HomeMy WebLinkAboutReso 2010-1581 ..;J RESOLUTION NO. 2010- ~ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE CRIME CONTROL ACT OF 1984 TO EXPEND UP TO SEVENTY -FIVE THOUSAND DOLLARS ($75,000.00) FROM THE PARTIAL FEDERAL FORFEITURE (DOJ) FUNDS FOR THE PURCHASE OF MISCELLANEOUS INVESTIGATIVE EQUIPMENT TO BE USED BY THE POLICE DEP ARTMENT'S DETACHED DETECTIVE AND HIS DEA, HIDT A GROUP; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City and its Police Department are authorized to expend forfeiture funds from the established Department of Justice (DOJ) federal forfeiture account, for the approved programs or purchases intended to enhance law enforcement purposes; and WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, upon the request of the Chief of Police to the governing body of a municipality, federally forfeited funds may be expended if accompanied by written certification that the request complies with the provisions of the Comprehensive Crime Control Act of 1984; and WHEREAS, the Chief of Police has submitted a request for the expenditure of up to Seventy-Five Thousand Dollars ($75,000.00) in federally forfeited funds in compliance with the aforementioned. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached certification, the Chief of Police is hereby authorized to spend up to $75,000.00 from the established Department of Justice (DOJ) federal forfeitures account for the purchase of miscellaneous investigative equipment to be used by the Police Department's detached Detective and his DEA, HIDTA Group. Section 2. Effective Date. This Resolution shall become effective immediately upon adoption. PASSED AND ADOPTED this 15th day of July 2010. Investigative Equipment Technology equipment to include: Laptop Computers, Cameras, GPS, Combat Flashlights, Binoculars and Law Enforcement Vehicle $ 45,000.00 Lighting (Red/Blue). . Vehicle Firearm Vaults Mobile Firearm vaults for police vehicles without trunks (SUV's) to safely secure police rifles. $ 17,500,00 . Mobile Training Trailer 5x8 Single axle enclosed aluminum trailer equipped with necessary training supplies to conduct on site firearms and miscellaneous $ 12.500.00 tactical training. Certification I, Fred A. Grandinetti, Police Captain 7/15/2010 Approval to Expend Partial Forfeiture (DOJ) Funds for the purchase of a Training Trailer, Vehicle Rifle Vaults and miscellaneous investigative equipment to be used by our detached detective and his DEA, HIDTA group, in an amount not to exceed $75,000.00 RECOMMENDATION: It is recommended that the City Commission approve the expenditure of partial Federal (DOJ) Forfeiture Funds, previously awarded to the Police Department as the results of investigative participation in forfeiture and seizure cases. These funds are permissible by law to be spent for the purchases of police equipment and other law enforcement activities. It is requested that we be permitted to utilize up to $75,000.00 of said funds on deposit for such purpose. REASONS: The Sunny Isles Beach Police Department actively participates in a DEA I HIDTA (High Intensity Drug Trafficking Area) Initiative Group that conducts numerous ongoing proactive investigations and has a need for the attached listed equipment. ADDITIONAL INFORMATION: One of the benefits of participating in and providing personnel into high intensity narcotics investigations is the sharing of confiscated proceeds for the enhancement of law enforcement.
