HomeMy WebLinkAboutReso 2009-1502 ~ RESOLUTION NO. 2009- J 5D 2J A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE FIRST ADDENDUM TO THE AGREEMENT WITH MARLIN ENGINEERING, INC. TO PROVIDE CONSUL TING CIVIL ENGINEERING SERVICES FOR THE ARCHITECTURAL/ STRUCTURAL DESIGN OF THE REST AURANT, ARCHITECTURAL SERVICES, MECHANICAL, LIGHTING AND PLUMBING DESIGN SERVICES FOR THE NEWPORT FISHING PIER, IN AN AMOUNT NOT TO EXCEED SIXTY-FIVE THOUSAND DOLLARS ($65,000.00), A TT ACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE SAID ADDENDUM TO AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THE AGREEMENT; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on January 17, 2008, the City Commission adopted Resolution No. 2008- 1198 approving an agreement with Marlin Engineering, Inc., in an amount of Four Hundred Forty-One Thousand Three Hundred Three Dollars ($441,303.00), to provide civil engineering services for the design, specification, and permitting documents for the demolition and reconstruction of the Sunny Isles Beach/Newport Fishing Pier; and WHEREAS, the City wishes for the Consultant to provide additional services by providing consulting civil engineering services for the architectural/structural design of the restaurant, architectural services, mechanical, lighting and plumbing design services for the Newport Fishing Pier; and WHEREAS, Marlin Engineering, Inc. has submitted a proposal to provide design parameters of the restaurant to accommodate a building of approximately 5,000 square feet, in an amount of Twenty-Five Thousand Dollars ($25,000.00), and to modify the existing plans of the pier in order to adjust the pier and restaurant dimensions to be that of the existing pier, in an amount not to exceed Forty Thousand Dollars ($40,000.00). WHEREAS, the City wishes to accept the proposal from Marlin Engineering, Inc., modifying the agreement to include this work, in a total amount not to exceed Sixty-Five Thousand Dollars ($65,000.00), for a total contract amount of Five Hundred Six Thousand Three Hundred Three Dollars ($506,303.00), attached hereto as Exhibit "A". WHEREAS, the City Commission wishes to amend the Agreement with Marlin Engineering, Inc. for the provision of said services, attached hereto as Attachment "A". NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. Approval of First Addendum to the Agreement. The First Addendum to the Agreement with Marlin Engineering, Inc., attached hereto as Exhibit "A", be and the same, in an amount not to exceed Sixty-Five Thousand Dollars ($65,000.00), for a total contract amount not to exceed Five Hundred Six Thousand Three Hundred Three Dollars ($506,303.00), is hereby approved. Section 3. Authorization of Mayor. The Mayor IS hereby authorized to execute said Addendum to Agreement. Section 4. Authorization of City Manager. The City Manager is hereby authorized to all things necessary to effectuate the terms of the Agreement. Section 5. Effective Date. This Resolution will become effective upon adoption. RECOMMENDA TION: Staff recommends that the City Commission approve the attached resolution. REASONS: The City has been working to receive approval for the re-construction of the pier from the State Department of Environment Protection (DEP). As part of the permit process and comments from DEP the City has had to revise the plans for the proposed restaurant and pier design. The $40,000 portion of this change is to cover those services (a new smaller footprint design and redesign of the T-head). The $25,000 portion of the change was committed to by the City late last year for the work done to begin the expansion to the restaurant. This is the first addendum to the contract with Marlin Engineering. The cost for this work is in an amount not to exceed $65,000. Dr. Cornfeld has agreed to pay half of this change, so the total additional cost to the City will be $32,500. FUNDING SOURCE: Funding for this service comes from account no. 20-600-5670. ADDITIONAL SCOPE OF WORK: The City wishes to add to the original Agreement with the Consultant to provide consulting civil engineering services for the plans design, including engineering specification and permitting documents for the demolition and reconstruction of the Newport Fishing Pier ("Services"), as more fully described in Attachment "A", attached hereto and made a part hereof. 2. COST: The Contractor agrees to charge an amount not to exceed Sixty-Five Thousand Dollars ($65,000.00) for said Services, bringing the total amount not to exceed Five Hundred Six Thousand Three Hundred Three Dollars ($506,303.00). 3. TERM: The term of this First Addendum shall begin upon execution by the parties hereto and shall end upon the completion of the Services. 4. OTHER PROVISIONS REMAIN IN EFFECT: Except as specifically modified herein, all terms and conditions of the Original Agreement between the parties, dated January 17,2008 and approved via Resolution No. 2008-1198 shall remain in full force and effect. PROJECT Provide Consulting Civil Engineering Services for the plans design, including Engineering Specification and permitting documents for the demolition and reconstruction of the Newport Fishing Pier. The Newport Fishing Pier is located at Sunny Isles Boulevard and Collins Avenue, and is accessible through Pier Park. The Newport Fishing Pier was built in 1926, and was designated as a historic site in 1982. 2. SCOPE OF WORK A) The original scope for architectural services was based on the replacement of the existing restaurant. The design parameters of the restaurant have changed to accommodate a building of approximately 5000 square feet. This facility can accommodate inside seating as well as outside eating areas. B) The scope of this supplemental is to modify the existing plans of the pier in order to adjust the pier and restaurant dimensions to be that of the existing pier. 3. COMPENSATION FOR PROFESSIONAL SERVICES For the services performed under paragraph 2 Scope of Work, the Client will pay the Engineer a lump sum of A) TWENTY FIVE THOUSAND Dollars ($25,000.00 and B) FORTY THOUSAND Dollars ($40,000.00), and payable monthly in proportion to the services performed, for a total of SIXTY FIVE THOUSAND Dollars.
