HomeMy WebLinkAboutOrdinance 2006-258 ORDINANCE NO. 2006- 'A. 5 B AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTIONS 233-3 AND 233-5 OF THE CODE OF THE CITY OF SUNNY ISLES BEACH TO INCREASE THE APPLICATION FEE FOR SPECIAL EVENTS PERMITS; CREATING AN APPLICA TION FEE SCHEDULE FOR SPECIAL EVENTS PERMITS; REPEALING SECTION 233- 5 IN ITS ENTIRETY; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach currently provides for a permit application fee for special events, but no outdoor special events; and WHEREAS, outdoor special events are held on a regular basis in the City and impacts the City's resources; and WHEREAS, in order to maintain the same level of services and protect the health and welfare of its residents, the City wishes to amend Ordinance No. 2004-209 by establishing criteria for hosting of outdoor special events in the City. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Amendment. Section 233-3 of the Sunny Isles Beach Code of Ordinances is amended as follows: A. The City Manager or designee may impose such fees as they determine appropriate considering the impact of the special event on the City facilities and services, including without limitation, user fees for particular City properties, rates for exclusive use of public property, and concession agreements for paid admissions, and sale of food, beverage and merchandise on public property. The City Manager may, ffi at his discretion, reduce or waive the submission periods, or fees for events by not-for-profit corporations, for a particular event when such waiver is found to be in the best interest of the City. B. An application fec of fOliy ($10.00) dollars shall be submitted \vith a special event permit application. The following fee schedule shall apply for all special event permit applications: Page I of3 (1) 01 to 49 People No Charge* (2) 50 to 249 People $75.00 (3) 250 to 499 People $100.00 (4) 500 to 749 People $200.00 (5) 750 People and above $500.00 The above-listed fees shall be reviewed by the City Manager or his designee on an annual basis. Section 2. Amendment. Section 233-5 of the Sunny Isles Beach Code of Ordinances is amended as follows: A permit is required for any outdoor event that is not defined as a special event in Section 233 1 herein abo','e. No application fee shall be required for permits issued under this section. Section 3. Repeal of Conflicting Provisions. All ordinances, or pmis of ordinances in conflict herewith be, and the same, are hereby repealed Section 4. Severability. If any section, subsection, clause or provision of this Ordinance is declared invalid or unconstitutional by a court of competent jurisdiction, the remainder shall not be affected by such invalidity. Section 5. Inclusion In The Code. It is the intention of the City Commission, and it is hereby ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny Isles Beach Code; that the sections of this Ordinance may be renumbered or re-lettered to accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other appropriate word. REASON (5): The Code Enforcement and Licensing Department is requesting a revision of the fees associated with the application for special event permits. Since the 2004 - 2005 fiscal years to date, the Department has received (374) special event applications. The original ordinance included a nominal processing fee. It is necessary to increase the processing fee to capture the administrative duties of the involved departments.
