ORDINANCE NO. 2007-~
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AMENDING
SECTIONS 265-51, 265-56, AND 265-57 OF THE SIGN CODE;
ESTABLISHING NEW REQUIREMENTS FOR WINDOW AND
TEMPORARY SIGNS; ESTABLISHING NEW
REQUIREMENTS FOR APPROVAL OF MURALS AND
GRAPHICS FOR TEMPORARY CONSTRUCTION FENCE;
PROVIDING FOR REPEALER; PROVIDING FOR
SEVERABILITY; PROVIDING FOR INCLUSION IN THE
CODE; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission has a desire to protect the public safety and welfare
and promote positive conditions for sign communication to enable business identification while
eliminating visual clutter in the City; and
WHEREAS, the City Commission wishes to amend the sign code to address certain
issues relating to window and temporary signs.
NOW THEREFORE, BE IT ORDAINED BY TIlE CITY COMMISSION OF TIlE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses arc hercby ratified
and confirmed as being true and correct and are hereby made a specific part by this Ordinance
upon adoption hereof.
Section 2.
Amendment. Section 265-5 I of the Sign Code is amended to read as follows:
~ 265-51. Definitions.
WINDOW SIGN m_ A sign attached to or painted on the inside of a storefront window or door
or anv sign located within a window or upon the inside surface or outside surface of the window
glass used to attract such attention located within the premises which is located within three (3)
feet from the window opening. An)' si!;n that can be seen from the outside whether or not attach
to storefront glass or door. (i.e., paper, neon, etc.)
Section 3.
Amendment. Section 265-56 of the Sign Code is amended to read as follows:

(9) Attention-getting devices or signs that emit sound, vapor, smoke, or moving signs that
revolve, rotate, flash, etc" except for a visual equipment within the maximum
permitted window sign area. such as a touch screen computer.
~ 265-56. Nonrcsidential, Town Ccnter and Mixcd-Use Resort District signs.
H. Window sign (permanent).
(1) Approvals necessary: City Manager or designee.
(2) Maximum number: one per establishment,
(3) Maximum sign area: fOHf square feet. Hffeen twentv percent (20%) of the total area of
all windows on the elevation where the sign is to be located. or ten square feet.
whichever is greater. The calculation of the permitted sign area shall exclude the
address. hours of operation and licensing information which may be displayed on
either the window or the door. but not both.
(4) Illumination: prohibited.
(5) Design standards: All window signs must be furnished in a professional manner and
professionally designed. Perimeter borders. stripes and bonding are permitted but will
count towards the calculation of window sign area. No paper signs are permitted on
the window or door unless the paper is within a professionally designed case attached
to the window.
I. Directional sign.
(1) Approvals necessary: City Manager or designee.
(2) Maximum number: to be approved as part of site plan; if not approved as part of site
plan, permit required.
(3) Maximum sign area: six square feet.
(4) Height: three feet.
(5) Other restrictions: Logo may cover no more than 25% of the sign area.
Section 4. Amendment. Section 265-57 of the Sign Code is amended to read as follows:

B. Real estate freestanding signs: No permit required.
(I) Residential Districts.
(a) Maximum number: one per lot, except corner lots may have two.
(b) Maximum sign area: ;! eight square feet.
(c) Maximum sign height: four feet.
(d) Setback: six feet from property line.
(e) Length of display: shall be removed within 10 days after closing, or in case of
property for lease, within five days after all space is leased.
(1) Other restrictions: sign copy shall be limited to:
1. Situation, i.e., sale, rent, lease, zoning, size of property;

2. Name of owner, broker or agent;
3. Phone number;
4. Designs or trademarks not comprising more than 20% of sign area; and
5. Sign to be located on the premises to be rented. leased or sold.
(2) Nonresidential Districts:
(a) Maximum number: one per lot or unit.
(b) Maximum sign area: M eight-square feet.
(c) Maximum sign height: four feet.
(d) Setback: six feet from property line.
(e) Length of display: shall be removed within 10 days after closing, or in case of
property for lease, within five days after all space is leased.
(1) Other restrictions: sign copy shall be limited to:
1. Situation, i.e., sale, rent, lease, zoning, size of property;
2. Name of owner, broker or agent;
3. Phone number;
4. Designs or trademarks not comprising more than 20% of sign area; and
5. Sign to be located on the premises to be rented. leased or sold.
C. Construction signs: Residential and Nonresidential:
(I) Maximum number: one per lot.
(2) Maximum sign area: 32 square feet.
(3) Maximum sign height: six feet.
(4) Setback: six feet from property line (not in right-of-way or within visibility triangle).
(5) Length of display: permitted for a twelve-month period from day of building permit
issuance or until construction is completed, provided active construction is ongoing.
(6) Other restrictions: sign copy shall be limited to:
(a) Project name;
(b) Nature of development;
(c) General contractor;
(d) Architect;
(e) Lending institution;
(1) Owner or agent;
(g) Phone number.
D. Freestanding Model signs: Residential and Nonresidential Districts:
(1) Maximum number: one per lot.
(2) Maximum sign area: four square feet.
(3) Maximum sign height: four feet
(4) Model arrow signs: three per development not to exceed two square feet each. Shall
not be located in right-of-way or sight visibility triangle.
(5) Time limit: until certificate of occupancy is issued for last house in development.
(6) Other restrictions: Sign copy shall be limited to:
(a) Model;

(b) Builder;
( c) Architect;
(d) Agent;
(e) Number of bedrooms and baths;
(1) Telephone number.
E. Window sign (temporary).
(I) Approvals necessary: City Manager or designee.
(2) Maximum number; one per establishment,
(3) Maximum sign area: four square feet. fifteen twenty percent (20%) of total area of all
windows on the elevation where sign is to be located. or ten square feet. whichever is
greater. The calculation of the permitted sign area shall exclude the address. hours of
operation and licensing information which mav be displayed on either the window or
the door. but not both.

is required. Such signs shall not exceed six (6) square feet in area and must be professionally
designed.
G. Murals and graphics. Graphics and murals on temporary construction fencing are
prohibited unless approved by the Citv Manager or designee. City Commissioll at site plan

discretion, may permit graphics and painted murals on temporary construction fences for
aesthetic enhancement of the fence and advertisement of the project to be constructed at site plall

approved administratively by the City Manager or designee without Ilotiee to tile Commission.
Section 5. Severability. The provisions of this Ordinance are declared to be severable and if
any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid
or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being thc
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 6. Inclusion in the Code. It is the intention of the Commission, and it is hereby
ordained, that the provisions of this Ordinance shall become and be made a part of the code of the
City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or
relettered to accomplish such intentions; and that the word "ordinance" shall be changed to
"section" or other appropriate word, as required.

Section 7. Repealer. All ordinances or part of ordinanccs in conflict herewith be and the
same are hereby repealed.
Section 8. Effective Date. This Ordinance shall be effectivc tcn (10) days after adoption on
second reading.

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the City Commission, also sitting as the Local
Planning Agency, of the City of Sunny Isles Beach, Florida, will hold a public hearing
in the Sunny Isles Beach Government Center, David P. Samson Commission
Chambers, 18070 Collins Avenue, Sunny Isles Beach, Florida, on Thursday, March
15, 2007, at 7:30 p.m., to consider final adoption of the following proposed
Ordinance:

Sign Code Amendment - Murals and Graphics for Temporary Fencing
At its regular meeting of March 15,2007, the City Commission adopted Ordinance No. 2007-
278, which amended the sign code ordinance with respect to murals and graphics for temporary
fencing. Additionally, the Local Planning Agency adopted LP A Resolution No. 2007-43, which
recommended the ordinance to the City Commission. Attached is a copy of the approving
resolutions for your files.

Amending Sign Code.
RECOMMENDATION
It is recommended that the City Commission approve the attached Ordinance relating to
signs.
REASONS
The City Commission on February 16, 2006 adopted revisions to the Sign Code. After
conducting previous workshops with members of the business community and based on
the comments expressed, the City Commission directed staff to revise some sections of
the code. The Department adopted the recommendation from the Business Community at
large as well as from the City Commission. The attached Ordinance outlines
requirements for the allowance of 20% of the total of all windows for permanent signs; of
the 20% a total of 5% may be used for an electronic informational display. It also
provides for requirements on freestanding signs and accounts for temporary window
signs. The Department feels that passing of this Ordinance will promote positive
conditions for sign communication to enable business identification while eliminating
visual clutter in the City.
