HomeMy WebLinkAboutOrdinance 2008-296 ORDINANCE NO. 2008 - ~ 9 i.., AN ORDINANCE OF THE CITY OF THE SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 265-47 OF THE CITY CODE RELATING TO DRIVEWAY ST ANDARDS; PROVIDING FOR SEVERABILITY;, PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR REPEALER; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 265-47 of the City of Sunny Isles Beach, Florida (the "City") Code provides for driveway standards under the City's zoning code. WHEREAS, Section 265-47(0) regulates the minimum size requirements for driveways for single-family and duplex structures in all residentially zoned districts; and WHEREAS, Section 265-47(0) further provides that such driveways shall have a minimum width of 18 feet and a minimum length of 20 feet providing that such 20 feet shall be clear of sidewalks and roadway easements within the confines of the subject parcel; and that driveways for three-car garages shall have a minimum width of 26 feet; and WHEREAS, Section 265-47(0) should be amended to state that any additional driveway constructed pursuant to this section shall be required to have a minimum width of 12 feet; and WHEREAS, the City Commission finds that this Ordinance amending Section 265-47 of the City Code will improve the driveway standards for single family and duplex structures located in the City's residentially zoned districts. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Section 265-47 of the City Code pertaining to driveway standards is hereby amended by adding the following underscored words and deleting those stricken through, to read as follows: ~ 265-47. Driveway standards O. Minimum size. Primary driveways Driveways for single-family and duplex structures in all residentially zoned districts shall have a minimum width of 18 feet and a minimum length of 20 feet providing that such 20 feet shall be clear of sidewalks and roadway easements within the confines of the subject parcel unless otherwise specified in these regulations. Driveways for three-car garages shall have a minimum width of 26 feet. In the event a second driveway is installed to a single family or duplex structures, the secondary driveway shall be required to have a minimum width of 12 feet and must Ordinance amending Section 265-47 of the City Code - I - meet all other driveway standards. The required minimum width for a circular driveway is 10 feet. The minimum setback of driveways installed pursuant to this section is 5 feet from the side property lines. A parking pad for recreational vehicle storage maybe installed contiguous to an approved driveway provided that an enclosure is installed around the recreational vehicle to obstruct a view of the vehicle from the rights-of-way or any adioining property. Driveways shall not be used for the parking or storage of any trailer. camper. motor home. boat or any other equipment at any time unless permitted under this Code. Recreational vehicles may be parked on a parking pad in the rear yard or in the side yard to the rear of a line established by the front building line furtherest from the street. A driveway does not constitute a structure for the purpose of this section. Section 2. Severability. The provisions ofthis Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 3. Inclusion in the Code. It is the intention of the Commission, and it is hereby ordained, that the provisions of this ordinance shall become and be made a part of the code of the City of Sunny Isles Beach, Florida; and that the sections of this ordinance may be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be changed to "section" or other appropriate word, as required. Section 4. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed. Section 5. Effective Date. RECOMMENDA TION It is recommended that the City Commission approve the attached Ordinance relating to signs. REASONS After reviewing Code Section 265-47(0), it's the Departments OpInIOn that a reVISIOn and clarification of the Section is required. As such the Department is proposing the attached Ordinance that will clarify the need for any additional or secondary driveway to provided a minimum of 12' -0" in width and meet all driveway standards. It also clarifies the section in reference to circular driveways and provides for a minimum width of 10'-0" and a minimum setback of 5' -0" from the subject property line for all primary and secondary driveways. In addition the section includes language to assure that all recreational vehicles such as boats, jet skies and others be located in the rear yard or in the side yard to rear of the a line established by the front building line furthest from the street with an enclosure installed around the subject area to obstruct the view of the vehicle from the rights-of-ways. It further clarifies that parking pads located behind the front building line are not to be construed as driveways for the purpose of this Ordinance, and that they may be installed contiguous to an approved driveway with approved permits from the Building Department.
