HomeMy WebLinkAboutOrdinance 98-54 ORDINANCE NO. 98- 5lf AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 33-304(b) OF THE MIAMI- DADE COUNTY CODE AS ADOPTED BY THE CITY OF SUNNY ISLES BEACH, TO DELETE THE REQUIREMENT THAT ALL ZONING APPLICATIONS MAY ONLY BE FILED AND ACCEPTED THE FIRST SEVEN (7) DAYS OF EACH MONTH AND AMEND SECTION TO PERMIT ZONING APPLICATIONS TO BE FILED ANY DAY OF THE MONTH EXCLUDING LEGAL HOLIDAYS, SATURDAYS AND SUNDAYS PROVIDED THAT APPLICATIONS MUST BE SUBMITTED PRIOR TO EIGHT (8) WEEKS PRIOR TO THE SCHEDULED HEARING; PROVIDING FOR A REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City, by its Charter, Section 8.3 adopted the Code of Miami-Dade County as its own; and WHEREAS, the City wishes to streamline the process of accepting and reviewing zoning applications as well as provide the department with more efficient method of scheduling its applications; NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Section 33-304(b) is amended as follows: (b) All zoning applic.ations delineated in this chaptel, with the exception of administIati ve '\'alianc.es, may only be filed and acc.epted fol filing ({wing the fiIst seven (7) days of each month. The fiIst seven (7) days of eac.h month shall indude all legal holidays, Satmdays and Smldays. Administrative 'VaIiances may be filed at any time. (b) All zoning applications delineated in this chapter, including administrative variances, may be filed and accepted for filing any day of the month excluding legal holidays, Saturdays and Sundays provided that no hearing will be scheduled prior to eight (8) weeks from filing. -1- Section 2. Re.peal. All Ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall, for any reason, be held invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 4. Effective Date. This Ordinance shall take effect ten (10) days after adoption upon second reading.
