HomeMy WebLinkAboutOrdinance 2005-222 ORDINANCE NO. 2005-222 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 265-46 "OFF-STREET PARKING, LOADING AND DRIVEWAY STANDARDS" OF THE LAND DEVELOPMENT REGULATIONS TO REPEAL SECTION 265-46A (2) (b) WHICH PROVIDED FOR A PARKING "BUY-DOWN" AMENDING SECTION 265-46A(4) TO REDUCE TANDEM PARKING FROM 100% TO 20%; AMENDING SECTION 265-46A(7) TO ENLARGE THE SIZE OF ALL PARKING SPACES TO NO LESS THAN NINE FEET; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission has the authority to amend its Land Development Regulations; WHEREAS, the City Commission has reason to believe based on demographic trends as well as the significant increase in light of the use of trucks, vans, and sports utility vehicles for daily transportation that current parking requirements for the City must be revisited to address both the number of parking spaces as well as the space dimensions to accommodate vehicle size. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA AS FOLLOWS: Section 1. Amendments. a. Section 265-46A.(2)(b) "Off-Street Parking, Loading and Driveway Standards" of the Land Development Regulations of the City of Sunny Isles Beach, Florida providing up to 20% of the off-street parking spaces to be bought down by a contribution to the City Off-Street Parking Trust Fund be and the same is hereby repealed. b. Section 265-46A (4) Tandem parking. Tandem parking shall abide by the definition under Article II of this Code. Twenty (20) percent of the required off- street parking spaces, other than handicapped parking, may be permitted as tandem parking. Tandem parking spaces shall meet the dimensional requirements of the code for standard parking spaces; the drive aisles may be reduced to 18 feet. All applications for the use of tandem parking must be approved by the City Commission and the applicant must enter into an agreement, recorded in the public records at the expense of the owner and shall run with the land and shall bind the heirs, successors, and assigns of said owner which requires all 02005-222 Amd On-Street Parking See 265-46.Doc Page 1 DB developments having any tandem parking spaces to provide twenty-four-hour valet parking service. c. Section 265-46A. (7) Size and character or required parking. The following design requirements shall be observed for off-street parking: (a) Size; parking stalls. Each parking space required and provided pursuant to the provisions of this article shall be not less than nine feet in width and 18 feet in length for all commercial and mixed use developments. Each parking space required and provided pursuant to the provisions of this article shall be nine (9) feet in width and 18 feet in length for all residential only developments. Section 2. Applicability. This Ordinance shall not apply to any zoning application that has been filed with the City prior to the adoption ofthis Ordinance, February 10, 2005. Section 3. Inclusion in the Code. It is the intention of the City Commission, and it is hereby ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny Isles Beach Code; that the sections of this Ordinance may be renumbered or re-Iettered to accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or to other appropriate word. Section 4. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall, for any reason, be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this Ordinance but shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part Section 5.
