ORDINANCE NO. 2001-12Q
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, REPEALING ALL
REFERENCES TO THE "PLANNING DIRECTOR",
"COMMUNITY PLANNING & DEVELOPMENT DIRECTOR"OR
"DIRECTOR OF BUILDING, PLANNING AND ZONING (OR
SOME FACSIMILE THEREOF) CONTAINED IN THE
ORDINANCES LISTED IN THE ATTACHED EXHIBIT "A," AND
SUBSTITUTING THEREFOR THE TERM "CITY MANAGER
AND HISIHER DESIGNEE," AS APPROPRIATE; PROVIDING
FOR SEVERABILITY; PROVIDING FOR REPEALER;
PROVIDING INCLUSION INTO THE CODE; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, on May 23rd, 2001, the City Manager, as a result of budget deficits,
eliminated the position of Community Planning and Development Director, among others; and
WHEREAS, the City of Sunny Isles Beach has a number of Ordinances containing a
reference to that position or some earlier references to a position when the building, planning and
zoning departments were consolidated under one director;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Repeal and Substitution. All references to the Planning Director, Community
Planning and Development Director or any earlier references to a Director of Building, Planning
and Zoning (or some facsimile thereof) contained in the Ordinances listed in the attached Exhibit
"A," be, and the same, are hereby repealed and the term "the City Manager and hislher designee,
as appropriate" is substituted therefor.
Section 2. Repealer. Any and all ordinances, resolutions and parts of ordinances or
resolutions in conflict with this Ordinance are hereby repealed insofar as they are inconsistent or
in conflict herewith.
Section 3 Severability. The provisions of this Ordinance are declared to be severable and if
any section, sentence, clause or phrase of the Ordinance shall, for any reason, be held invalid or
unconstitutional, such decision shall not affect the validity of the remaining sections, sentences,
clauses and phrases of this Ordinance but shall remain in effect, it being the legislative intent that
this Ordinance shall stand notwithstanding the invalidity of any part.
Section 4. Inclusion in the Code. It is the intention of the City Commission, and it is hereby
ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny
Isles Beach Code; that the sections of this Ordinance may be renumbered or re-Iettered to
accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other
appropriate word.

Section 5. Effective Date. This Ordinance shall take effect ten (10) days after adoption on
second reading.
