HomeMy WebLinkAboutOrdinance 2001-143 ORDINANCE NO. 2001-B.3 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, ESTABLISHING APPLICABILITY AND SPEED LIMITS ON LOCAL STREETS AND ALLEYS WITHIN THE CORPORATE LIMITS OF THE CITY OF SUNNY ISLES BEACH, ADOPTING DEFINITIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 316, Florida Statutes, State Uniform Traffic Control, recognizes there are conditions which may require municipalities to pass traffic ordinances for the regulation of municipal traffic; and WHEREAS, Section 30-299 of the Code of Miami-Dade County recognizes that municipalities may establish a maximum speed of 30 miles per hour in the corporate limits of a municipality, altering such speeds both as the maximum and minimum, after investigation to determine such a change is reasonable and in conformity to the criteria promulgated by the Department of Transportation; and WHEREAS, the City of Sunny Isles Beach has conducted such an investigation and come to certain conclusions which are reflected in this ordinance; ~". NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Definitions. The following words and phrases when used in this Ordinance, except where the context clearly indicates a different meaning, shall supplement the definitions contained in Florida Statutes 9316.003: a. Alley means every street or way within a block set apart for public use, vehicular traffic and local convenience, except foot paths. b. City Manager shall mean the Manager of the City of Sunny Isles Beach or hislher authorized designee. Section 2. Applicabilitv. This Ordinance shall apply to every residential street, alley, sidewalk, driveway, parking area, park area and every other way within this municipality, including without in any way restricting the generality of the foregoing, to any area which is privately owned and to which the public is invited or the use of which is or may be afforded to the public by acquiescence and without invitation. Section 3. Speed Limits. a. No person shall drive vehicle on a highway at a greater speed than IS reasonable and prudent under the conditions then existing. Except for roads owned by the Florida Department of Transportation, there is hereby established municipal speed limits for local roads within the corporate limits of the City of Sunny Isles Beach as follows: (1) A speed limit of 15 miles per hour in any alley within the limits of the City; (2) A speed limit of 20 miles per hour on all residential streets and avenues not otherwise specifically prescribed herein; (3) On all other City (as opposed to state) streets within the limits of the City of Sunny Isles Beach, the speed limit shall be designated by the City Manager by sign. Section 4. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 5. Repealer. All ordinances or parts of ordinances in conflict herewith be, and the same, are hereby repealed. Section 6. Inclusion in the Code. It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance be included and incorporated into the Code of Ordinances of the City of Sunny Isles Beach as an addition thereto and the sections of this Ordinance may be renumbered to conform to any uniformed numbering system. Section 7. Effective Date. This Ordinance shall become effective 10 days after adoption on second reading. PASSED AND ADOPTED on first reading the 11- ik day of O~~ 2001.
