AN ORDINANCE OF THE CITY COMMISSION OF THE.
CITY OF SUNNY ISLES BEACH, FLORIDA, ADOPTING
STANDARDS, REQUIREMENTS AND RESTRICTIONS ON
MATERIALS AND COLORS FOR EXTERIOR WALLS OF
BUILDINGS; PROVIDING FOR FACING MATERIALS;
PROVIDING FOR SAMPLES OF COLORS AND PAINTINGS
AND AWNING WORKS; PROVIDING FOR A MATERIALS
CHART IN CONNECTION WITH ANY SITE PLAN
APPROVAL; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REP'EAL OF CONFLICTING ORDINANCE
AND SPECIFICALLY ORDINANCE NO. 98-47; PROVIDING
FOR INCLUSION INTO THE CODE AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the haphazard application of materials and colors on exterior walls is in conflict
with the City Commission's policy to create a beautification; and
WHEREAS, the City Commission wishes to create requirements for the selection use and
application of materials and colors of exterior walls as well as a material chart in connection with the
Site Plan approval, in order to promote the health, safety and welfare of the City of Sunny Isles
Beach, as well as the aesthetic appearance of the City;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Exterior Walls - Materials and Color. All exterior walls of buildings shall be
constructed of concrete, glass blocks, poured concrete, stone, hollow tile, coral rock or clay brick
provided that for commercial zoning disi.;:icts metal panels, pebble face panels, precast panels and
architectural concrete may be used for exteriors of walls designed and used for commercial purposes.
All exterior masonry services shall be stuccoed and painted excepting those of coral rock, stone,
glass, clay brick, slump brick, pebble faced brick, pebble faced panels, precast panels and
architectural concrete. Sun screens on commercial buildings may be constructed of masonry, metal,
glass or plastic where such frames are located in a metal or masonry frame, provided that such sun
screen shall be subject to approval by the City Commission for every site plan applicant. Exterior
coloring shall be approved by the City Commission, in accordance with a palette of colors that will

be available for public consumption at the Zoning Department and which colors shall be
approximate to appropriate and harmonious with the palate of colors included in the Sherman
Williams Exterior Color Numbers SW 2419 through SW 2421 up to the 4th panel of each color
palette strip (No.s 2419-2421 ). Semi gloss paint may be used on exterior walls and gloss paint shall
only be used on doors and trims. Single family homes shall be exempt from the requirement of
Commission approval provided that single family homeowner shall secure approval for exterior
colors in accordance with the approved color palate from the building department prior to pulling a
building permit.
Section 2. Material Chart Requirements. All applicants for site plan approval shall create and
present to the City Commission a materials chart which shall consist of actual samples including the
color type and manufacturing name and identifying the numbers of roofing materials and the color
type and the manufacturing name and identifying the numbers of paint to be used in the project and
in incompliance with the sample of color and painting and awning work palate of colors to the City.
The City shall maintain the materials chart until the issuance of this certificate of completion or the
certificate of occupancy and for such time it may determine necessary.
b) The applicant shall also provide the City with the information from the materials chart in written
form including the name of the manufacturer and manufacturer's designation number for each item
used on the materials chart which shall be attached to the site plan approval application and shall be
incorporated as part of the application.
Section 3. Severability. The provisions of this Ordinance are declared to be severable and ifany
section, sentence, clause or phrase of this Ordinance shall, for any reason, be held invalid or
unconstitutional, such decision shall not affect the validity of the remaining sections, sentences,
clauses and phrases of this Ordinance but they shall remain in effect, it being the legislative intent
that this Ordinance shall stand notwithstdllding the invalidity of any part.
Section 4. Repeal of Conflicting Ordinances. All Ordinances or parts of Ordinances in conflict
herewith be and the same are hereby repealed.
Section 5. Inclusion in the Code. It is the intention of the Commission, and it is hereby
ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny
Isles Beach Code; that the sections of this Ordinance may be renumbered or re-lettered to accomplish
such intentions and that the word "Ordinance" shall be changed to "Section" or other appropriate
word.
Section 6. Effective Date. This Ordinance shall take effect ten (10) days after its adoption at
second reading.
