HomeMy WebLinkAboutOrdinance 2008-297 ORDINANCE NO. 2008 - "2. 91 AN ORDINANCE OF THE CITY OF THE SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 265-45(E) OF THE CITY CODE RELATING TO FENCES AND WALLS; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR REPEALER; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 265-45 of the City of Sunny Isles Beach, Florida (the "City") Code regulates structures in a required yard or buffer yard area; and WHEREAS, Section 265-45.E.(2) specifically regulates the height and appearance of fences and walls on a residential lot; and WHEREAS, Section 265-45.E.(2) provides that fences on a residential lot shall be limited to six feet in height, with fences and walls being limited to four feet in height within a required front yard; and WHEREAS, Section 265-45.E.(2) should be amended to increase the total permissible height of a front yard fence or wall from four feet to six feet, with the increased height to be permitted to decorative railings; and WHEREAS, the City Commission finds that this Ordinance amending Section 265-45 of the City Code will improve the form, function and aesthetics of fencing or walls located in the City's residential lots. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Section 265-45 of the City Code pertaining to fences and walls in residential lots is hereby amended, by adding the following underscored words and deleting those stricken through, to read as follows: ~ 265-45. Accessory uses. E. Fences and walls. (2) Fences on residential lots. Fences on a residential lot shall be limited to six feet in height. Barbed wire and other similar material shall not be permitted on a fence or wall within a residential district. Fences and walls shall be limited to four feet in height within a required front yard. except that fences with decorative railings shall be limited to six feet in height. Such railings shall be a minimum of six inches apart and shall not obstruct Ordinance amending Section 265-45(E) of the City Code - I - the view from the rights-of-way. In all zoning districts, only pressure treated pine, redwood and cedar wood shall be acceptable for wood fence construction. All wood fencing shall have a nominal thickness of one inch. Each side of a concrete block or masonry wall shall be completely finished with stucco and/or paint. Section 2. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 3. Inclusion in the Code. It is the intention of the Commission, and it is hereby ordained, that the provisions of this ordinance shall become and be made a part of the code of the City of Sunny Isles Beach, Florida; and that the sections of this ordinance may be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be changed to "section" or other appropriate word, as required. Section 4. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed. Section 5. Effective Date. J December 13, 2007 Fences and Walls RECOMMENDATION It is recommended that the City Commission approved the attach resolution for a modification to Section 265-45 of the Code of Sunny Isles Beach, specifically as it regulates fence and wall height in the single family residential district. REASONS Under Section 265-45 E(2) regulates the height and appearance of fences and walls on single family residential lots. The Code requires that fences or walls be limited to 6 feet in height from the building line to the rear of the property and limiting the fence or wall height in the front yard area to 4 feet in height. The intent of the Code was to allow protection for the residences along the front yard and also permit visibility into the lot from the right of way. An exception to the height requirement for fences on the front yard should be made when a property owner wishes to place decorative fencing that may reach up to 6 feet in height in the front yard. These decorative fences do not obstruct the visibility of the front yard from the right of way. As more and more new single family residences are constructed in the City, the use of the decorative fences in the front yard will increase.
