HomeMy WebLinkAboutOrdinance 2007-275 ORDINANCE NO. 2007- '2.'15 AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH, FLORIDA AMENDING SECTION 74-8 OF THE CITY'S RULES OF PROCEDURE; PROVIDING FOR AN INCREASE IN THE TOTAL MEMBERSHIP COMPOSITION OF ALL STANDING COMMITTEES FROM FIVE (5) MEMBERS TO SEVEN (7) MEMBERS; AUTHORIZING EACH LIAISON COMMISSIONER OF ANY STANDING COMMITTEE TO APPOINT ONE (I) COMMITTEE MEMBER; PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE AND AN EFFECTIVE DATE. WHEREAS, there has been a lack of quorum in the Standing Committees and, without a quorum, the Standing Committee cannot conduct official City business; and WHEREAS, in an effort to increase attendance, the City Commission desires to increase the total membership of all City Standing Committees. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Scction 1. Amcndmcnt. Section 74-8 of the City Code is amended as follows: ~ 74-8. Standing committccs; Chairpcrsons. A. There may be such standing committees of the City Commission as the Mayor or City Commission deems necessary to conduct the business of the City appropriately and in accordance with the City Charter. Such committees shall be governed by these rules of procedure and, if advisory, shall be subject to the Florida Sunshine and Public Records Laws. B. In accordance with S C-2.2(a)(ii) of the Charter, the Mayor shall appoint both a Chairperson and a Vice Chair person of each committee. In addition, each Commissioner shall appoint one member to each Committee. The Liaison Commissioner of a particular committee shall appoint one additional member to each Committee. The Committee shall consist of seven (7) members. Each member shall serve a one (]) vear term commencing on Januarv I st of each vear and ending on December 31 st of each vear. Beginning the vear 2007, the term shall end on December 31 st. The provisions of this Section shall onlv applv to committees created under this Section. Notwithstanding the foregoing, the Citv Commission mav remove a member of a committce with cause or without cause. Scction 2. Scvcmbilitv. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall, for any reason, be held to be 1 Ordinance Amending Total i\lcmbcrship of Standing Committees, Section 74-H invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this Ordinance but shall rcmain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 3. RCIICalcr. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed. Section 4. Inclusion in thc Code. It is the intention of the City Commission, and it is hereby ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny Isles Beach Code; that the sections of this Ordinance may be renumbered or re-lettered to accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or to other appropriate word. Section 5. Effcctivc Date. This Ordinance shall be effective ten (10) days after adoption on second reading. PASSED and ADOPTED on First Reading this ~ day of be"-Pm6er,-2006.
