HomeMy WebLinkAboutOrdinance 2005-238 ORDINANCE NO. 2005- 23~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 68-2 (E) RELATING TO REIMBURSEMENT OF EXPENSES TO REQUIRE THE APPROVAL OF EXPENSES SUBMITTED BY CHARTER OFFICERS OF THE CITY; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission has the authority to adopt its own rules to regulate the reimbursement of business expenses incurred in the performance of official duties of the City officials; and WHEREAS, the City commission has the desire to create the accountability for the reimbursement of expenses submitted by Charter officers. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this ordinance upon hereof. Section 2. follows: Amendment. Section 68-2 (E) of the City Code is hereby amended to read as (E) Procedure for reimbursement of expenses. After travel has been completed and reimbursable travel-related expenses have incurred. employees of the City must complete a travel reimbursement form prepared by the City Manager and/or designee to receive reimbursement. A travel reimbursement form along with receipts must be submitted to the City Manager and or designee within three weeks of returning from travel. Upon receipt of a completed travel reimbursement forms, the City Manager and/or designee will perform a review to determine compliance with the City's travel reimbursement policies. Any noncompliance, missing information, etc. will delay the reimbursement of expenses. Notwithstanding any provision in Chapter 68, the Mayor and a member ef the City Commission shall approve expenses submitted by Charter Officers which exceed five hundred one thousand dollars ($1.000.00 $500.00) per occurrence in the aggregate. If the Mayor is not available, the Vice Mayor shall approve such expenses '.'lith another member of the City Commission. Any and all ordinances, resolutions and parts of ordinances or resolutions in conflict with this Ordinance are hereby repealed insofar as they are inconsistent or in conflict herewith. Section 4. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 5 . Inclusion in the Code. It is the intention of the Commission, and it is hereby ordained, that the provisions of this ordinance shall become an appendix to the City of Sunny Isles Beach Code; that the sections of this ordinance may be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be changed to "section" or other appropriate word, as required. Section 6. Effective Date. This Ordinance shall be effective ten (10) days after adoption on second reading. PASSED and ADOPTED on first reading the T3f' day of~, 2005.
