Home My WebLink AboutOrdinance 2009-322 ORDINANCE NO. 2009- 32~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 26-6 OF THE CITY CODE TO REVISE THE QUALIFYING PERIOD DATES OF THE GENERAL ELECTION FOR THE OFFICE OF MAYOR OR CITY COMMISSIONER; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CITY CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 26-6 of the City Code provides that candidates for the office of Malor or City Commissioner shall qualify with the City Clerk no earlier than 9:00 a.m. on the 63r day and no later than 4:00 p.m. on the 60th day prior to the date of the general election; and WHEREAS, the Miami-Dade Elections Department has requested that the City modify the dates for candidate qualifying to no earlier than the 76th day and no later than the 73rd day prior to the date of the general election; and WHEREAS, with the transition to a paper-based voting system, the State deadlines for several election processes have been moved up; and WHEREAS, Florida Statutes 101.62(4)(a), provides that absentee ballots must be mailed to overseas voters 45 days before a general election, and this new qualifying period would provide the Elections Department sufficient time to prepare, print, and mail absentee ballots to overseas voters by the statutory deadlines; and WHEREAS, this change would benefit the City and the Elections Department m providing a more efficient and smooth election; and WHEREAS, the City Commission wishes to change the City's dates for candidate qualifying pursuant to the request made by the County's Election Department NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISISON OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Recitals adopted. That each of the recitals stated above is hereby adopted and confirmed. Section 2. Amendment. Section 26-6 of the City Code of the City of Sunny Isles Beach is hereby amended to read as follows: Section 26-6. Qualifying as Candidate for Mayor or City Commissioner; Fee; Oath; Single Candidate Considered Elected. Candidates for the office of Mayor or City Commissioner shall qualify with the City Clerk no earlier than 9:00 a.m. on the 76th @f6 day and no later than 4:00 p.m. on the 73rd 6{)tfl day prior to the date of the general election. 02009- Amend Section 26 Qualifying Period Page 1 of2 Section 3. Repealer. All ordinances or parts of ordinances in conflict herewith be, and the same, are hereby repealed. Section 4. Severability. If any section, sentence, clause or phrase of this ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this ordinance. Section 5. Inclusion in the Code. It is the intention of the Mayor and City Commission of the City of Sunny Isles Beach, and it is hereby ordained that the provisions of this ordinance shall become and be made a part of the Code of the City of Sunny Isles Beach, Florida. The sections of this ordinance may be renumbered or re-Iettered to accomplish such intention, and the word "ordinance" may be changed to "section", "article", or other appropriate word. Section 6. The Miami-Dade Elections Department has requested that the City modify the dates for candidate qualifying to no earlier than the 76th day and no later than the 73rd day prior to the date of the general election. The City's next General Election takes place on November 2, 2010, and with this change in the qualifying period, the dates would be from 9:00 a.m. on Tuesday, August 17 to 4:00 p.m. on Friday, August 20, 2010. With the transition to a paper-based voting system, the state deadlines for several election processes have been moved up. For instance, per Florida Statutes 1 01.62(4)(a), absentee ballots must be mailed to overseas voters 45 days before a general election. For the November 2, 2010 Sunny Isles Beach General Election, absentee ballots to overseas voters would have to be mailed to later than September 18, 2010. The qualifying dates for the 2010 General Election are currently scheduled to end on September 3, 2010. Unfortunately, this date will not give the Department sufficient time to prepare, print, and mail absentee ballots to overseas voters by the statutory deadlines. Given these constraints, it is imperative that the Elections Department receives all resolutions, candidate loyalty oaths, and any other documentation necessary to prepare the 2010 General Election ballot by August 20, 2010. It is respectfully requested that your board consider moving your qualifying dates, so that qualifying ends by our August 20,2010 deadline. Your prompt reply to this request is greatly appreciated.
