HomeMy WebLinkAboutOrdinance 2007-288 I I I ORDINANCE NO. 2007- 265 I AN ORDINANCE OF THE CITY COMMISSION OF I THE CITY OF SU~NY ISLES BEACH, FLORIDA, AMENDING SECTION 265-11 OF THE CITY CODE TO REQUIRE SITE PdAN REVIEW FOR CHARTER SCHOOLS AND I PRIV A TE EDUCATIONAL FACILITIES WITH A STUDENT POPULATION OVER I 40 STUDENTS OR MORE; PROVIDING FOR I SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING FOR I INCLUSION IN THE CODE; PROVIDING FOR ANI EFFECTIVE DATE. WHEREAS, the City Commission has found it necessary for the purpose of protecting the public health, safety and general w~lfare to require site plan review for Charter Schools and Private Educational Facilities; and WHEREAS, Site Plan Review rill provide a process that will ensure the proper location of Charter Schools and Private Educational Facilities; and WHEREAS, the City commJion wishes to adopt this amended ordinance [0 regulate impacts of certain uses. NOW THEREFORE, BE IT ([)RDAINED BY THE CITY COMMISSION OF THE I CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of RecitaJ The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correJ:t and are hereby made a specific part by this ordinance upon hereof. Section 2. Amendment to Section 265-11. Section 265-11 of the City Code IS hereby amended to read as follows: I ~265-11. Procedures of General ApplicAbility. I I O. Zoning clearance shall be required for all buildings and structures hereinafter erected, constructed, altered, or repaire:d within any zoning district established by the Land Development Regulations, and for the use of vacant land or for a change in the character of the use of land within the di~trict established by the Land Development Regulations. No building permit shall be issu~d until a zoning clearance memorandum has been issued I by the Director of Planning and Zoning or designee. I P. Charter Schools/Private Educational Facilities. Notwithstanding any other provision in the City Code, Charter Schools dr Private Educational Facilities with a student population of 40 or more students shall b~ required to submit a site plan for a public hearing in accordance with the provisions bf Section 265-11 of this Article. For the purpose of this I subsection, a charter school shall mean an educational institution which is authorized and I maintained in accordance with the provisions of Chapter 1002, Florida Statutes, as same Public Charter School Ord. For the purpose of this subsection, a private I educational facility is an educational facility which is not considered a public school or a I charter school or a day care facility under state law. Development approval may be issued administratively for Charter Sthools or Private Educational Facilities with a student population of 39 students or les~, except where the City Manager or designee has decided that the review of the City Comfuission is required. Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrasb of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decisibn shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this! Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 4. Repealer. Any and alii ordinances, resolutions and parts of ordinances or resolutions in conflict with this Ordinarlce are hereby repealed insofar as they are inconsistent or in conflict herewith. Section 5. Inclusion in the Code. It is the intention of the Commission, and it is hereby ordained, that the provisions of this ordinance shall be included in the City of Sunny Isles Beach Code; that the sections of this ordinante may be renumbered or relettered to accomplish such intentions; and that the word "ordinarlce" shall be changed to "section" or other appropriate word, as required. Section 6. Effective Date. This Ordinance shall be effective ten (10) days after adoption on second reading. PASSED and ADOPTED on first reading the ;{O~day of S~ 2007.
