HomeMy WebLinkAboutOrdinance 2005-224 ORDINANCE NO. 2005-~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 33-3(E) (4) OF THE ETHICS CODE OF THE CITY OF SUNNY ISLES BEACH TO REQUIRE DISCLOSURE OF ANY GIFT HAVING A VALUE IN EXCESS OF ONE-HUNDRED (($100) DOLLARS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City is required to comply with the Ethics Code of Miami-Dade County; and WHEREAS, the Miami-Dade Commission on Ethics has recently amended its Gift Law to increase the disclosure amount for gifts from twenty-five ($25) to one-hundred ($100); and WHEREAS, the City wishes to amend its Ethics Code to comply with the Ethics Code of Miami-Dade County; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, AS FOLLOWS: Section 1. follow: Definitions. Section 33-3(E)(4) of the Ethics Code is hereby amended to read as (4) Disclosure. Any person included in the terms defined as COMMISSIONERS; AUTONOMOUS PERSONNEL; QUASI- JUDICIAL PERSONNEL; ADVISORY PERSONNEL; DEPARTMENTAL PERSONNEL; and EMPLOYEES in subsection B shall disclose any gift, or series of gifts from anyone person or entitv, having a value in excess of one-hundred dollars ($100.00), Said disclosure shall be made by filing a COpy of the disclosure form required by Chapter 112., Florida Statutes, for "local officers" with the City Clerk simultaneously with the filling of the form with the Secretary of State. Section 2. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall, for any reason, be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this Ordinance but shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Gift Amendment Ordinance. Created on 2/2/05 1 Section 3. Repealer. Any and all ordinances, resolutions and parts of ordinances or resolutions in conflict with this Ordinance are hereby repealed insofar as they are inconsistent or in conflict herewith. Section 4. Inclusion in the Code. It is the intention of the City Commission, and it is hereby ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny Isles Beach Code; that the sections of this Ordinance may be renumbered or re-Iettered to accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or to other appropriate word.
