ORDINANCE NO. 2000- <13
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AMENDING ORDINANCE NO. 99-74
BY ADOPTING A REVISED FEE SCHEDULE, INCLUDING COSTS,
FOR ZONING HEARINGS AND CERTIFICATES OF USE, WHICH
REVISED FEE SCHEDULE IS ATTACHED HERETO AS EXHIBIT "A"';
PROVIDING FOR A REPEALER; PROVIDING FOR SEVERABILITY;
PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on June 17, 1999, the City of Sunny Isles Beach adopted a fee schedule
which had been revised by Miami-Dade County and, at the recommendation of staff, was
subsequently adopted for the City by the Ordinance; and
WHEREAS, City staff now recommends a newly revised fee schedule for zoning
hearings and wishes to establish a fee schedule for certificates of use as well as administrative
charges for advertising and notices;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Adoption of Fee Schedule for Zoning Hearings. Certificate of Use. etc. Ordinance
No. 99-74 is hereby amended to include the revised zoning hearings and certificate of use fee
schedule attached hereto as Exhibit "A," which shall become effective for the City of Sunny Isles
Beach upon adoption after second reading.
Section 2. Costs Included. Included in the fee schedule is a percentage, which reflects the
costs of advertising and notices for zoning hearings and establishes a fixed fee for same.
Section 3. Repealer All ordinances or parts of ordinances in conflict herewith be and the
same are hereby repealed.
Section 4. Severability. The provisions of this Ordinance are declared to be severable and if
any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be
invalid or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 5. Inclusion in the Code. It is the intention of the City Commission and it is hereby
ordained that the provisions of this Ordinance shall be included and incorporated into the Code
of Ordinances of the City of Sunny Isles Beach as an addition thereto and the sections of this
Ordinance may be renumbered to conformed to any uniformed numbering system.

Section 6. Effective Date. This Ordinance shall become effective ten (10) days after
adoption upon second reading.

~ Except as otherwise provided in B. through F. below, for every application for a zoning change, variance, or other
zoning application, where a public hearing is required to be held, there shall be paid to the Dcoartment ofPla..ulitlg

or matters involving platting inquiries, etc. A minimwn fee of S75.00 shall be charged.

A. RE- WORK FEES
A fee of $75.00 may be charged for failure to make required correction previously indicated,
B. REVISED LANDSCAPING PLANS FEE
Major landscaping plan revision after permit is issued shall be subject to a fee of $150.00.

A. CONCURRENCY REVIEW
A fee of six (6) percent (for concurrency review) of the total permit fee, CO or zoning application fee, will be added to original
fees where a concurrency review was performed.

A zoning review fee related to the pennitting process such as the zoning plans processing review and the zoning
inspection process is being split from the building fee, therefore creating a zoning review fee.

1. Major plan revision after pennit is issued shall be subject to a fee of 50% of the original pennit fee up to a
maximum of $1,000.00.
2. Minor plan revisions shall be subject to a fee at the rate of $1.00 per minute of time for each review that takes
longer than 5 minutes.
2. "UP-FRONT"PROCESSING FEE
When the building pennit application is received for the construction of a new Single Family Residence or
Duplex, the applicant shall pay an "up-front" processing fee equal to $0.03 for each square foot or

does not apply. When a building pennit application is received for a conunercial project, the applicant

each $100.00 of estimated value or fractional part thereof This processing fee is not refundable, but shall
be-credited toward the fmal building pennit fee.
