AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, AMENDING CHAPTER 156 OF THE SUNNY ISLES
BEACH CODE ENTITLED "FEES, MISCELLANEOUS"; ADOPTING
A REVISED FEE SCHEDULE FOR THE BillLDING DEPARTMENT,
ATTACHED AS EXHIBIT "A"; PROVIDING THE CITY MANAGER
WITH THE AUTHORITY TO REVIEW ANNUALLY ALL
BUILDING DEPARTMENT FEES; PROVIDING FOR REPEALER;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, by Section 156-1 of the Code of the City of Sunny Isles Beach, the City
Commission adopted a fee schedule for the Building Department; and
WHEREAS, the City Manager has the authority to review all Building Department
fees to determine if an adjustment to the fee schedule should be recommended to the City
Commission; and
WHEREAS, based on in-depth review of the fee schedule, City Manger is
recommending an adjustment to the fee schedule as reflected in Exhibit "A", amending
Chapter 156 of the Sunny Isles Beach Code,
NOW, THEREFORE, BE IT ORDAINED BY THE CITYCOMMISSION OF
THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Adoption of Revised Fee Schedule. The revised building fee schedule,
attached hereto as Exhibit "A" is hereby adopted for the City of Sunny Isles Beach.
Section 2. Authority of City Manager. The City Manager and/or his designee are hereby
directed to annually review the Building Department Fee Schedule to determine if an
adjustment to the fee schedule should be recommended to the City Commission.
Section 3. Effective Date. This Ordinance shall become effective ten (10) days after
adoption upon second reading.

A. GENERAL INFORMATION ON SPECIAL FEES,
REFUNDS, EXTENSIONS AND CANCELLATIONS
1. DOUBLE FEES
A-OOl
Any person who commences building, structural, $100.00
electrical, gas, mechanical or plumbing system work
before obtaining the building official's approval by
means of a City-issued permit shall be subject to a
penalty of 100 percent (100%) of the usual permit
fee in addition to the required permit fees. When
work (for which a permit is required) is commenced
prior to obtaining a permit, the homeowner will be
required to pay the specified fee twice (double
permit fee) to the Building Department before it will
issue the permit plus penalty fee. The payment of
the required fee shall not relieve the applicant from
being subject to any other penalties therein (code
enforcement fines may apply). The double fee
requirements shall be applicable to all divisions of
the Building Department as noted herein.

If a permit applicant is found doing work without a $250.00
permit as stated above in A-DOl a second time, the
permit applicant shall be required to pay twice the
double fees plus the following amount.

If a permit applicant is found doing work without a $500.00
permit as stated above in A-DOl a third time and any
other time thereafter, the permit applicant shall be
required to pay twice the double permit fee plus the
following amount.
2. RE-INSPECTION FEES
A-004
Upon receipt of a permit, the permit holder shall be
entitled to one (1) initial inspection for each
mandatory inspection. All work shall be inspected
and if any deficiency is found it shall be noted by the
inspector for correction by the contractor. When the
work described on the permit is partially completed,
an inspection shall be performed on those portions

of the work completed, provided that compliance
with the Florida Building Code may be determined
with respect to those portions. If an inspection is
required to assure compliance with the Florida
Building Code once the initial inspection and one (1)
follow-up inspection have been done, the permit
holder shall pay a fee for each additional inspection.
All such re-inspection fees shall be paid prior to any
re-inspection taking place and the final inspection
being conducted. Payment should be in person at
the City of Sunny Isles Beach Building Department.

(a) LOST PLANS: When a field copy (job copy) is
lost, a recertification fee shall be paid to the Building
Department (before the office copy is sent out for
duplication). The recertification fee shall cover the
following services from the Building Department:
review and approval by all applicable trades, and
stamp indicating the Building Official's certification,

4. REFUNDS, TIME LIMITATIONS, AND
CANCELLATIONS

The fees charged pursuant to this schedule, provided
the same are for a permit required by Section 104.1.1
of the Florida Building Code, may be refunded by the
Building Official with the following exceptions:
(a) No refunds shall be made on requests involving:
(1) permits fees of $100.00 or less; or
(2) permits revoked by the City Manager or
the Building Official under authority granted by
the Florida Building Code, or permits cancelled by
Court Order, or conditional permits; or
(3) permits which have expired; or
(4) permits under which work has
commenced as evidenced by recorded inspection
having been made by the Building Department;
or
(5) no refunds shall be made on a permit
when a change of contractor is requested.
(b) A full refund less $100.00 or 50% of the permit
fee, whichever is greater, rounded to the nearest
dollar, shall be granted to a permit holder who
requests a refund proVided that:
(1) The Building Department receives an
original and hardcopy written request from the
permit holder prior to the permit expiration date;

(2) The permit holder submits with such
request [as noted in item no. A-009(b)(1)] the
Applicant's validated copy of such permit; and
(3) That no work has commenced under such
permit as supported by any recorded inspection
and/or field inspection.

(c) Applications having a change of contractor or
qualifier shall pay a fee of $85.00 to cover the
cost of transferring the data from the original $85.00
permit to the second permit. When an original
permit has expired under section .w4:5 '~05.4 of
Florida Building Code the original permit fee shall
be paid.

(d) A fee of $100.00 shall be paid by the permit
holder who submits a written request for a $100.00
permit extension as authorized under the Florida
Building Code Section 304.3(b).
(e) Where a permit has become null and void
pursuant to section 104.5.1 Florida Building
S?8e(a credit of fifty percent (50%) of the
9tlglhij! permit fee shall be applied to any re-
application fee for permit covering the same
project and involving the same plans, provided
that the complete re-application is made within
six (6) months of the expiration date of the
original permit, and proVided that no refund had
been made as provided in this Section.

5. SPECIAL PROJECTS:

A fee equal to actual staff time and related costs shall
be assessed for special projects requiring research by
the Building Department in order to answer questions
proposed by developers, attorney's, realtors, or
municipalities, and others, in connection with the use,
re-subdivision, and development of properties, or
determination if any violations exist on the property
through a review of departmental records. Such
special fee will only be levied for requests outside the
scope of normal departmental work.
A fee equal to $2.00 per page shall be assessed for
pre-programmed computer reports on Building $2.00

PUBLICATION FEES
The charge for each copy of the Florida Building Code,
other code books or supplements thereto or other
departmental publications shall be assessed by the
Building Department in the amount equal to the low
bid printing cost plus the demonstrable cost to the
Building Department of selling and distributing such
code books, code supplements or departmental
publications. The charge for publications of
Construction Lien Law information is limited to $5.00
per copy of publication as permitted under Chapter
713 of the Florida Statutes.

10. TRAINING AND EDUCATION FEES:

training and educational fee of two Dercent (2% 1
of the permit fee cost. All fees collected pursuant
hereto shall be set aside to offset the cost of
training and education of personnel in the
regulation, inspection and enforcement of the
Florida Building Code.

When an inspection is necessary prior to the issuance $ 32.00
of a C/O or TCO or TCC and inspection fee shall be
charged for each inspector who is required to make a
field inspection. Temporary C/O and CC will be charged
a fee equal to the final CO or CC cost in addition to the
inspection fee. This fee will be required regardless of
the length of time the Temporary CO or CC is needed
up to ninety (90) days for Certificates of Use and
Occupancy and up to sixty (60) days for Temporary
Certificate of Completion. Temporary Certificates of
Completion or Occupancy are charged at a fee equal to
the Permanent Certificate of Completion or Occupancy.

Revision to Building Department's Fee Schedule
RECOMMENDATION:
It is recommended that the City Commission approves the attached Ordinance
proposing a revision of the City of Sunny Isles Building Department's Fee Schedule.
REASON (5):
The Building Department, as directed by Chapter 156-2 of the Chapter and Code of the
City of Sunny Isles Beach, has reviewed the Department's Fee Schedule and has made
some minor adjustments to reflect the needs of the City, the Department, and the
community as a whole.
Among the proposed changes incorporated in the fee schedule as requested ,by the City
Commission at the November 16th 2006 Commission Meeting, the Building Department
has rounded off to the nearest dollar some of its fees. After carefully reviewing the
schedule; fees which are calculated per square footage, per lineal footage, per ton, per
Horse Power, per thousand dollars of estimated job value or fractional part thereof, or
fees calculated per one hundred dollars of job value or fractional part thereof; remained
unchanged. Rounding these figures up or down to the nearest dollar, depending on the
case, will cause a great monetary impact to either the residents or the City. On the other
hand, fees such as Landscaping for Code Compliance has been changed from $138.67
to $139.00; Tree removal was changed from $16.12 to $16.00; Irrigation System fee

was modified from $16.80 to $17.00; Mechanical fees on pages 29 and 30 of the
schedule were rounded off to the nearest dollar. Contractor Enforcement fees, Criminal
Processing Recovery Cost fees, and Florida Building Code - Unsafe Structures fees on
pages 31 and 33 were also rounded off to the nearest dollar.
As previously presented at the November 16, 2006 Commission Meeting, because of
the upcoming implementation of a new software program in our Department, and in an
effort to facilitate and make the fee schedule user friendly, we have re-c1assified and re-
codified certain items and sections of the fee schedule.
Equally relevant, among the proposed adjustment to the schedule, we have changed
the Landscape Architectural Review Fee, to reflect the current hourly rate charged by
the City's Landscape Architect Consultant. We are proposing to change the Building
pool deck fee from $112.00 to $2.50 per each $100.00 dollars of estimated job value.
We are also proposing to increase our current demolition fee from $10.00 to $50.00 for
additional 1000 sq ft of demolition or fraction thereof. We have added a section for the
replacement of broken glass for windows and doors. Equally important, and due to the
increasing amount of applications for tile installation received by our Department, we
have exclusively added a section to address tile installation. Along with the above
mentioned changes, we have also made other adjustments to the Electrical and
Mechanical schedule which encompass minor modifications to some fees as detailed in
the attached, proposed fee schedule.
