ORDINANCE NO. 2000-~.
AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH, FLORIDA,
AMENDING SECTION 33-149 OF THE ZONING CODE OF MIAMI
DADE COUNTY AS ADOPTED BY SECTION 8.3 OF THE CHARTER OF
THE CITY ENTITLED DUTY OF OWNERS OF BUILDINGS;
PROVIDING FOR THE ADDITION OF THE REQUIREMENT THAT
BUILDINGS WHICH HAVE ENTRANCES THAT ABUT A WATERWAY
OR BEACH PROVIDE ADDRESS NUMBERS VISIBLE FROM SAME;
PROVIDING FOR A COMPLIANCE PERIOD PRIOR TO
ENFORCEMENT; PROVIDING FOR SEVERABILITY; PROVIDING
FOR REPEAL OF CONFLICTING PROVISIONS; PROVIDING FOR
INCLUSION IN THE CITY OF SUNNY ISLES BEACH CODE OF
ORDINANCES AND PROVIDING FOR AN EFFECTIVE DATE OF
ENFORCEMENT.
WHEREAS, the City of Sunny Isles Beach Police Department and the Code and
Licensing Enforcement Division have encountered difficulty in identifying waterfront properties
from the rear for code enforcement issues but more importantly in cases of police emergencies;
WHEREAS, the addition of this requirement will enhance the City's ability to maintain
the health, safety, and welfare of our citizenry:
NOW THEREFORE BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section1.
(a)
Section 33-149 entitled "Duty of owners of buildings" is herby amended as
follows:
It shall be the duty of the owner of any building facing, abutting, opening or
having its main entrance from any right-of-way in the County City as well as any
building facing, abutting, opening or having any rear entrance from any waterway
or beach to have affixed to such building suitable numbers composed of figures
not less than three (3) inches in height, and/or panel upon glass or some metallic
substance, in accordance with the plats referred to in section 33-148(a) hereof.
(b)
All buildings constructed, erected or removed after January 31, 1941 shall upon
completion of their construction, erection or removal be numbered by the owner
thereof as per section 33-148 hereof.
(c)
It shall be the duty of the owner to maintain numbers of his buildings as herein
33-149 Ordinance amendment.

provided in good condition and in conspicuous place where same can be seen and
read from the street as well as the abutting waterway and/or beach.
The word "owner" as used in this article shall include owners of the fee, lessee
and "agent in charge".
All such building owners shall have sixty (60) calendar days from adoption ofthis
ordinance to come into compliance herewith. Thereafter. such building owners
shall be subiect to enforcement action as necessary to bring said buildings into
compliance herewith.
Severability.
Provisions of this Ordinance are declared to be severable and if any section, sentence, clause or
phrase of this Ordinance shall be held to be invalid or unconstitutional, shall decision shall not
affect the validity of the remaining section, sentences, clauses and phrases of this Ordinance, but
they shall remain in effect it being the legislative intent that this Ordinance shall stand
notwithstanding the invalidity of any part.
Section 4.
Inclusion in Code.
It is the intention of this Commission and is hereby ordained that the provISIons of this
Ordinance shall become and made part of the City of Sunny Isles Beach Code; that the Sections
of this Ordinance may be renumbered or re-lettered to accomplish such intentions, and that the
word "Ordinance" shall be changed to Section or other appropriate word.
Section 5.
Repealer.
All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed.
Section 6.
Effective Date.
This Ordinance shall take effect ten (10) days after adoption on second reading.
