ORDINANCE NO. 2008--313
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AMENDING
SECTIONS 14-8 AND 14-10 OF THE CITY CODE RELATING
TO THE IMPOSITION AND COLLECTION OF CIVIL
PENALTIES IN CODE ENFORCEMENT CASES; PROVIDING
FOR REPEALER; PROVIDING FOR SEVERABILITY;
PROVIDING FOR INCLUSION IN THE CODE; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission has the authority to amend its code provISIOns
pursuant to Section C-4.3 of the City Charter; and
WHEREAS, the City Commission wishes to amend Section 14-8 paragraph "H" of the
Code of the City of Sunny Isles Beach to clarify that civil penalties assessed by the Special
Master shall become delinquent if not paid within 10 (ten) days after notice to the violator of the
Special Master's decision itemizing the civil penalties; and
WHEREAS, the City Commission wishes to amend Section 14-10 paragraphs "M" and
"0" of the City Code to affirm the City's intent to recover its administrative costs in the amount
of $75, and limit any mitigation of civil penalties assessed to no less than 50% of the total amount
of civil penalty.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified
and confirmed as being true and correct and are hereby made a speci fic part by this Ordinance
upon adoption hereof.
Section 2.

Amendment. Sections 14-8 and 14-10 of the City Code are amended to read as
~ 14-8. Civil penalties; continued and repeat violations.
H. Civil penalties assessed pursuant to this chapter by the Special Master are due and
payable to the City at the close of the hearing and shall become delinquent if not paid
within 10 (ten) days after notice to the violator of the Special Master's decision itemizing
the civil penalties. er,-i.f If a proper appeal of the Special Master's decision is made, the
civil penalties assessed pursuant to this chapter by the Special Master are due and payable
to the City when the appeal has been finally decided adversely against the named violator.

~ 14-10. Scheduling and conduct of hearing.
M. If the named violator is found guilty of the violation, s/he shall be held liable for the
reasonable cost of the administrative hearing cost, at the discretion of the Special Master,
of no less than $75.
N. The fact finding determination of the Special Master shall be limited to whether or not the
violation alleged occurred, and, if so, whether the person named in the civil violation
notice may be held responsible for that violation. Based upon this fact finding
determination, the Special Master shall either affirm or reverse the decision of the Code
Enforcement Officer. If the Special Master reverses the decision of the Code
Enforcement Officer and finds the named violator not responsible for the Code violation
in the alleged civil violation notice because the department did not present substantial
competent evidence to indicate that such violator is responsible for the violation, then,
and in that case, the named violator shall not be liable for the payment of any civil
penalty, absent reversal of the Special Master's findings pursuant to any circuit court
appeals.
O. The decision of the Special Master affirming the decision of the Code Enforcement
Officer shall include the following elements:
(1) Amount of civil penalty.
(a) Prescribed in the schedulea of civil penalties as adopted herein.
(b) Gravity of the violation.
(c) Actions taken to correct said violation.
(d) Any previous violations committed by the violator of a similar nature.
(e) The Special Master may reduce the fine amount imposed. mitigate the
amount of civil penalties assessed in an amount up to but not in excess of
fifty percent (50%) of the total amount of civil penalty, not including
administrative costs. Provided however, in no case shall mitigation occur
prior to satisfactory correction of the violation or other permanent
disposition of the building or property that obviates the need for correction.
The administrative costs of the hearing shall not be subiect to mitigation at
any time.
(2) Administrative costs of the hearing, which shall represent the costs incurred by the
City in preparation for the specific hearing, shall be no less than $75.
(3) Date by which the violation must be corrected to prevent resumption of continuing
violation penalties, if any.

Section 3. Severability. The provisions of this Ordinance are declared to be severable and if
any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid
or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby
ordained, that the provisions of this Ordinance shall become and be made a part of the code of the
City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or
relettered to accomplish such intentions; and that the word "ordinance" shall be changed to
"section" or other appropriate word, as required.
Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the
same are hereby repealed.
Section 6. Effective Date. This Ordinance shall be effective ten (10) days after adoption on
second reading.

Revision to Chapter 14 of the City Code (Code Enforcement)
RECOMMENDATION:
It is recommended that the City Commission approve the attached revised Code Enforcement
Ordinance.
REASON (S):
The Code Enforcement and Licensing Department is requesting a revision of Chapter 14, better
known as the Code Enforcement Chapter. The Department is amending Section 14-8 (H) to
reflect that civil penalties assessed by the Special Master shall become delinquent if not paid
within 10 days after notice to the violator of the Special Master decision. The ordinance was
revised in 2006 but Section 14-10 (M) was not amended to provide discretion to the Special
Master to reduce the administrative fees below the amount of $75.00. As the ordinance currently
reads the Special Master has the ability to reduce or basically waive the amount. This fee will
offset the expense incurred in the preparation of cases to be heard by the Special Master. The
Department is also looking to amend Section 14-10 (0) (1 e) to require the Special Master not to
go below 50% of the amount of the civil violation, if the violator is found guilty by the Special
Master.
The Special Master's decision does not affect the City Manager's office to enter into negotiations
for payment of outstanding fines due to imposition of lien on properties that have accumulated
subsequent to final decision of the Special Master. Request for negotiations for payments on the
process for imposed lien will be handled by the City Manager's office.
