A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, APPROVING CHANGE
ORDER NO. 1 TO AGREEMENT WITH FORTIN, LEAVY,
SKILES, INC. TO PROVIDE ADDITIONAL PLATTING
SERVICES FOR THE GOVERNMENT CENTER, IN AN
AMOUNT NOT TO EXCEED FIVE THOUSAND ONE HUNDRED
SIXTY-FIVE DOLLARS AND NINETY-EIGHT CENTS ($5,165.98),
ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE
CITY MANAGER TO DO ALL THINGS NECESSARY TO
EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the property lines of the Government Center includes City Hall and the
Tony Roma's property; and
WHEREAS, the City is in need of a Surveyor to prepare a tentative plat to subdivide the
Government Center parcel into two separate parcels; and
WHEREAS, under Resolution No. 2009-1385, Fortin, Leavy, Skiles, Inc. agreed to
provide platting services for the Government Center for an amount not to exceed Twenty-Five
Thousand Dollars ($25,000.00); and
WHEREAS, due to unknown issues involving the platting of the property, the City
requested additional services from Fortin, Leavy, Skiles, Inc. in the preparation of the tentative
plat; and
WHEREAS, Fortin, Leavy, Skiles, Inc. will provide the additional platting services for
the Government Center for an amount not to exceed Five Thousand One Hundred Sixty-Five
Dollars and Ninety-Eight Cents ($5,165.98) for a total contract amount not to exceed Thirty
Thousand One Hundred Sixty-Five Dollars and Ninety-Eight Cents ($30,165.98).
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Change Order No. 1 to Agreement. The Change Order No. 1 to
Agreement with Fortin, Leavy, Skiles, Inc. to provide additional platting services for the
Government Center, in an amount not to exceed Five Thousand One Hundred Sixty-Five Dollars
and Ninety-Eight Cents ($5,165.98) for a total contract amount not to exceed Thirty Thousand
One Hundred Sixty-Five Dollars and Ninety Eight Cents ($30,165.98), is hereby approved.

Section 2. Authorization of the City Manager. The City Manager is hereby authorized to do
all things necessary to effectuate this Resolution.
Section 3.
Effective Date. This Resolution will become effective upon adoption.

Change Order #1 to contract with Fortin, Leavy, Skiles Inc.
RECOMMENDATION:
Staff recommends approval of the attached resolution.
REASONS:
The City requested the surveying services of Fortin, Leavy, Skiles Inc to prepare a
tentative plat for the Government Center and adjoining parcels. The purpose of this
platting is for the City to receive property tax exemption from the County on the property
that the is used for public use by separating the Tony Romas restaurant from the
government use areas. The City Commission approved this contract for $25,000. under
Resolution 2009-1385. However, due to complications in the property search and
easement, the surveyors needed to do additional work. The plat has already been
recorded and now the surveyors are requesting compensation for the additional work not
contemplated under the original contract. The change order for the additional work
performed is for an amount not to exceed $5,165.98.
