Ordinance shall stand notwithstanding
the invalidity of any part.
Effective Date. This Ordinance shall be effective immediately after its adoption at
second reading.
