() AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, CHANGING THE 2007 ELECTION DATE FROM TUESDAY, NOVEMBER 13,2007, TO TUESDAY, NOVEMBER 6, 2007, PURSUANT TO A REQUEST MADE BY THE MIAMI- DADE ELECTIONS DEPARTMENT; ESTABLISHING DECEMBER 4, 2007, AS THE RUN-OFF ELECTION DATE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 5.1 of the City Charter provides that a general election be held on the second Tuesday, in each odd-numbered year; and WHEREAS, Section 100.3605, Florida Statutes, provides the City Commission with the authority to change the dates of its election; and WHEREAS, the Director of the Miami-Dade Elections Department has requested that the City change its election date to coincide with other local elections; and WHEREAS, this changc would benefit the City and the Elections Department in providing a more efficient and smooth election as well as providing a lower cost to the City; and WHEREAS, the City Commission wishes to change the City's election date pursuant to the request made by the County's Election Department NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISISON OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section I. Change of Election Date. The City Commission hereby approves the change of the 2007 election date from Tuesday, November 13,2007, to Tuesday, November 6,2007. Section 2. Change of Run-off Date. The City Commission hereby approves the change of thc run-off date from December 1 I, 2007, to December 4,2007. Section 3. SeverabiIitv. If any section, subsection, clause or provision of this Ordinance is declared invalid or unconstitutional by a court of competent jurisdiction, the remainder shall not be affected by such invalidity. Section 4. Repeal of Conflicting Provisions. All ordinances, or parts of ordinances in conflict herewith be, and the same, are hereby repealed Section 5. Effective Date. This Ordinance shall become effective ten (10) days after adoption on second reading. Hines, City Clerk City of Sunny Isles Beach Sunny Isles Beach Government Center 18070 Collins Avenue Miami Beach, FL 33160 Dear Ms. Hines: Per your request, I am writing to formally request that the City of Sunny Isles Beach changes, via ordinance, the date of its upcoming General Election from November 13, 2007 to a new date of November 6,2007. This change will be of mutual benefit to both the City of Sunny Isles Beach and the Miami-Dade Elections Department. Several other municipalities are currently holding elections on November 6th and the Department can more efficiently run several municipal elections on one date than on several different dates. In turn, the efficiencies that we realize will result in the distribution of certain fixed costs among several municipalities, resulting in lower costs to each municipality, including Sunny Isles Beach. This would not be the case if using separate dates. As it currently stands, the City of Sunny Isles Beach is the only scheduled election for November 13th, resulting in a higher cost to conduct that election. Additionally, fewer election dates leads to less voter confusion and higher turnout. Media are more apt to inform the public about an election date in which more voters are eligible to participate. The Childhood Obesity Prevention Program, CHOPP, is a support group (or over- weight children and their par- ents. REASONS The Miami-Dade County Elections Department has requested the City of Sunny Isles Beach to move its Election date from Tuesday, November 13,2007 to Tuesday, November 6, 2007. The run-off election date, if needed, would change from December I I, 2007 to December 4,2007. This change would be of mutual benefit to the City and to the Elections Department as several municipalities are holding elections on November 6, 2007 (Hialeah, Miami, Miami Beach, and Homestead). The Elections Department can run several municipal elections more efficiently on one date rather than on several different dates. It can also result in spreading out certain fixed costs among several municipalities, resulting in lower costs to each municipality. The estimated savings for the City of Sunny Isles Beach is over $10,000.00. ADDITONAL INFORMATION Additionally, fewer election dates can lead to less voter confusion and higher voter turnout because media are more apt to inform the public about an election date in which more voters are eligible to participate.
