HomeMy WebLinkAboutOrdinance 99-61 ORDINANCE NO. 99- \v \ AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 33-84 "DEFINITIONS" TO INCLUDE THE DEFINITION OF "WINDOW SIGNS"; AND AMENDING SECTIONS 33-103, 33-105 AND 33-106 TO INCLUDE THE TYPE OF WINDOW SIGN, THE SIZE OF A WINDOW SIGN, THE NUMBER OF SIGNS PERMISSIBLE, TO PROVIDE THAT ILLUMINATION IS PROHIBITED EXCEPT FOR NEON SIGNS NOT EXCEEDING 50% OF ALLOWABLE AREA; ENUMERATING SPECIAL CONDITIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach by Section 8.3 of its City Charter has adopted the Code of Miami-Dade County as its own Code of Regulations; and WHEREAS, the City of Sunny Isles Beach, for the health, safety and welfare of its citizens, desires to regulate window signs in its permissible zones and must therefore amend several sections of Chapter 33 Zoning in order to accommodate regulations of window signs; NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: 1. Definitions. Section 33-84, Definitions is hereby amended to add: "33-84 (y) Window Signs: Any sign, picture, symbol or a combination thereof, designed to communicate information about an activity, business, commodity, event, sale, or service, that is placed either upon the window panes or glass or inside a window, and is visible from the exterior of the window or glass." 2. Amendment of Sections 33-103, 33-105 and 33-106. Sections 33-103, 33-105 and 33-106 are hereby amended to include as follows in each section: Setbacks: Illumination: Window Sign Ten percent (10%) of window pane or glass area Only one (1) sign per 100 square feet of window pane or glass area, type selected by applicant Not applicable No window sign shall be illuminated except that neon signs not "Type of Sign: Size of Sign: Number of Signs: Signs Amendment Ord. -1- Maximum Height: Special Conditions: exceeding 50 percent (50%) of allowable area will be permitted Not Applicable Signs permitted only in the middle or top portion ofthe window pane or glass. No sign shall be placed within a window in such a manner as to obscure the ability of a Police Officer or Code Enforcement Officer to clearly view the interior of the establishment." 3.
