ORDINANCE NO. 2005 - ~;}~
AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, AMENDING ORDINANCE NUMBER 2004-196;
ADOPTING A REVISED FEE SCHEDULE FOR THE BillLDING
DEPARTMENT, ATTACHED AS EXIDBIT "A"; PROVIDING THE
CITY MANAGER WITH THE AUTHORITY TO REVIEW
ANNUALLY ALL BillLDING DEPARTMENT FEES; PROVIDING
FOR REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING
FOR CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE;
WHEREAS, by Ordinance Number 2004 - 196, the City Commission adopted a
fee schedule for the Building Department; and
WHEREAS, the City Manager has the authority to review all Building Department
fees to determine if an adjustment to the fee schedule should be recommended to the City
Commission; and
WHEREAS, based on in-depth review of the fee schedule, City Manger is
recommending an adjustment to the fee schedule as reflected in Exhibit" A", amending
Ordinance Number 2004 - 196.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Adoption of Revised Fee Schedule. The revised building fee schedule,
attached hereto as Exhibit "A" is hereby adopted for the City of Sunny Isles Beach.
Section 2. Authority of City Manager. The City Manager and/or his designee are
hereby directed to annually review the Building Department Fee Schedule to determine if
an adjustment to the fee schedule should be recommended to the City Commission.
Section 3. Effective Date. This Ordinance shall become effective ten (10) days after
adoption upon second reading.

A. GENERAL INFORMATION ON SPECIAL FEES,
REFUNDS, EXTENSIONS AND CANCELLA TIONS

1. DOUBLE FEES

Any person who commences building, structural, $100.00
electrical, gas, mechanical or plumbing system work
before obtaining the building official's approval by
means of a City-issued permit shall be subject to a
penalty of 100 percent (100%) of the usual permit
fee in addition to the required permit fees. When
work (for which a permit is required) is commenced
prior to obtaining a permit, the homeowner will be
required to pay the specified fee twice (double
permit fee) to the Buildin De artment before it will
issue the permit The payment of
the required fee shall not relieve the applicant from
being subject to any other penalties therein (code
enforcement fines may apply). The double fee
requirements shall be applicable to all divisions of
the Building Department as noted herein.

If a permit applicant is found doing work without a $250.00
permit as stated above in A-001 a second time, the
permit applicant shall be required to pay twice the
double fees plus the following amount.

If a permit applicant is found doing work without a $500.00
permit as stated above in A-001 a third time and any
other time thereafter, the permit applicant shall be
required to pay twice the double permit fee plus the
following amount.
2. RE-INSPECTION FEES
A-004
Upon receipt of a permit, the permit holder shall be $fi5~gg
entitled to one (1) initial inspection for each
mandatory inspection. All work shall be inspected
and if any deficiency is found it shall be noted by the
inspector for correction by the contractor. When the
work described on the permit is partially completed,
an inspection shall be performed on those portions

of the work completed, provided that compliance
with the Florida Building Code may be determined
with respect to those portions. If an inspection is
required to assure compliance with the Florida
Building Code once the initial inspection and one (1)
follow-up inspection have been done, the permit
holder shall pay a fee for each additional ins ection.

(a) LOST PLANS: When a field copy (job copy) is
lost, a recertification fee shall be paid to the Building
Department (before the office copy is sent out for
duplication). The recertification fee shall cover the
following services from the Building Department:
review and approval by all applicable trades, and
stamp indicating the Building Official's certification.
Such fee shall be based on thirty percent (30%) of
the original building permit fee.

4. REFUNDS, TIME LIMITATIONS, AND
CANCELLATIONS

The fees charged pursuant to this schedule, provided
the same are for a permit required by Section 104.1.1
of the Florida Building Code, may be refunded by the
Building Official with the following exceptions:
(a) No refunds shall be made on requests involving:
(1) permits fees of $100.00 or less; or
(2) permits revoked by the City Manager or
the Building Official under authority granted by
the Florida Building Code, or permits cancelled by
Court Order, or conditional permits; or
(3) permits which have expired; or
(4) permits under which work has
commenced as evidenced by recorded inspection
having been made by the Building Department;
or
(5) no refunds shall be made on a permit
when a change of contractor is requested.
(b) A full refund less $100.00 or 50% of the permit
fee, whichever is greater, rounded to the nearest
dollar, shall be granted to a permit holder who
requests a refund provided that:

(1) The Building Department receives an
original and hardcopy written request from the
permit holder prior to the permit expiration date;
(2) The permit holder submits with such
request [as noted in item no. A-009(b)(1)] the
Applicant's validated copy of such permit; and
(3) That no work has commenced under such
permit as supported by any recorded inspection
and/or field inspection.
(c) Applications having a change of contractor or
qualifier shall pay a fee of $85.00 to cover the
cost of transferring the data from the original
permit to the second permit. When an original
permit has expired under section 104.5 of Florida
Building Code the original permit fee shall be
paid.
(d) A fee of $100.00 shall be paid by the permit
holder who submits a written request for a permit
extension as authorized under the Florida
Building Code Section 304.3(b).
(e) Where a permit has become null and void
pursuant to section 104.5.1 Florida Building
Code, a credit of fifty percent (50%) of the
permit fee shall be applied to any re-application
fee for permit covering the same project and
involving the same plans, provided that the
complete re-application is made within six (6)
months of the expiration date of the original
permit, and provided that no refund had been
made as provided in this Section.

Other agencies including, but not limited to, the
Department of Environmental Resources
Management (DERM), Miami-Dade Fire Rescue
Department, Building Code Compliance Office and
the Florida Department of Health may assess fees
on building permits, including re-application on
expired permits (contact the applicable agencies
for details).
5. SPECIAL PROJECTS:
A fee equal to actual staff time and related costs shall
be assessed for special projects requiring research by
the Building Department in order to answer questions
proposed by developers, attorney's, realtors, or
municipalities, and others, in connection with the use,
re-subdivision, and development of properties, or
determination if any violations exist on the property
through a review of departmental records. Such
special fee will only be levied for requests outside the
scope of normal departmental work. A minimum fee
shall be charged, a fee equal to $2.00 per page shall
be assessed for pre-programmed computer reports on
Building Department records. The minimum fee shall
be $50.00.
6. GENERAL INFORMATION:

(a)A fee charged per square foot will be added to $ 0.01
building permits for the State of Florida to study
building code requirements for radon gas, and
certification and regulation of building code
administrators, plans examiners and inspectors.
(b)A six percent (6%) fee of the total permit fee will
be added to original fees where a concurrency
review was performed.

7. COST OF PUBLICATIONS AND RECORDS

(a) FLORIDA BUILDING CODE, OTHER CODE
BOOKS, SUPPLEMENTS AND DEPARTMENTAL
PUBLICATION FEES
The charge for each copy of the Florida Building Code,
other code books or supplements thereto or other
departmental publications shall be assessed by the
Building Department in the amount equal to the low
bid printing cost plus the demonstrable cost to the
Building Department of selling and distributing such
code books, code supplements or departmental
publications. The charge for publications of
Construction Lien Law information is limited to $5.00
per copy of publication as permitted under Chapter
713 of the Florida Statutes.

8. INSPECTIONS REQUIRING OVERTIME:

9. FEES BASED ON ESTIMATED COST-
DOCUMENTATION REQUIREMENTS
The Building Department may require the permit
applicant to submit appropriate documentation as
proof of estimated cost of construction used to
compute permit fee.
10. TRAINING AND EDUCATION FEES:
All permits for new construction alterations or
additions shall be accompanied by payment of
training and educational fee of two percent (2%) of
the permit fee cost. All fees collected pursuant
hereto shall be set aside to offset the cost of
training and education of personnel in the
regulation, inspection and enforcement of the
Florida Building Code.
11. TECHNOLOGY FEES
All permits for new construction, alteration or
additions shall be accompanied by payment of a
technology fee of 5.0%. All fees collected pursuant
hereto shall be set aside to offset the cost of
computer system purchases or technology
expenditures within the building department.

12. PRE - SUMITAL REVIEW FEES: $ 52.00
A per hour fee will be assessed for Building,
Electrical Mechanical, Plumbing and Zoning review
when the customer elects to submit plans for pre - $ 120.00
submittal review.
A per hour fee will be assessed for Structural and
Landscaping pre - submittal review. Refer to
Professional Fee Ordinance.
13. STRUCTURAL ENGINEER PLAN REVIEW: $ 115.00
A per hour fee will be charged for plan review for all
new construction and alteration/repair that involves
structural review.
14. LANDSCAPE ARCHITECTURAL REVIEW: $ 115.00
A regular per hour fee will be charged for
landscaping review.
B. BUILDING PERMIT FEES
Fees listed in Subsection (B) include only building
permit fees and do not include fees for Plumbing,
Electrical and Mechanical, which are listed in the
following sections:
1. UP - FRONT PROCESSING FEE
