HomeMy WebLinkAboutOrdinance 2009-340 ORDINANCE NO. 2009-~D AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 212 OF THE CITY CODE RELATING TO CONSTRUCTION SITE MAINTENANCE STANDARDS; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR REPEALER; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of Sunny Isles Beach finds that construction cranes located in construction areas with no construction activity for 30 (thirty) days or more creates a public nuisance; and WHEREAS, this public nuisance condition is detrimental to the public peace, welfare and safety of the residents of the City of Sunny Isles Beach. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof. Section 2. Amendment. Section 212-4 of the City of Sunny Isles Beach Code of Ordinances is amended to read as follows: ~ 212-4. Property maintenance. D. It shall be the joint responsibility ofthe owner of any property upon which construction is occurring and any contractor responsible for said construction to ensure that all construction materials, waste and trash are contained upon the property. ill In the event that the Building Official or designee determines that there is no construction activity occurring on a construction site for a period of 30 (thirty) or more consecutive days and there is a construction crane located on said construction site, then the owner( s) of said property and the contractor responsible for operation and/or maintenance of the construction crane shall be iointly responsible for removing the construction crane from the property no later than 15 (fifteen) days following written notice from the City of Sunny Isles Beach. Removal of the crane is not necessary if construction activity does not occur due to an act of God. Words added underlined, words stmken deleted (ed) Page I of3 In the event the construction crane is not removed from the property within this time period, then the owner( s) of said property and the contractor responsible for operation and/or maintenance of the construction crane shall be iointly responsible for a civil penalty in the amount of $1.000.00 (one thousand dollars) per day for each day beyond the 15 (fifteen) day compliance period. Additionally, in such an event. the contractor responsible for operation and/or maintenance of the construction crane may be prohibited from operating their business in the City for a period of up to 1 (one) year for failure to remove the crane on a timely basis. Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby ordained, that the provisions of this Ordinance shall become and be made a part of the code of the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be changed to "section" or other appropriate word, as required. Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed. Section 6. Effective Date. REASONS: The crash of the real estate market has forced developers to abandon certain development projects in the City. The abandonment of development projects have caused several properties to become vacant construction sites. These construction sites have become a public nuisance due to the fact that construction machinery like construction cranes has not been removed from the site. These unused construction cranes pose a danger to the community because the City is located in a high hazard area. Removal of the construction cranes is necessary to protect the public. Staff has requested property owners to remove construction cranes that are located on sites where there is no construction activity. Unfortunately, staffs request has not been acted upon in a diligent manner. To facilitate the removal of such cranes, staff believes the attached ordinance is necessary. This ordinance requires the removal of construction cranes if the Building Official determines that removal is required because of no construction activity.
