ORDINANCE NO. 2009-.331
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER
233 OF THE CITY CODE TO REVISE FEES FOR SPECIAL
EVENTS ON PRIVATE AND PUBLIC PROPERTIES;
PROVIDING FOR REPEALER; PROVIDING FOR INCLUSION
IN THE CODE; PROVIDING FOR SEVERABILITY; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, Special Events have forced the City to utilize vital resources to protect the
public safety; and
WHEREAS, the Special Events Ordinance IS In need of revision to accommodate
changing circumstances.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified
and confirmed as being true and correct and are hereby made a specific part by this Ordinance
upon adoption hereof.
Section 2.
Amendment. Chapter 233 of the City Code is amended to read as follows:
~ 233-3. Fees
A.
The City Manager or designee may impose such fees as he determines appropriate considering
the impact of the special event on the City facilities and services, including without limitation,
user fees for particular City properties, rates for exclusive use of public property, and concession
agreements for paid admissions, and sale of food, beverage and merchandise on public property.
The City Manager may, at his discretion, reduce or waive the submission periods or fees for
events by not-for-profit corporations, for a particular event when such waiver is found to be in
the best interest of the City.
B.
Fees established.
(1)
The following fee schedule shall apply for all special event permit applications:

There shall be no refunds for any special event permit applications. An administrative fee of
$15.00 shall be added for any revised special event permit application. The above-listed fees
shall be reviewed by the City Manager or his designee on an annual basis. The provisions of this
chapter shall not apply to informal gatherings of less than twenty-five (25) people where the
public area has not been specifically reserved.
& 233-7. Co-ordination with City Police Department.
For the safety of participants, volunteers, etc., police may be necessary for your special event. A
police presence may be required at any event where alcoholic beverages are served or at any
other location deemed necessary by the special event police liaison to maintain order and protect
persons and property. All special event permit applicants are required to coordinate scheduling
of the special event in advance with the City of Sunny Isles Beach Police Department.

If a private security firm or individuals associated with the event are acting as security guards.
the event promoter shall indicate that in the special event application. The police liaison will
also coordinate with each promoter how many security guards the promoter will need to hire for
street closure and other responsibilities. All race/walks will be required to hire security guards in
order to help close the roads and monitor street closings.
The cost for providing off-duty police services will vary based on whether the event is a City
sponsored event or a privately sponsored event. For privately sponsored events. the applicant
will contact the police department and speak to the special event police liaison. The liaison will
determine the number of officers needed and provide the applicant with an off-duty police detail
contract which must be completed and turned in as quickly as possible. The estimated fee for
off-duty police services will be determined when the special events police liaison receives a
finalized site map. Payments will be billed according to the off-duty police detail contract.
~ 233-8. Indemnification.
Before issuing a special event permit. the permit applicant and authorized officer of the
sponsoring organization, if any. must sign an agreement to defend the City against. and
indemnify and hold harmless the City. its officers. employees and agents. where such claim
arises in whole or in part out of the activities for which such permit is issued: except any claims
arising solely out of the negligent acts or omissions of the City. its officers. employees or agents.
~ 233-9. Insurance.
Before issuing a special event permit. the City Manager may require each applicant to file with
the City Manager a certificate of insurance showing the maintenance of insurance in an amount
appropriate to cover the liability of the permitee for property damage and iniuries to persons in
connection with the activities done in accordance with the special event permit.
~ 233-10. Cleanup deposits for events on public property.
A. Required for certain special events. The applicant/sponsor of an event on public property
may be required to provide a cleanup deposit prior to the issuance of a special event permit. In
addition to a $150 nonrefundable cleanup inspection fee. the following cleanup deposit fees are
required: (1) 0 to 100 people the fee shall be $350 (2) 101 to 499 people the fee shall be $450
and (3) 500 plus people the fee shall be $500. The cleanup deposits are refundable.
B. Refunds and overruns. The cleanup deposit shall be returned after the event if the area used
for the permitted event has been cleaned and restored to the same condition as existed prior to the
event. If the property used for the event has not been properly cleaned or restored. the
applicant/sponsor shall be billed for the actual cost by the City for cleanup and restoration. The
cleanup deposit shall be applied toward the payment of the bill.

Section 3. Severability. The provisions of this Ordinance are declared to be severable and if
any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid
or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby
ordained, that the provisions of this Ordinance shall become and be made a part of the code of the
City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or
relettered to accomplish such intentions; and that the word "ordinance" shall be changed to
"section" or other appropriate word, as required.
Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the
same are hereby repealed.
Section 6. Effective Date. This Ordinance shall be effective ten (10) days after adoption on
second reading.

Amendment to Special Events Ordinance
RECOMMENDA TION:
This Ordinance is presented for your consideration.
REASONS:
Several years ago, the City Commission adopted the Special Events Ordinance to
alleviate the negative impacts of large gatherings in the City. After consulting with the
Police Department, staff has proposed several amendments to the Special Events
Ordinance to mitigate negative impacts. Staff is proposing the following amendments to
the Special Events Ordinance: (1) Coordination requirements with the Police
Department; (2) Hold harmless and insurance requirements; and (3) new fees for special
events on private and public property.
By adopting this Ordinance, the City Commission will provide staff the necessary tools
to protect the public.
