HomeMy WebLinkAboutOrdinance 2003-166 - ORDINANCE NO.: 2003-1 bb --" !N ORDINA~CE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, ADOPTING A REVISED FEE SCHEDULE FOR THE BUILDING DEPARTMENT, ATTACHED AS EXHIBIT "A"; PROVIDING THE CITY MANAGER WITH THE AUTHORITY TO REVIEW ANNUALLY ALL BUILDING DEPARTMENT FEES; PROVIDING FOR AN EFFECTIVE DATE; WHEREAS, by Ordinance No. 2000-110, adopted on November 15, 2000, the City Commission adopted a fee schedule for the Building Department; and WHEREAS, pursuant to Ordinance No. 2000-110, the City Manager has the authority to review all Building Department fees to determine if an adjustment to the fee schedule should be recommended to the City Commission; and WHEREAS, based on in-depth review of the fee schedule, the City Manager IS recommending an adjustment to the fee schedule as reflected in Exhibit "A". NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, AS FOLLOWS: Section 1. Adoption of Revised Fee Schedule. The revised building fee schedule, attached hereto as Exhibit "A" is hereby adopted for the City of Sunny Isles Beach. Section 2. Authority of City Manager. The City Manager and/or his designee are hereby directed to annually review the Building Department Fee Schedule to determine if an adjustment to the fee schedule should be recommended to the City Commission. GENERAL INFORMATION ON SPECIAL FEES, REFUNDS, EXTENSIONS AND CANCELLATIONS 1. DOUBLE FEES When work for which a permit is required is commenced prior to obtaining a permit, the permit applicant will be required to pay 0 ne hundred dollars ($100.00) P Ius a double permit fee. T he payment of the required fee shall not relieve them from being subject to any of the penalties therein. The double fee requirements shall be applicable to all divisions of the Building Department as noted herein. For second offense of doing work without a permit, the permit applicant shall be required to pay twice the double permit fees pIus two hundred dollars [$200.00]. For each offense thereafter, the permit applicant shall be required to pay twice the double permit fee plus five hundred dollars [$500.00]. 2. RE-INSPECTION FEES A permit holder shall be entitled to an initial inspection for each mandatory inspection. All work shall be inspected and deficiencies shall be noted by the building inspector. When the work to be inspected is only partially complete, the inspection shall be performed on those,.~g~.~.,g!1~..~!.!~~ work completed, provided that compliance with the South Florida Bailding Code I_~_ may be determined with respect to those portions. A permit holder shall pay a fee of $50.00 for eac~,..~~~!~~g!!1!~!'!'I!~~g~~!!~g~! required to assure compliance with the South Florida Building Code .:I:'~.w:;;;;._I,\.1I beyond the initial and one follow-up inspection. All additional inspection fees shall be paid prior to a final inspection being conducted and may be paid by mailing the required fee to the City of Sunny Isles Beach Building Department. 3. LOST, REVISED AND REWORKED PLANS FEE (a) LOST PLANS: When plans for new buildings and additions are lost by the owner or contractor, a recertification fee will be required to review, stamp and approve a new set of plans as a field copy. Such fee shall be based on 30 percent of the original building permit fee, with a minimum fee for Group I [single family residence] of $50.00 dollars and a minimum fee for all others of $90.00. (b) REVISEDPLANS PROCESSING FEE: (1) Major plan revision after permit is issued shall be subject to a fee of 50% of the original permit fee. (2) Minor plan revisions shall be subject to a fee at the rate of$1.00 per minute of time for each review that takes longer than 5 minutes. (3) Minor plan revision fee minimum fee $50.00. A fee of $75.00 may be charged for failure to make required corrections previously indicated. (d) LOST PERMIT CARD FEE: A replacement fee of $30.00 shall be charged for the loss of a Permit Inspection Record Card after a permit has been issued. ( e) Records of inspection results in excess of 5 pages - per page $1.00 A035 A036 4. REFUNDS, TIME LIMITATION, CANCELLATIONS The fees charged pursuant to this schedule, provided the same are for a permit required by Section 104.1.1 of the South Florida Building Code may be refunded by the Building Official subject to the following: (a) No refunds shall be made on requests involving: (1) permit fees of$100.00 or less; or (2) permits revoked by the Building Official or the Buildin Official under authority granted by the South Florida Building Gede or permits cancelled by court order, or conditional permits; or (3) permits which have expired; or (4) permits under which work has commenced as evidenced by any recorded inspection having been made by the Building Department; or (5) the original permit holder when there is a change of contractor. (b) A full refund less $100.00 or 50% of the permit fee, whichever is greater, rounded to the nearest dollar, shall be granted to a permit holder who: Requests a refund, provided: (1) That the Building Department receives a written request from the permit holder prior to the permit expiration date; and (2) That the permit holder submits with such request the applicant's validated copy of such permit; and (3) That no work has commenced under such permit as evidenced by any recorded inspection and/or field inspection. PAGE 2 OF 30 BUILDING DEPARTMENT FEE SCHEDULE AOIO (c) Where there is a change of contractor or qualifier involving a permit, the second permit holder shall pay a fee of $85.00 to cover the cost of transferring the data from the original permit to the second permit. A012 A014 (d) A fee 0 f$100.00 shall be p aid by the permit holder who submits a written request for a extension as authorized under Section 104.5 of the SmIth Florida Building Code A014 (e) Where a permit has become null and void to paragraph 301.3(a) South Florida Building Code a credit of fifty percent (50%) of the permit fee shall be applied to any re-application fee for a permit covering the same project and involving the same plans, provided that the complete re-application is made within six (6) months of the expiration date of the original permit, and provided that no refund had been made as provided in this Section. A008 (f) Permit applications filed under Ordinance 97-107. A009 Where a permit has become null and void in accordance with paragraph 301.5 of the 8effih a credit of 50% of the permit fee shall be applied to any re-application fee for a permit covering the same project provided that no refund has been granted. Where no permit Vias obtained, in aeeordance wita paragraph 301.5 of the South Florida Building Code Florida Building Code, the minimum permit fee for the trade shall apply to any new permit application. Impact fees are assessed on certain building permits, including re-application on expired permits, (contact the Impact Fee Section for details). Other agencies including, but not limited to, the Department of Environmental Resources Management, Miami-Dade Fire Rescue Department, Building Code Compliance Office and the Florida Department of Health assess fees on building permits, including re-application on expired permits (contact the applicable agencies for details). SPECIAL PROJECTS: A fee equal to actual staff time and related costs shall be assessed for special projects requiring research by the Building Department in order to answer questions proposed by developers, attorneys, realtors, or municipalities, etc., in connection with the use, re-subdivision, and development of properties, or to determine if any existing violations are on the property through a review of departmental records. Such special fee only will be levied for requests outside the scope of normal departmental work. A minimum fee of $60.00 shall be charged. A fee equal to $2.00 per page shall be assessed fro pre-programmed computer reports on Building Department records. The minimum fee shall be $50.00. X022 6. GENERAL INFORMATION (a) A $0.01 per square foot fee will be added to building permits for the State of Florida to study building code requirements for radon gas, and certification and regulation of building code administrators, plans examiners and inspectors. (b) A fee of six (6) percent (for concurrency review) of the total permit fee will be added to original fees where a concurrency review was performed. (c) Impact fees are assessed on certain building permits, including re-application on expired permits (contact the Impact Fee Section for details on these fees). A037 7. INSPECTIONS REQUIRING OVERTIME Charges for construction inspections, which are requested in advance and which require that employee work overtime will be at a rate of $75.00 per hour and in accordance with applicable employee contracted bargaining agreements. 8. FEES BASED ON ESTIMATED COST - DOCUMENTATION REQUIREMENTS The Building Department may require the permit applicant to submit appropriate documentation as proof of estimated cost of construction used to compute permit fees. 9. TRAINING AND EDUCATIONAL FEES All permits for new construction, alterations or additions shall be accompanied by payment of training and educational fee of one (1 %) percent of permit fee cost. All fees collected pursuant hereto shall be set aside to offset the cost of training and education of personnel in the regulation, inspection and enforcement of the South Florida Building Code Florida Building Code. 10. CERTIFICATES OF COMPLETION AND TEMPORARY CERTIFICATES OF COMPLETION FEES Fee for Certificates of Completion and Temporary Certificates of Completion issued by the Building Department will be assessed in accordance with the Department ofPlanning and Zoning Fee Schedule. TECHNOLOGY FEES All permits for new construction, alterations or additions shall be accompanied by payment of a technology fee of 2.6% percent. All fees collected pursuant hereto shall be set aside to offset the cost of computer system purchases or technology expenditures within the building department. 12. PRE-SUBMITAL REVIEW FEES 13. BUILDING PERMIT FEES Fees listed in Subsection (B) include only building permit fees and do not include fees for plumbing, electrical, and mechanical fees which are listed in the following sections: 1. "UP-FRONT" PROCESSING FEE When the building permit application is received for the construction of a new Single Family Residence or Duplex, the applicant shall pay an "up-front" processing fee equal to $0.15 for each square foot or fractional part thereof, or $0.02 per dollar in estimated value or fractional part when square footage does not apply. When a building permit application is received for a commercial project, the applicant shall pay an "up-front" processing fee equal to $4.60 per 100 square feet or fractional part or $0.75 for each $100.00 of estimated value or fractional part thereof. MINIMUM FEE FOR BUILDING PERMIT The minimum fee for all building permits is applicable to all items in this section except as otherwise specified. (With the exception of fees associated with windows, trusses, doors, skylights and all required shop drawings, which are already included in the basic building permit fee, this minimum fee does not apply to add-on building permits issued as supplementary to current outstanding permits for the same job.) 3. NEW BUILDINGS OR ADDITIONS New construction Single Family and Duplex above 1000 sq. ft. - Group I per sq. ft. Prefabricated utility sheds with slab (Max 100 sq. ft. of floor area). Single Family and Duplex (Group I) - Attached Structures o to 100 sq. ft. in floor area. 101 to 300 sq. ft. in floor area. 301 to 500 sq. ft. in floor area. 501 to 1000 sq. ft. in floor area. PREMISE PERMIT FEES In accordance with provisions of the South Florida Building Code and Chapter 10 of the Code of Miami-Dade County, each firm or organization in Miami-Dade County which performs its own maintenance work with certified maintenance personnel, as well as helpers thereunder, may pay to Miami-Dade County an annual Master and Subsidiary Premise Permit fee in lieu of other fees for maintenance work. Such fee shall be paid to the Building Department and such permit shall be renewed annually at a fee, which is calculated in accordance with the provisions of this sub-section. 1. CALCULATION OF THE INITIAL MASTER PREMISE PERMIT FEE KOOl Each firm or organization which obtains an annual master premise permit shall include in their application for such permit the total number of maintenance personnel, including helpers and trainees thereunder, assigned to building, electrical, plumbing or mechanical work. The Master Premise Permit fee shall be computed by multiplying the total number of such employee's times [$53.50 during fiscal year 1999-2000 and $57.25 during fiscal year 2000- 2001]. The minimum Master Premise Permit fee shall be [$1011.15 during fiscal year 1999- 2000 and $1081.94 during fiscal year 2000-2001]. 2. CALCULATION OF THE INITIAL SUBSIDIARY PREMISE PERMIT FEE K002 Each firm or organization, which utilizes decentralized locations in addition to the main location described under Point 1 above, may additionally apply for a Subsidiary Premise Permit for each such decentralized location. Such application for a Subsidiary Premise Permit shall include the same information required in Point I above. The Subsidiary Premise Permit fee shall be computed by multiplying the total number 0 f such employee's times [$53.50 during fiscal year 1999-2000 and $57.25 during fiscal year 2000-2001]. The minimum Subsidiary Premise Permit fee shall be [$283.55 during fiscal year 1999-2000 and $303.40 during fiscal year 2000-2001]. 3. RENEWAL OF PREMISE PERMIT K003 Prior to each premise permit expiration, the holder will be sent a renewal notice to continue the Premise Permit for the next renewal period. The calculation of the renewal Premise Permit fee shall bet he same as the method used to calculate the 0 riginal Premise Permit fee. No allowances shall be made for late renewal fees or part year renewal fees. PAGE 28 OF 30 BUILDING DEPARTMENT A038 J. 40-YEAR RE-CERTIFICATION FEES For every application for 40-year re-certification under Section 104.9 of the Se-Hth Florida Building Code Florida Building Code there shall be paid to the Building Department, for the processing of each application, a fee of $267.50 during fiscal year 1999-2000 and $286.23 during fiscal year 2000-2001. For every application for subsequent re-certification at 10-year intervals thereafter, there shall be paid to the Building Department for the processing of each application, a fee of $267.50 during fiscal year 1999-2000 and $286.23 during fiscal year 2000-2001. Recording Fees: as established by the Clerk of the Court (Recorder). K. STRUCTURAL GLAZING SYSTEMS RE-CERTIFICATION FEES X034 For the initial application for structural glazing re-certification and each subsequent application under Sections 104.9 and 3515 of the South Florida Building Code Florida Building Code, there shall be paid tot he Building Department for the processing of each application, a fee of $267.50 during fiscal year 1999-2000 and $ 286.23 during fiscal year 2000-2001.
