HomeMy WebLinkAboutReso 2010-1582 RESOLUTION NO. 2010- , 58~ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE MAYOR TO APPL Y FOR, RECEIVE AND EXPEND ADDITIONAL FUNDING IN THE AMOUNT OF TWO HUNDRED THOUSAND DOLLARS ($200,000.00) FOR THE ENHANCEMENT OF LAW ENFORCEMENT TECHNOLOGY UNDER A COMMUNITY ORIENTED POLICING SERVICES ("COPS") TECHNOLOGY PROGRAM, SPONSORED BY THE UNITED STATES DEPARTMENT OF JUSTICE; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach has an active and growing policing unit that is seeking to protect the health, safety and welfare of its residents; and WHEREAS, the Chief of Police has determined that there is a need for law enforcement technology equipment that will enhance or implement new or current technology within the Police Department; and WHEREAS, the United States Department of Justice has additional funding available in the amount of Two Hundred Thousand Dollars ($200,000.00) under the FY 2010 COPS Technology Program and has invited the City to apply for the additional funding; and WHEREAS, the Police Department intends to use the funding to purchase five (5) automatic tag readers, one (1) advisory radio station, forty-eight (48) defibrillators and one (1) uninterrupted power system for a total cost not to exceed $200,000.00. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Authorization of Mayor. The Mayor is hereby authorized to apply for, receive and expend funds in the amount of Two Hundred Thousand Dollars ($200,000.00) for law enforcement technology equipment under the United States Department of Justice Community Oriented Policing Program (COPS) Technology Program. Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 3. Effective Date. The Office of Community Oriented Policing Services needs to secure your assurance that the applicant will comply with these provisions. If you would like further information about any of these assurances, please contact your state's COPS Grant Program Specialist at 800.421.6770. By the applicant's authorized representative's signature, the applicant assures that it will comply with all legal and administrative requirements that govern the applicant for acceptance and use of federal grant funds. In particular, the applicant assures us that: I. It has been legally and officially authorized by the appropriate governing body (for example, mayor or city council) to apply for this grant and that the persons signing the application and these assurances on its behalf are authorized to do so and to act on its behalf with respect to any issues that may arise during processing of this application. 2. It will comply with the provisions offederallaw, which limit certain political activities of grantee employees whose principal employment is in connection with an activity financed in whole or in part with this grant. These restrictions are set forth in 5 U.S.C. 91501, et seq. 3. It will comply with the minimum wage and maximum hours provisions of the Federal Fair Labor Standards Act, if applicable. 4. It will establish safeguards, if it has not done so already, to prohibit employees from using their positions for a purpose that is, or gives the appearance of being, motivated by a desire for private gain for themselves or others, particularly those with whom they have family, business or other ties. 5. It will give the Department of Justice or the Comptroller General access to and the right to examine records and documents related to the grant. 6. It will comply with all requirements imposed by the Department of Justice as a condition or administrative requirement of the grant, including but not limited to: the requirements of28 CFR Part 66 and 28 CFR Part 70 (governing administrative requirements for grants and cooperative agreements); 2 CFR Part 225 (OMS Circular A-87), 2 CFR 220 (OMS Circular A-21), 2 CFR Part 230 (OMS Circular A-122) and 48 CFR Part 31.000, et seq. (FAR 31) (governing cost principles); OMS Circular A-133 (governing audits) and other applicable OMS circulars; the applicable provisions of the Omnibus Crime Control and Safe Streets Act of 1968, as amended; 28 CFR Part 38.1; the current edition of the COPS Grant Monitoring Standards and Guidelines; the applicable COPS Grant Owner's Manuals; and with all other applicable program requirements, laws, orders, regulations, or circulars. 7. If applicable, it will, to the extent practicable and consistent with applicable law, seek, recruit and hire qualified members of racial and ethnic minority groups and qualified women in order to further effective law enforcement by increasing their ranks within the sworn positions in the agency. 8. It will not, on the ground of race, color, religion, national origin, gender, disability or age, unlawfully exclude any person from participation in, deny the benefits of or employment to any person, or subject any person to discrimination in connection with any programs or activities funded in whole or in part with federal funds. These civil rights requirements are found in the non- discrimination provisions of the Omnibus Crime Control and Safe Streets Act of 1968, as amended (42 U.S.c. 9 3789d); Title VI of the Civil Rights Act of 1964, as amended (42 U.S.C. 9 2000d); the Indian Civil Rights Act (25 U.S.C. 99 1301-1303); Section 504 of the Rehabilitation Act of 1973, as amended (29 U.S.C. 9 794); Title II, Subtitle A of the Americans with Disabilities Act (ADA) (42 U.S.C. 912101, et seq.); the Age Discrimination Act of 1975 (42 U.S.C. 9 610 I, et seq.); and Department ofJustice Non- Discrimination Regulations contained in Title 28, Parts 35 and 42 (subparts C, D, E, G and I) of the Code of Federal Regulations. A. In the event that any court or administrative agency makes a finding of discrimination on grounds of race, color, religion, national origin, gender, disability or age against the applicant after a due process hearing, it agrees to forward a copy of the finding to the Office for Civil Rights, Office of Justice Programs, 810 7th Street, NW, Washington, D.C. 20531. B. If your organization has received an award for $500,000 or more and has 50 or more employees, then it has to prepare an Equal Employment Opportunity Plan (EEOP) and submit it to the Office for Civil Rights ("OCR"), Office of Justice Programs, 810 7th Street, N.W., Washington, DC 2053 I, for review within 60 days of the notification of the award. If your organization received an award between $25,000 and $500,000 and has 50 or more employees, your organization still has to prepare an EEOP, but it does not have to submit the EEOP to OCR for review. Instead, your organization has to maintain the EEOP on file and make it available for review on request. In addition, your organization has to complete Section B of the Certification Form and return it to OCR. If your organization received an award for less than $25,000; or if your organization has less than 50 employees, regardless of the amount of the award; or if your organization is a medical institution, educational institution, nonprofit organization or Indian tribe, then your organization is exempt from the EEOP requirement. However, your organization must complete Section A of the Certification Form and return it to OCR. SECTION 158: CERTIFICATIONS ... Regarding Lobbying; Debarment, Suspension and Other Responsibility Matters; Drug-Free Workplace Requirements; Coordination with Affected Agencies. Although the Department of Justice has made every effort to simplify the application process, other provisions of federal law require us to seek your agency's certification regarding certain matters. Applicants should read the regulations cited below and the instructions for certification included in the regulations to understand the requirements and whether they apply to a particular applicant. Signing this form complies with certification requirements under 28 CFR Part 69, "New Restrictions on Lobbying," 2 CFR Part 2867, "Nonprocurement Debarment and Suspension" 28 CFR Part 83 Government-Wide Requirements for Drug-Free Workplace (Grants)," and the coordination requirements of the Public Safety Partnership and Community Policing Act of 1994. Debarment, Suspension and Other Responsibility Matters (DirectRecipient) As required by Executive Order 12549, Debarment and Suspension, and implemented at 2 CFR Part 2867, for prospective participants in primary covered transactions, as defined at 2 CFR Part 2867.20(a)- A. Drug-Free Workplace (Grantees Other Than Individuals) As required by the Drug- Free Workplace Act of 1988, and implemented at 28 CFR Part 83, for grantees/recipients, as defined at 28 CFR Part 83.660- A. The applicant certifies that it will, or will continue to, provide a drug- free workplace by: (i) Publishing a statement notifying employees that the unlawful manufacture, distribution, dispensing, possession or use ofa controlled substance is prohibited in the grantee's workplace and specifying the actions that will be taken against employees for violation of such prohibition; (ii) Establishing an on-going drug-free awareness program to inform employees about - (a) The dangers of drug abuse in the workplace; (b) The grantee's policy of maintaining a drug-free workplace; (c) Any available drug counseling, rehabilitation and employee assistance programs; and (d) The penalties that may be imposed upon employees for drugabuse violations occurring in the workplace; SECTION 15B: CERTIFICATIONS (iii) Making it a requirement that each employee to be engaged in the performance of the grant be given a copy of the statement required by paragraph (i); (iv) NotifYing the employee in the statement required by paragraph (i) that, as a condition of employment under the grant, the employee will- (a) Abide by the terms of the statement; and (b) NotifY the employer in writing of his or her conviction for a violation of a criminal drug statute occurring in the workplace no later than five calendar days after such conviction; (v) Notifying the agency, in writing, within 10 calendar days after receiving notice under subparagraph (iv)(b) from an employee or otherwise receiving actual notice of such conviction. With the use of the automatic tag readers the squad, along with investigators that supplement their investigations, will be able to protect the citizens within city limits by monitoring vehicles and their operators. The tag readers will allow officers to identify stolen vehicles, Amber Alert vehicles, stolen tags, wanted or missing persons, and drivers whose driving privileges have been suspended. Thc dcpartmcnt implemcntcd a program to outfit cvcry police car in the department with a computer that is linkcd with thc communications office. This allows officcrs to be dispatchcd to calls and communicatc with communications via a computer. Duc to budgct constraints the city has bccn forccd to limit its cxpcnditures for the policc department. This limiting of expenditures left administrators with an important decision to make. Keep jobs or limit the amount of money allocated to the tcchnology improvement program. With the grant funds thc police departmcnt will seek to enhance several tcchnology programs to include automatic tag reader systcms, a radio station, and dcfibrillators. One problem being perpetrated within city limits is the prevalence of stolen vchicles that are recovered in the city but are stolen from other jurisdictions. This disturbing trend is supported by the 2009 Uniform Crime Reports. According to the 2009 UCR's, 78.5% of stolen vehicle recoveries within our city limits are from outside jurisdictions. This tells us that the city/beach is inviting to thieves who steal vehicles and come to the beach to pray on beachgoers or just for the typical joyride. Defibrillators According to figurcs compiled during the 2000 ccnsus the median age within the city was 50.4 years old compared to the national average of35.3 ycars old. The City of Sunny Islcs Beach originally assigned twenty-eight (28) Heart Stream, Automatic External Defibrillators in our police vehicles for response to medical emergencies. Emergency mcdical calls are one of the most prevalent calls handled by our patrol officers. In 2009 the policc department handled 931 medically related calls. That means that officers are responding to 2.55 medical callas a day. As of now the defibrillators that were assigned to patrol vehicles are becoming technologically obsolcte and in need of rcpair or replacement. New technology in current defibrillators allows for a bctter post event medical rcvicw and tracking. New defibrillators also allow for use on adult and pediatric patients. Advisory Radio Station The City of Sunny Isles Beach is a barrier island located on thc southeast coast of Florida and is home to many elderly residents and visitors from around thc world. One problem this city has faced year aftcr year is the dissemination of critical information to our residents and visitors in a timcly manner. Bcing a coastal community, there are many cascs where the rapid dissemination of information may save lives; Bcach Conditions or closures, weather events, cvacuation notices, ctc. Being a community of many elderly residents with limited mobility, somctimcs the radio is thcir only sourcc of information and it is important to provide them with specific local detailed information. Uninterrupted Power Supply The Sunny Islcs Bcach Police Department has always strived to be a technologically progressive agency. In 2006 the police department implemented a state of the art police software to include; Computer Aidcd Dispatch, Mobile Data Tcrminals, Mobile Field Reporting and Records Management System. Although this software system is state of the art, the strain and power draw that the additional computer hardwarc has bccn placed on our battery power source has been disabling at times. B. Dcfibrillators With the usc of fcderal grant funds, Thc Sunny Isles Beach Policc Department would purchasc forty- eight (48) Automatic External Defibrillators (AED's) replacing thc oldcr obsolete units that arc currently assigned to some of the policc vehicles. Our objectivc would be to have enough Automatic External Defibrillators to assign one to cach officer rather thcn thc vchicle, eliminating thc possibility that an officer would rcspond to a cardiac medical cmcrgency and not havc an AED available. Being that the Sunny Isles Beach Policc Dcpartment participates in the take home vehicle program, where each officer drivcs their marked/unmarked vehicle homc with them, this would also bc placing forth- eight additionallifc saving tool on the street throughout thc surrounding citics and countics in the case of an cmcrgcncy. Advisory Radio Station With thc usc of federal grant funds, Thc Sunny Isles Beach Police Department would purchase an Advisory Radio Station. Our objective is to find a reliable method of disseminating critical information to our rcsidcnts and visitors in a timely manner. With thc implementation of an advisory radio station, it is the goal of thc police department to develop an early warning system to provide our rcsidcnts with information that may save livcs; Beach Conditions or closures, weather evcnts, evacuation notices, traffic hazards or advisories, etc. According to a query performed using thc NOAA Satellite and Information Scrvicc thcrc have bcen 492 weathcr related events since thc Sunny Isles Beach Police Departmcnt was cstablished in August of 1998. Being a community of many elderly residents with limited mobility, sometimes the radio is thcir only source of information and it is important to providc them with specific C. After six (6) months of operation, Uniform Crime Reports will be compared. Defibrillators If this grant is approved and the federal funds are awarded, The Sunny Isles Beach Policc Department will submit a request within two weeks to purchase forty-eight (48) Automatic External Defibrillators (AED's) utilizing the city's normal procurement process. This project will be supervised by the administrative division of the police dcpartment, issued and maintained through the police quartcrmaster and monitored by the Miami-Dade County Mcdical Review Physician. Once the dcfibrillators are received, inventoried and tagged, they will be cleared by the medical revicw physician and should bc issued to each officer within two weeks. Each and every use of the defibrillators will bc documented by a police report as well as the data download from the defibrillators to be reviewed by the medical review physician. Advisory Radio Station If this grant is approved and the federal funds arc awarded, The Sunny Islcs Beach Police Department will submit a request within two weeks to purchase the Advisory Radio Station utilizing the city's normal procurcment process. This project will be supcrvised by the administrative division of the police department, but managed and opcratcd by the cities video services unit of the information tcchnology department. Once the purchase order is issued by the city, application to the Federal Communications Commission (FCC) will be made by the vcndor for an FCC License. This process takes approx. 2-4 weeks. Once the license is issued, the advisory radio station should be fully installed and operational within 90 days.
