ORDINANCE NO. 2006- 2 53
AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF SUNNY ISLES BEACH, FLORIDA,
AMENDING SECTION 250-12 OF THE CODE OF THE
CITY OF SUNNY ISLES BEACH RELATING TO THE
UTILITY REQUIREMENTS OF NEW CONSTRUCTION
AND REHABILITATED STRUCTURES; PROVIDING
FOR THE INSTALLATION OF UNDERGROUND
SERVICE FACILITIES ON ALL NEW
CONSTRUCTION WITHIN THE BOUNDARIES OF
THE CITY OF SUNNY ISLES BEACH; PROVIDING
FOR SEVERABILITY; PROVIDING FOR REPEALER;
PROVIDING FOR INCLUSION IN THE CODE;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, it is the general policy of the City of Sunny Isles Beach to require the
underground installation of utilities to the greatest extent feasible; and
WHEREAS, the City of Sunny Isles Beach adopted this underground utility installation
policy in order to assure public safety, foster tree preservation, and improve and protect the
aesthetic character of the City; and
WHEREAS, currently the Code of the City of Sunny Isles Beach only requires that new
construction abutting Collins A venue to the east and west are required to install underground
service facilities; and
WHEREAS, the City Commission has determined that it is in the best interest of the
residents of the City to promote an environment free from overhead utility service facilities
throughout the City of Sunny Isles Beach.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified
and confirmed as being true and correct and are hereby made a specific part by this ordinance
upon adoption hereof.
Section 2.

Amendments. Section 250-12 (A) of the City Code is hereby amended to read as
A. All new construction abutting Collins A venue to the east and west and within the
Town Center District (TCD), including but not limited to single-family
residences (if any), multiple-family dwelling units, hotel and/or time-share
units, and commercial properties shall be required to install underground service
facilities. The requirements of this section shall not apply to any development
proiect in the Town Center District which has been approved by the City
Commission prior to the adoption of this amendment provided that the frontage
for the proiect is identical to the frontage in the site plan approved by the City
Commission.

Section 3. Severability. The provisions of this Ordinance are declared to be severable and if
any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be
invalid or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby
ordained, that the provisions of this ordinance shall become and be made a part of the code of the
City of Sunny Isles Beach, Florida; and that the sections of this ordinance may be renumbered or
relettered to accomplish such intentions; and that the word "ordinance" shall be changed to
"section" or other appropriate word, as required.
Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the
same are hereby repealed.
Section 6. Effective Date. This Ordinance shall be effective ten (10) from adoption on
second reading.

Ordinance Requiring the Installation of Underground Service Facilities on all
New Construction within the City boundaries
RECOMMENDA TION
This Ordinance is presented for your consideration and approval.
REASONS
The general policy of the City of Sunny Isles Beach is to require the underground installation of
utilities to the greatest extent feasible. Currently, the City Code only mandates this requirement
for new construction abutting Collins Avenue to the east and west. I believe that the
underground requirements should apply to development projects in the Town Center District.
Please note that this requirement will not apply to projects that have already received
development approval.
