ORDINANCE NO. 2007-~
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA; AMENDING SECTION
201-5 OF THE CODE OF THE CITY OF SUNNY ISLES BEACH
RELATING TO RECREATIONAL ACTIVITIES TO PROVIDE
THE CITY MANAGER WITH THE AUTHORITY TO
ESTABLISH GUIDELINES FOR ORGANIZED COMMERCIAL
WEDDINGS AND SPECIAL EVENTS ON THE PUBLIC BEACH;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEALER; PROVIDING FOR INCLUSION IN THE CODE;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Sunny Isles Beach, Florida, (the "City")
has worked diligently each year to make the City a world class destination community; and
WHEREAS, the City has numerous hotels who are seeking to compete in the business of
hosting weddings; and
WHEREAS, by adopting this Ordinance, the City Commission will provide hotels in the
City with the ability to compete with other hotels in coastal communities.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1.
Amendment. Section 201-5 of the City Code is amended to read as follows:
Section 201-5. Recreational activities.
A. Rule 14. Recreational activities. No person shall engage in recreational or other
activities other than those prescribed in certain areas set aside for such purposes.
B. Rule 15. Games, etc. No person or persons shall engage in rough or potentially
dangerous games or practice for same, such as football, baseball, softball, horseshoes,
golf, lacrosse, soccer, cricket, rugby, tennis, volleyball, badminton or any other games,
practice or exercise involving thrown or otherwise propelled objects such as balls, stones,
arrows, javelins, shuttlecocks, radio controlled or model aircraft or engage in racketeering
except for those organized and administered by the City of Sunny Isles Beach in areas
specifically designated and set aside for such recreational usages.
C. Rule 16. Bathing and swimming.
(1) No person, regardless of age, sex, or manner of dress shall swim, wade, or
bathe in waters or waterways in or adjacent to any park other than at such

places as are provided for such activities and in compliance with the rules of
these areas as to hours of the day and safety limitations for such use.
(2) No person shall erect or cause to be erected any tent, shelter or structure on or
in any City Park unless expressly authorized in writing by the Department
Director.
D. Rule 17. Hunting and firearms. No person shall erect or cause to be erected any tent,
shelter or structure on or in any City Park unless expressly authorized in writing by the
Department Director
E. Rule 18. Toy firearms, fireworks and explosives.
(1) No person may bring into, or have in his possession, or set off or otherwise
cause to explode, discharge or burn in any park area or on any public lands or
highways adjacent thereto, any firecrackers, torpedoes, rockets, toy firearms
or cannon, sparklers or other fireworks or explosives of inflammable materials
or any substance or compound that, may explode, discharge or burn, unless
first obtaining written permission from the Department Director.
(2) Parents or guardians will be held strictly responsible and accountable for the
actions of minors in regards to the prohibitions in Subsection E(1).
F. Rule 19. Picnic areas and use.
(1) No person will cook in any area not specifically designated by and regulated
by the Director for such usage.
(2) The Director will regulate activities in picnic areas when necessary to prevent
congestions and to secure the maximum use for the comfort and convenience
of all. If the facilities are crowded, persons holding picnics in any park picnic
areas, building or structure, will avoid using same to the exclusion of others
for an unreasonable time, the determination of what is unreasonable being at
the discretion of the Director.
G. Rule 19(a). Weddings and special events on the beach. The City Manager in conjunction
with the Department Director shall establish guidelines for organized commercial
weddings and special events on the City's public beach. Such rules and regulations shall
be codified in an administrative order, as may be amended from time to time, and be
readily accessible to the public.
Section 2. Severability. The provisions of this Ordinance are declared to be severable and if
any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid
or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.

Section 3. Inclusion in the Code. It is the intention of the Commission, and it is hereby
ordained, that the provisions of this ordinance shall become and be made a part of the code of the
City of Sunny Isles Beach, Florida; and that the sections of this ordinance may be renumbered or
relettered to accomplish such intentions; and that the word "ordinance" shall be changed to
"section" or other appropriate word, as required.
Section 4. Repealer. All ordinances or part of ordinances in conflict herewith be and the
same are hereby repealed.
Section 5. Effective Date. This Ordinance shall be effective ten (10) days after adoption on
second reading.

Miami Beach voters will
decide in a November refer-
endum whether to spend up
to $95 million in new bonds to
transform the Miami Heart
Institute into a park
In a divisive 4-3 vote, the
Miami Beach City Commis-
sion decided Wednesday
night to support the proposal
ior a park referendum, made
by Commissioner Simon
Cruz, after four hours of con-
tentious debate.
"We'll never get a shot at
this again, Once we lose this,
we lose it. We can do nothing
beller for our children than to
buy this land," Cruz said.
Atthe same time, the com-
mission also decided to put a
competing referendum - to
amend the city charter so that
when hospital property is
rezoned, it can only become
as dense as the properties sur-
rounding it - on the ballot
sometime next year. Origi-
nally, city ofticials wanted to
place the amendment on the
ballot Jan. 29, when the state's
tax super-exemption will be
on the ballot, but City Allor-
ney Jose Smith said legal
restrictions prohibited that.
Mount Sinai Medical Cen-
ter purchased the Miami
Heart Institute site, at 4701 N.
Meridian Ave., for $75 million
in 2000, and is now trying to
sell it. Residents in the sur-
rounding mid-Beach neigh-
borhood are concerned the
hospital may sell the property
to a developer or another
company that might build
high-rise condos there.
Mayor David Dermer, who
has been a strong proponent
of reierendums during his 10
years in office, blasted Cruz
for rushing the park bond
issue to the ballot.
The voting showed the
division, with Dermer, Saul
Gross and Malli Herrera
Bower voting against the park
referendum favored by Cruz,
Jerry Libbin, Michael
Gongora and Richard Stein-
berg.
Cruz and Bower are candi-
dates in the race to replace
Dermer, who faces term lim-
its, in the Nov. 6 election.

Chambers, 18070 Collins Avenue, Sunny Isles Beach, Florida, on Thursday, September 20, 2007, at
7:30 p.m., to consider final adoption ot the following proposed Ordinance:

Weddings and Special Events on the Beach Guidelines Authorization
At its regular meeting of September 20, 2007, the City Commission adopted Ordinance No.
2007-286, which authorized the City Manager to establish guidelines for weddings and special
