HomeMy WebLinkAboutOrdinance 2007-282 ORDINANCE NO. 2007- 2 ~ 2 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, CREATING A NEW CHAPTER ENTITLED "NUISANCE" TO ESTABLISH GUIDELINES TO REGULATE VARIOUS TYPES OF PUBLIC NUISANCE WITHIN THE CITY'S JURISDICTION; PROVIDING FOR PENALTIES AND ENFORCEMENT; PROVIDING FOR REPEAL, SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE. WHEREAS, the City Commission finds there exist certain types of activities in the City which create a nuisance and affects the safe, quiet and comfort and repose of City residents; and WHEREAS, the City Commission wish to establish guidelines to regulate public nuisance within the City of Sunny Isles Beach; and WHEREAS, the adoption of this ordinance is in the best interest of the City of Sunny Isles Beach residents and will preserve the health, safety and welfare of the City residents. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section I. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct '.md are made a specific part by this ordinance upon adoption hereof. Section 2. Adoption of Nuisance Ordinance. Chapter 194 entitled "Nuisance" is hereby created as follows: NUISANCE 194-1. Public Nuisance Declared. Whatever annoys, injures, or endangers the safety, health, comfort or repose of the public; interferes with or destroys or renders dangerous any street, highway, allows accumulation of junk or obnoxious matters on private property; or in any way renders the public insecure in life or property is hereby declared to be a public nuisance. Public nuisances shall include, but not be limited to, whatever is forbidden by any provision of this Chapter and the common and statute law of this state. This chapter is hereby declared remedial and essential to the public interest and shall be liberally construed to accomplish its intended purpose. For purposes of this chapter a "public nuisance" shall be defined as any of the following: A. Abandoned or Dangerous Buildings. (1) The owner of any dangerous building who fails to comply with any notice or order to repair, vacate or demolish said building given by any person authorized under this Code to give such notice or order shall be guilty of a violation of this Chapter. (2) The occupant or lessee in possession who fails to comply with any notice to vacate or who fails to repair said building in accordance with any notice given, as provided for in this Chapter, shall be guilty of a violation of this Chapter. B. Abandoned Iceboxes, Refrigerators, Etc. Any person who knowingly leaves, in a place accessible to children, any abandoned, unattended or discarded icebox, refrigerator or other container of a kind and size sufficient to permit the entrapment and suffocation of a child therein, without first removing the snap lock or other locking device from the lid or cover thereof, is guilty of a misdemeanor. C. Dangerous Structures. Any structure which is unsafe or which is a menace to the health, morals or safety of the public. (1) Emergency Abatement. The Building Official shall have the power to abate any dangerous structure or building if the public safety shall require immediate action due to a distinct hazard to life or property. (2) Cost for Abatement. The cost of abating such public nuisance shall be charged against the owner or occupant of the premises and payment thereof shall be enforced through special assessment as provided in the City Code. D. Continuous Noise. The making of any continuous loud, unnecessary and unlawful noise as defined by Chapter 193 of this Code. 194-3. Exercise of Police Power. It is deemed by the City Commission of the City of Sunny Isles Beach, Florida, that this Chapter is necessary and a lawful exercise of the police power of the County for the protection of the public health, welfare, and safety of the City residents. 194-4. Enforcement; Penalties. Violators ofthis ordinance shall be subject to the penalties prescribed in Chapter 14 of the City's Code of Ordinances, providing for a maximum fine of $500 for each single violation and up to $500 per day for each continuing or repetitive violation, or may be subject to imprisonment of 2 U:\LEGISTLA TION\Draft Ordinances\2007\Creating Chapter 194, Public Nuisance 030207.doc not more than sixty (60) days. The City's Code Enforcement Department shall be responsible for enforcing this Chapter. The Police Department may also enforce this Chapter. The provisions discussed herein shall also be enforceable through injunctive relief as a means of protecting the public's interest through the exercise ofthe City of Sunny Isles Beach's police power, and through any other means available at law. Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby ordained, that the provisions of this Ordinance shall become and be made a part of the Code of the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be changed to "section" or other appropriate word, as required. Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed. Section 6. Effective Date.
