HomeMy WebLinkAboutOrdinance 2008-305 ORDINANCE NO. 2008-.3Q5 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTIONS 256-12, 256-14, 256-17 OF THE VEHICLES AND TRAFFIC CODE TO ESTABLISH NEW PARKING RATES FOR RESIDENTIAL PARKING AREAS AND TO PERMIT PARKING ON A 24-HOUR BASIS; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission has a desire to provide a location for residents to park their commercial/recreational equipment; and WHEREAS, the City Commission wishes to amend the vehicle and traffic code to establish new parking rates. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof. Section 2. follows: Amendment. Section 256 of the Vehicles and Traffic is amended to read as ~ 256-12. Hours permits are valid. A. A monthly permit/decal holder shall have the right to park their vehicle(s) during the Regular business days, excluding weekends, from 6:00 a.m. to 6:00 p.m. B. An annual resident only parking permit/decal holder shall have the right to park their vehicle(s) within designated resident only parking areas from 6:00 a.m. to 6:00 JT.ffi.24 hours a day unless otherwise posted on official signage. If the official signage extends or reduces the permissible hours, the permit/decal holder shall abide by the posted hours. C. Overnight/nighttime parking is strictly prohibited in all resident only parking areas. C Nighttime parking is permitted with a special nighttime permit/decal from 6:00 p.m. to 6:00 a.m. (7) days a week in designated areas. The parking meter rates at the Ellen Wynne Beach Access and the William Lehman Overpass (Center Island) parking lots shall be $2 for each hour, with a minimum purchase of one hour and a maximum of 12 hours. B. The parking meter rates at the Pier Park, under the William Lehman Bridge, and at the Bella Vista Bay Park parking lots shall be as follows: (I) Flat rate fee of $6 during weekday hours, with a maximum purchase of 12 hours. Weekdays shall begin at 12:00 midnight on Monday and terminate at 11 :59 p.m. on the Friday that immediately follows. (2) Flat rate of $1 0 per day on weekends and City-observed holidays, with a maximum of 12 hours. Weekends shall begin at 12:00 midnight on Saturday and end at 11 :59 p.m. on Sunday. C. The annual rate for Resident Only Parking Permits/Decals shall be fifty ($50.00) Seventy Five Dollars ($75.00) per month. Fee may be reviewed by the City Manager or his/her designee every two years. and may be increased if necessary. D. The parking rate for resident only commercial/recreational equipment parking under the William Lehman Bridge designated area is as follows. and fee may be reviewed by the City Manager or his/her designee every two years. and may be increased if necessary: TVDe of Fee Amount of the Fee Comments Application Fee $75.00 annually (fiscal year) Administrative Fee Per vehicle fee $2.50 per foot length of vehicle Transfer Fee $25.00 per permit ~ 256-17. Penalties for offenses. A. The regulations herein are created in supplementation of an in addition to Chapter 30 of the Miami-Dade County Code (entitled "Dade County Traffic Code") as adopted, and Florida State Statute Chapter 316 (entitled "State Uniform Traffic Control"). The penalties as enumerated therein shall remain in full force and effect. B. A general penalty in the amount of $-l-W $250 for each violation shall apply to all violations of this article not specifically enumerated in Chapter 30 as adopted. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 6. Inclusion in the Code. It is the intention of the Commission, and it is hereby ordained, that the provisions of this Ordinance shall become and be made a part of the code of the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be changed to "section" or other appropriate word, as required. Section 7. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed. Section 8. Effective Date. This Ordinance shall be effective ten (10) days after adoption on second reading. Solera, Community Development Director June 19,2008 Amendment to Section 256 Vehicles and Traffic RECOMMENDATION: It is recommended that the City Commission approves the attached Ordinance amending the Vehicles and Traffic Section REASONS: The Community Development Department in response to requests from residents, is proposing an amendment to the existing Code that would allow the parking of Commercial vehicles / Recreational equipment under the William Lehman Bridge with the following payment schedule: Tvpe of Fee Amount of the Fee Comments Aoolication Fee $75.00 annually (fiscal year) Administrative Fee Per vehicle fee oer month $2.50 ner foot lenQth of vehicle Transfer Fee $25.00 per permit Resident only Parking Permit $50.00 per month This benefit will provide a relief for those citizens with this type of equipment, since various associations do not allow the parking of these vehicles within their premises. The Department will also like to increase the penalty fee for violation of any section of this Ordinance. The attached amended Ordinance was revised at first reading by reducing the monthly fee for a Resident Only Parking Permit from $75.00 to $50.00.
