ORDINANCE NO. 2010-~
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION
265-11(K) OF THE LAND DEVELOPMENT REGULATIONS;
AND AMENDING SECTION 265-18(C) OF THE LAND
DEVELOPMENT REGULATIONS TO PROVIDE FOR
ADMINISTRA TIVE APPROVAL OF CERTAIN SITE PLANS;
PROVIDING FOR REPEALER; PROVIDING FOR
SEVERABILITY; PROVIDING FOR INCLUSION IN THE
CODE; PROVIDING FOR AN EFFECTIVE DATE AND
APPLICABILITY.
WHEREAS, the City has traditionally used the administrative site plan approval process
to approve site plans for governmental facilities since its incorporation; and
WHEREAS, the administrative site plan approval process was incorporated into the City
Code when the City utilized the Code of Miami-Dade County as its Code; and
WHEREAS, the administrative site plan approval process was inadvertently removed
through amendments of the Land Development Regulations; and
WHEREAS, the City Commission wishes to reaffirm and reestablish the administrative
approval of site plans for governmental facilities.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified
and confirmed as being true and correct and are hereby made a specific part by this Ordinance
upon adoption hereof.
Section 2.

Amendment. Section 265-11 and 265-18 of the City Code is amended to read as
~ 265-11 Development Review Procedures.
K. Quasi-judicial proceedings. The following applications are quasi-judicial and shall
comply with the City's quasi-judicial legislation:
(1) Site specific rezoning.
(2) Conditional use applications.
(3) Variances.
(4) Development of regional impact.
(5) Plats.

(6) Site plans, except site plans for government facilities exempted pursuant to
Section 265-18C (7). .
~ 265-18 Administrative site plan review.
C. Exempt development. The following activities shall not require submission of a site plan
pursuant to this section:
(1) The deposit and contouring of fill on land.
(2) Construction of a single-family home on an existing single-family lot.
(3) Construction of a single residential duplex on an existing residential duplex lot.
(4) Land clearing activity done in compliance with a valid land-clearing permit issued
pursuant to the LDR and a City engineering permit.
(5) Demolition.
(6) Storage sheds on single-family residential lots, gazebos and tiki huts provided all
other requirements of these LDRs are met.
(7) Site plans for Government Agency facilities that are consistent with the
development standards of the zoning district. including any such Government
Agency facility constructed or permitted after December 19.2002.
Section 3. Severability. The provisions of this Ordinance are declared to be severable and if
any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid
or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby
ordained, that the provisions of this Ordinance shall become and be made a part of the code of the
City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or
relettered to accomplish such intentions; and that the word "ordinance" shall be changed to
"section" or other appropriate word, as required.
Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the
same are hereby repealed.
Section 6. Effective Date and Applicability. This Ordinance shall be effective upon adoption
on second reading.

Administrative Site Plan Review
RECOMMENDATION:
This Ordinance is presented for your consideration.
REASONS:
The City has historically used the administrative site plan process to approve government
facilities which are consistent with the development standards of the underlying zoning
districts. The administrative site plan approval process is a process that the City inherited
from Miami-Dade County. The City had at one time used the aforementioned process for
all site plans that were consistent with the development standards of the underlying
zoning. However, the Land Development Regulations were amended to require City
Commission approval for site plans submitted by private developers. In amending the
Land Development Regulations, the City had inadvertently removed the historical
administrative approval process for site plans submitted for government facilities that are
consistent with the standards of the zoning district. In order to reaffirm and reinstate the
administrative site approval process for government facilities, staff is requesting approval
of the attached Ordinance. The Ordinance basically provides for administrative approval
of site plans for government facilities provided that the site plan is consistent with the
development standards of the zoning district. Since the City has historically approved
administratively site plans for government agency facilities, this Ordinance shall apply to
all government facilities constructed or permitted after December 19, 2002.
