ORDINANCE NO. 2000 - 'I ~
AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, AMENDING CHAPTER FIFTEEN OF THE CODE OF
MIAMI-DADE COUNTY AS ADOPTED BY SECTION 8.3 OF mE
CHARTER OF THE CITY OF SUNNY ISLES BEACH, TO INCLUDE
A SECTION ENTITLED "SINGLE FAMILY AND TWO FAMILY
RESIDENTIAL GARBAGE CAN LOCATION"; PROVIDING FOR
SPECIFIC STORAGE LOCATION RELATIVE PRIMARY
BUILDING; PROVIDING FOR PENALTIES FOR VIOLATION;
PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR CODIFICATION; PROVIDING FOR DEFERRED
ENFORCEMENT; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Sunny Isles Beach has adopted the Code of Miami-Dade
County including Chapter 15 entitled "Solid Waste Management" as its own, which chapter
does not include a section on Single-family and Two-family residential garbage can storage,
and;
WHEREAS, the City of Sunny Isles Beach deems it to be in the best interest of its
citizens and residents to enhance the aesthetic appearance of the City by providing that
garbage cans be located appropriately;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Single-family and two-family residential garbage can location.
(A) It shall be unlawful for any person to place or store, or allow to be placed or
stored, a garbage can upon or in any public street, alley or right-of-way;
except that such container or receptacle may be placed in the public right-of-
way during the collection process as specified in section 15-5.
(B) At all other times, except as provided in section "A" above, garbage cans shall
be maintained on the owner's property behind the front building line furthest
from the street, in such a manner as to not be plainly visible from the street.
(C) Garbage can lids shall be kept closed at all times when the garbage can is not
being used or serviced.
(D) Garbage and trash shall be placed inside the garbage can. Loose garbage and
trash in plain view is a violation of Code, a health hazard, and aesthetically
undesirable. The property owner shall be responsible for keeping the

immediate area surrounding the garbage can litter, garbage, and trash free at
all times.
It shall be a violation of the Code of Ordinances to allow the garbage can to
be filled to over capacity so that the lid is prevented from closing.

Garbage cans shall be maintained in good repair.
The location of a garbage can on said property, and behind said building line
shall not be so located as to cause a nuisance to the surrounding properties.
Section 2.
Penalties for Violation.
Any person who violates any section of this code shall be subject to the issuance of a civil
penalty as follows:
1 st Offence
$ 25.00
2nd Offence
$ 50.00
3rd Offence
$100.00
These civil penalties shall be issued after the appropriate warning period and in accordance
with Ordinance No.'s 98-21,98-57, & 99-71.
Section 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed
to the extent of such conflict
Section 4. If any clause, section or other part of this ordinance shall be held by any court
of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid
part shall be considered as eliminated and shall in no way affect the validity of the remaining
portions of this ordinance.
Section 5. This ordinance shall become effective as provided by law. Enforcement will
commence sixty (60) calendar days after adoption of this ordinance so that the City may have
an opportunity to disseminate information to the general public regarding the requirements of
this ordinance.
