HomeMy WebLinkAboutOrdinance 99-69 ORDINANCE NO. 99- c,,'l AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING ORDINANCES 98-18 AND 98-26, ESTABLISHING INTERIM PARKS AND RECREATION IMPACT FEE SCHEDULES; TO REPEAL THE 7 1/2% GENERAL ADMINISTRATIVE CHARGE FOR THE PROCESSING OF MA TERIALS RELA TING TO IMPROVEMENTS AT A LOCAL PARK; PROVIDING FOR APPUCABILITY; PROVIDING FOR A REPEAL OF CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, on January 22, 1998, by Ordinance No. 98-18, the City established an interim parks and recreational impact fee schedule as later amended by Ordinance No. 98-26, which adopted the Miami-Dade County's amended fee schedule; and WHEREAS, the City has learned that Miami-Dade County in their fee schedule included the non-refundable, general administrative charge in the amount of7 1/2% for processing of all materials relating to improvements at a local park and therefore the Sunny Isles Beach Ordinance inadvertently imposes a duplicative fee; NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Amendment of Ordinances 98-18 and 98-26. Ordinances 98-18 and 98-26 are hereby amended to delete the imposition of a non-refundable general administrative charge in the amount of 7 1/2% for processing of all materials relating to improvements at a local park. Section 2. Applicability. Except as otherwise provided herein, all other provisions of Ordinance 98-18 and 98-26 shall remain in full force and effect unless otherwise modified or replaced by the City Commission. Section 3. Rq>eal of Conflicting Provisions. Any provision of Ordinance No. 98-18 and 98-26 of the City of Sunny Isles Beach in conflict with the provisions of this Ordinance is hereby repealed. Section 4. Severability. Ifany section, subsection, clause or provision of this Ordinance is declared invalid or unconstitutional by a court of competent jurisdiction, the remainder shall not be affected by such invalidity.
