HomeMy WebLinkAboutOrdinance 2007-281 ORDINANCE NO. 2007- ~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 265-52 OF THE SIGN CODE TO PERMIT A TELEVISION OR COMPUTER MONITOR WITHIN THE WINDOW SIGN AREA; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission wishes to permit the use of television monitors within the window sign area; and WHEREAS, the sign code is required to be amended in order to permit the use of television monitors within the window sign area. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISISON OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clause are hereby ratified and confirmed as being true and correct are hereby made a specific part by this Ordinance upon thereof. Section 2. Amendment. Section 265-52 of the Sign Code is amended to read as follows: ~ 265-52 Prohibited signs. (1) A sign that covers, interrupts or disrupts the major architectural features of a building. (2) Abandoned signs or signs that relate to a discontinued business or service. (3) (Reserved) (4) All signs located on or over public property or right-or-way, except those installed by governmental agencies c r banners attached to publicly approved pole brackets for special event purposes only. (5) Animated signs, except a television or computer monitor installed in the window SIgn area. Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Amendment To Sign Code. Doc Page I 01'2 Section 4. Repeal of Conflicting Provisions. All ordinances, or parts of ordinances in conflict herewith be, and the same, are hereby repealed Section 5. Inclusion In The Code. It is the intention of the City Commission, and it is hereby ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny Isles Beach Code; that the sections of this Ordinance may be renumbered or re-Iettered to accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other appropriate word, as required. Section 6. Effective Date. This Ordinance shall become effective ten (l0) days after adoption on second reading. PASSED and ADOPTED on First Reading the ~ day of MARc H ,2007.
